NOVEMBER 8, 2016, FORTYTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, November 8, 2016 at 4:30 p.m. Board members present were Monson, Ung, Taylor, Smith, and Clausen. Staff members present were Dennis Butler, Budget/Tax Analyst, Karen James, Board Administrative Coordinator, Ed Gilliland, Human Resources Director, Abigail Sills, Assistant County Attorney and Michelle Skaff, Deputy Auditor/Clerk to the Board.
The meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.
Citizen concerns.
Motion by Monson second by Ung to approve the Agenda for November 8, 2016. Carried 5-0. Copy filed.
Motion by Monson second by Ung to approve the minutes of the November 1, 2016 Board meeting. Carried 5-0. Copy filed.
Motion by Clausen second by Taylor to approve the claims totaling $581,381.28. Carried 5-0. Copy filed.
Motion by Clausen second by Smith to approve and authorize the Chairperson to sign a Resolution for petition for suspension of taxes through the redemption process for Diane Christiansen, 2750 140th St., parcel #894429100010. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS
WHEREAS, Diane Christiansen as joint titleholders of a property located at 2750 – 140th Street, Moville, Iowa, Woodbury County, Iowa, and legally described as follows:
Parcel # 894429100010
ARLINGTON TOWNSHIP IRREG TCT LYING IN THE NW NE & NE NW
WHEREAS, Diane Christiansen, as joint titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem this property Parcel #894429100010 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.9, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

A public hearing was held at 4:35 p.m. for the sale of parcel #001725, 609 W. 1st St. The Chairperson called on anyone wishing to be heard.
Motion by Smith second by Taylor to close the public hearing. Carried 5-0.
Motion by Monson second by Clausen to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Jose and Ana Crispin, 602 W. 1st St., Sioux City, for real estate parcel #001725, 609 W. 1st St., for $177.00 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By Jose M. Crispin and Ana M. Crispin in the sum of One Hundred Seventy-Seven Dollars & 00/100 ($177.00)-----------------------------------------------------dollars.
For the following described real estate, To Wit:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

Motion by Monson second by Taylor to approve and authorize the Chairperson to sign a Resolution authorizing tax abatement for Christopher Thomas Utesch, building on leased land for mobile home that was burned in a fire, parcel #894432131925, taxes for 2016-2016, total for $8.00 plus interest. Carried 5-0.

WHEREAS, the abovestated property has taxes payable Including special assessments and the parcel is owned by Christopher Thomas Utesch.
WHEREAS, these taxes are uncollectable or impractical to pursue collection through personal judgment or tax sale
WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Smith second by Taylor to authorize the Chairperson to sign the Authorization to initiate the hiring process for Civilian Jailer, County Sheriff Dept., CWA $18.00/hour and Clerk III, County Treasurer Dept., AFSCME: $18.94/hour. Carried 5-0. Copy filed.
Motion by Monson second by Taylor to approve the underground utility permit for Western Iowa Telephone for installation of telecommunication lines on D-12/110th St. Carried 5-0. Copy filed.
Motion by Smith second by Clausen to receive for signatures a Resolution closing and vacating a road right of way. Carried 5-0
RESOLUTION #12,464
WOODBURY COUNTY, IOWA
A RESOLUTION CLOSING AND VACATING A ROAD RIGHT OF WAY
WHEREAS, the Monona County Board of Supervisors in accordance with Section 306.11, (Code of Iowa) 2015, as amended, on September 28, 2015 held a public hearing on the proposed vacation of Woodbury-Monona County Line Secondary Road Right-Of-Way described as follows:
A portion of Woodbury- Monona County Line Road, also described as 340th Street (Monona County Road name is 100th Street), beginning at the SW corner of Section 31 T86N R46W of the 5th P.M. thence east along the section and county line approximately 2740 feet. Said right of way was established at 66 feet with the Woodbury County portion to be vacated at 33 feet in width. Said right of way was dedicated to the county by easement
WHEREAS, no objections were received in either writing or by persons present.
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that all interest in the subject section of road right-of-way be vacated, subject to utility easements of record for ingress and egress.

WOODBURY COUNTY BOARD OF SUPERVISORS

Motion by Monson second by Taylor to approve CMBA Architects to proceed with the project bid letting for structural and window repairs at the Woodbury County Courthouse. Carried 5-0. Copy filed.
