FEBRUARY 24, 2015 — NINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 24, 2015 at 9:30 a.m.  Board members present were Clausen, Ung, Monson, Taylor, and Smith.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

Motion by Clausen second by Taylor to go into closed session per Iowa Code 21.5(1)(c).  Carried 5-0 on roll-call vote.

Motion by Taylor second by Smith to go out of closed session per Iowa Code 21.5(1)(c).  Carried 5-0 on roll-call vote.

The meeting was called to order – Pledge of Allegiance to the Flag – Moment of Silence.

There was time allowed for Citizen concerns.  

Motion by Taylor second by Monson to approve the Agenda for February 24, 2015.  Carried 5-0.  Copy filed.

Motion by Taylor second by Ung to approve the minutes of the 02/17/2015 Board meeting.  Carried 5-0. Copy filed.  

Motion by Taylor second by Monson to approve the county’s claims totaling $763,924.17.   Carried 5-0.  Copy filed.

Motion by Ung second by Clausen to receive a report on the Policy for Time Clock and Missed Punches and to implement a plan to enforce the existing policy.  Carried 5-0.  Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairperson to sign a Resolution approving petition for suspension of taxes for Catherine Goertz, 1219 Virginia St, parcel #894728205010.  Carried 5-0. 

WOODBURY COUNTY, IOWA

RESOLUTION #12,135

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Catherine Goertz, is the titleholder of property located at 1219 Virginia Street, Sioux City, IA,  Woodbury County, Iowa, and legally described as follows:        Parcel #      8947 28 205 010  

SIOUX CITY EAST LOT 11 BLK 105     

WHEREAS, Catherine Goertz,  is the titleholder of the aforementioned properties have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension  for this property.

SO RESOLVED this 24th  day of  February, 2015

 RESOLUTION OF THE BOARD OF SUPERVISORS

OF WOODBURY COUNTY, IOWA

RESOLUTION #12,136

WHEREAS due to clerical error, Resolution #12,072, passed and approved by the Woodbury County Board of Supervisors on September 9, 2014, incorrectly listed Viking Education Services as the purchaser of certain real estate described herein.

WHEREAS Victory Education Services was the high bidder at public auction on September 9, 2014 for the described real estate and has tendered payment for the described real estate.

NOW BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that Resolution #12,072 is hereby rescinded.

BE IT FURTHER RESOLVED that the offer at public auction of:

  Victory Education Services in the sum of Three Hundred Nineteen Dollars & 00/100 ($319.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:    

Parcel #004755

The Westerly 49 feet of the Easterly 116 feet of Lot 17 in Block 18 Sioux City Addition in the County of Woodbury and

State of Iowa

(117 Sioux Street Unit A)           

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Corrective Deed for the said premises to the said purchaser.

Motion by Ung second by Smith to approve and authorize the Chairperson to sign Corrective Deed for parcels #004755 & #004740 (117 Sioux St., Unit A and 117 Sioux St., Unit B).  Carried 5-0.

Motion by Clausen second by Ung to approve and authorize the Chairperson to sign a Base Reallocation and Yield update (USDA Form CCC-858) for the County Farm.  Carried 5-0.  Copy filed.

Motion by Monson second by Taylor to commit $200,000 of Local Option Sales tax funds for FY 2014-15 and $200,000 for FY 2015-16 to the Investing in Woodbury County Loan Program.  Carried 5-0. 

Motion by Smith second by Ung to receive the award of a MidAmerican Energy Local Partners Program grant to receive $860 for professional development.  Carried 5-0.

Motion by Smith second by Clausen to approve and authorize the Chairperson to sign a policy for the disposal of excess secondary road department materials.  Carried 5-0.  Copy filed.

Motion by Clausen second by Taylor to approve and receive for signatures plans for letting for project # FM-CO97(122)—55-97, HMA Surfacing on Correctionville Road from K-49 to US 20.  Carried 5-0.  Copy filed.

There was a discussion on late fees incurred on county credit cards and suggested improvements to the process.

There was a discussion on parking spots at the Veteran Affairs offices and the utility billing process.

Motion by Clausen second by Smith to approve and authorize the Chairperson to sign a contract for At-Risk Youth Outreach Services between Woodbury County, Iowa and Sanford Center for the balance of the 2015 FY ending June 30, 2015.  Carried 4-1; Taylor opposed.  Copy filed.

Motion by Smith second by Taylor to approve and authorize the Chairperson to sign a GTS Professional Services Agreement providing services for the online tax sale.  Carried 5-0.  Copy filed.

It was confirmed by the Chairman that the new start time of 4:30 PM for board meetings will begin March 3rd.

The was a discussion of the creation of a document for board meeting procedures.  

Motion by Taylor second by Ung to recess the Board of Supervisors Meeting for an Orton Slough Drainage District Meeting.

The Board of Supervisor’s meeting was called back to order.

Board members gave reports on committee meetings.

There was time allowed for citizen’s concerns.

Rick Schneider, Conservation Director, discussed reporting requirements for county owned farm ground.

Board concerns and comments.

Motion by Monson second by Taylor to approve the elimination of Juvenile Detention line item 4261 $3,000 in the proposed 2015-16 budget and stop the practice in current fiscal year.  Carried 3-2; Clausen and Smith were opposed.

Dennis Butler, finance director, provided an update on the county’s budgets, tax askings, and tax rates.

The Board adjourned the regular meeting until March 3, 2015.
