SEPTEMBER 17, 2024, THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS 

The Board of Supervisors met on Tuesday, September 17, 2024, at 4:30 p.m.  Board members present were Ung, Radig, Taylor, Bittinger II, and Nelson. Staff members present were Karen James, Board Administrative Assistant, Melissa Thomas, Human Resources Director, and Patrick Gill, Auditor/Clerk to the Board. 

The regular meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.

Motion by Radig second by Ung to approve the agenda for September 17, 2024.  Carried 5-0.   Copy filed.

Motion by Taylor second by Ung to approve the following items by consent:

To approve minutes of the September 10, 2024, meeting.  Copy filed.
    
To approve the claims totaling $705,923.28.  Copy filed.

To approve the lifting of tax suspension for petitioners who failed to re-certify their income or income does not qualify for continued tax suspension.  Copy filed.

To approve the items to be auctioned per Personal Property Disposition Policy.  Copy filed.

To approve the appointment of Andrew DeMers, Assistant County Attorney, County Attorney Dept., effective 09-18-2024, $79,069.00/year. Job Vacancy Posted on 03/26/2023.  Entry Level Salary:  $79,069.00.; the separation of Laura Kinnaman, Custodian, Building Services Dept., effective 09-27-24.  Retired.; the separation of Jose Perez, Civilian Jailer, County Sheriff Dept., effective 10-04-2024.  Resignation.; the separation of Delayne Folsom, Equipment Operator, Secondary Roads Dept., effective 01-10-2025.  Retired.; and the separation of Tracy Nelson, Court Security Officer, County Sheriff Dept., effective 01-06-2025.  Retired.  Copy filed.

The 1st Day of October, 2024 at 4:35 o’clock p.m. in the basement of the   
Woodbury County Courthouse. 
      
2.   That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 1st Day of October, 2024, immediately
following the closing of the public hearing.

Motion by Taylor second by Ung to approve the plans for project #L-B(K19)—73-97.  Carried 5-0.  Copy filed.

Motion by Nelson second by Taylor to approve the plans for project #FM-CO97(152)—55-97.  Carried 5-0.  Copy filed.

The Board recessed for a meeting of the Bennett McDonald Levee & Wolf Creek Drainage Districts Trustees meeting.

The Supervisors meeting was called back to order.

Motion by Nelson second by Ung to receive the county staff report concerning proposed amendments to Ordinance #56:  An Ordinance Regulating Commercial Wind Energy Conversion Systems.  Carried 5-0.  Copy filed.

Motion by Nelson second by Taylor to receive written comments from MidAmerican Energy Company regarding the Woodbury County wind ordinance.  Carried 5-0. Copy filed.

A public hearing was held at 4:45 p.m. for proposed revisions to Woodbury County ordinance #56, including amending Sections 5.2.D, 6.1.A, 6.2, 7 and 7.1.C, which regulate Commercial Wind Energy Conversion Systems (C-WECS) in unincorporated Woodbury County.  The amendments address changes to the C-WECS application process, submission requirements, siting and design standards, including setbacks, protected areas, setback waiver limitations, as well as updates to discontinuance and decommissioning plan requirements.  The Chairperson called on anyone wishing to be heard.

Larry Fillipi, Anthon, presented documents to the Board regarding wind turbines.

Motion by Taylor second by Ung to receive documents from Larry Fillipi.  Carried 5-0.  Copy filed.

Tim Hoy, Anthon, Steve Corey, Salix, Jacob Joliet, Urbandale, Doyle Turner, Moville, Daniel Hair, Hornick, Ron Bohle, Pierson and Kim Alexander, Smithland, addressed the Board in regards to the proposed wind ordinance.

Motion by Ung second by Nelson to close the public hearing.  Carried 5-0.

Motion by Ung second by Bittinger to approve the 1st reading.  Carried 5-0.

Motion by Taylor second by Radig to approve to use the remaining $2,198.05 Emergency Services Doors CIP balance for a new CIP to make a partial payment for a firefighting skid unit for EMS.  Carried 5-0. Copy filed.

Daniel Bittinger, Board of Supervisors, and Anna Bertrand and Sierra Mohr, Sky Rance Behavioral Services, presented information on Opioid remediation settlement request and proposal from Sky Rance Behavioral Services for 3 F.T.E. positions.  Copy filed.

Matthew Ung, Board of Supervisors, and Daniel Bittinger, Board of Supervisors, presented a joint statement regarding MOU with Attorney’s union.  Copy filed.

There was no action taken to give direction for the Chairman to draft a resolution to be approved at a subsequent meeting, regarding the official position of the Woodbury County Board related to the MOU with AFSCME Council 61 Local 3462 (the attorney’s union).  Copy filed.

Motion by Taylor second by Nelson to designate Mark Nelson and Keith Radig to work with the County Attorney’s Union (AFSCME representatives) to negotiate a memorandum of understanding to address staffing issues in the County Attorney’s Office.  Carried 4-1 on a roll call vote; Ung was opposed.  Copy filed.

Motion by Taylor second by Radig to approve naming the “Old Board of Supervisors Chambers” the “Butler Meeting Room” and dedicate up to $1,500 in gaming revenue and set the intent for a dedication of that room at a future time certain.  Carried 5-0.  Copy filed.

Reports on committee meetings were heard.

There were no citizen concerns.

Board concerns were heard.

The Board adjourned the regular meeting until September 24, 2024.
