APRIL 15, 2014 — SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 15, 2014 at 10:00 a.m.  Board members present were Clausen, Monson, Tripp, Smith, and Boykin.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.  

Motion by Monson second by Tripp to approve the minutes of the 04/08/2014 Board meeting.  Carried 5-0.  Copy filed.  

Motion by Tripp second by Smith to approve the county’s claims totaling $393,926.39.  Carried 5-0.  Copy filed.

Motion by Smith second by Clausen to approve the reclassification of Zachary Lux, Service Officer, Veteran Affairs Dept., effective 04/23/14, $18.47/hour, 4%=$.71/hour. Per Wage Plan comparability with AFSCME Courthouse Contract, from Grade 5/Step 1 to Grade 5/Step 2.; the reclassification of Alesha Bieler, Secretary III, County Attorney Dept., effective 04/24/14, $18.47/hour, 4%=$.71/hour.  Per AFSCME Courthouse Contract agreement from Grade 5/Step 1 to Grade 5/Step 2.; and the reclassification of Diane Murphy, Asst. County Attorney, County Attorney Dept., effective 04/30/14, $70,886/year, 7.9%=$5,242/year. Per AFSCME Asst. County Attorney Contract agreement, from Step 6 to Step 7.  Carried 5-0.  Copy filed.

An update on the Woodbury County Wellness and Health Plan was provided by Ed Gilliland and Gloria Mollet.  Copy filed.

Motion by Clausen second by Monson to lift the suspension of taxes for Barbara Springer, 2120 Metropolitan St., Sioux City, Parcel #894823130003.  Carried 5-0.  Copy filed.

Motion by Clausen second by Monson to lift the suspension of taxes for John Smith, 1500 Lansdown Ave., Sioux City, Parcel #894723360001.  Carried 5-0.  Copy filed.

Motion by Clausen second by Monson to lift the suspension of taxes for Kirk Dahlheimer, 3319 E. 6th St., Sioux City, Parcel #894726327013.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to receive as submitted the Recorder’s Report of Fees Collected for the period of 01/01/14 through 03/31/14.  Carried 5-0.  Copy filed.

A quarterly update from Rural Economic Development was provided by David Gleiser, Rural Economic Development Director.

Motion by Monson second by Tripp to approve and receive for signatures a Resolution Proclamation for National Public Safety Telecommunications Week.  Carried 5-0.

RESOLUTION #11,983

NATIONAL PUBLIC SAFETY TELECOMMUNICATIONS WEEK

WHEREAS,   Woodbury County Communications will honor the men and women who serve as public safety dispatchers during National Public Safety Telecommunications Week, April 13 – 19, 2014 and

WHEREAS,    introduced to Congress in 1991, National Public Safety Telecommunications Week is the second full week of April each year.  This week is dedicated to public safety telecommunicators who aid in providing 9-1-1 emergency assistance to citizens everywhere, and

WHEREAS,     everyday, millions of people depend on the skill, expertise and commitment of the men and women who work in public safety telecommunications.  These individuals help save countless lives by responding to emergency calls, dispatching emergency professionals and equipment and providing moral support to citizens in distress, and

WHEREAS,    the term “9-1-1” is often associated with rapid emergency response, poise under pressure, aid and compassion in times of distress and critical decision-making within seconds.  Many people don’t stop to think about these seemingly nameless, faceless individuals until they experience actual emergencies themselves.  These professionals make the difference between life and death in many instances.

THEREFORE, The Woodbury County Board of Supervisors do hereby proclaim

APRIL 13-19, 2014

AS

NATIONAL PUBLIC SAFETY TELECOMMUNICATIONS WEEK

in Woodbury County, Iowa, in honor of the men and women whose diligence and professionalism keep our county and citizens safe.

Motion by Monson second by Tripp to approve the FY 2015 Iowa DOT Budget.  Carried 5-0.  Copy filed.

Motion by Monson second by Smith to approve the FY 2015-2019 Iowa DOT Construction Program.  Carried 5-0.  Copy filed.

Motion by Monson second by Clausen to award the bid for Centerline Repairs on Hwy 141 to Midwest Coatings for $79,600.  Carried 5-0.  Copy filed.

Motion by Smith second by Monson to approve and authorize the Chairperson to sign a Resolution for 2014 Weed Destruction Order.  Carried 5-0. 

WOODBURY COUNTY, IOWA

RESOLUTION #11,982

WEED DESTRUCTION ORDER

WHEREAS, it is the responsibility of each of Iowa County’s Board of Supervisors to enforce the provisions of Chapter 317 of the Code of Iowa as amended with regard to the destruction of weeds, and

WHEREAS, under Chapter 317 of the Code of Iowa as amended each county Board of Supervisors must prescribe and order a program of weed destruction to be followed by landowners, tenants, and other persons in possession or control of land, and

WHEREAS, it has been determined by the Woodbury County Board of Supervisors that a program of weed destruction for the year 2014 is necessary,

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that each landowner, tenant or other person in possession or control of private land shall on or before the dates stated below, destroy the below-listed noxious weeds on their land by spraying them with a suitable herbicide in a strength sufficient to kill such weeds.

1. May 19, 2014 - for musk, thistle, sow thistle, bull thistle, leafy spurge, perennial pepper grass, sour dock perennial, smooth dock perennial, and sheep sorrel perennial.

2. June 2, 2014 - for Canada thistle, Russian knapweed, buckhorn perennial, wild mustard annual, horse nettle, and teasel biennial.

3. June 9, 2014 - for field bindweed, wild carrot biennial, and quack grass.

4. June 16, 2014 - for butterprint annual, puncture vine annual, and cocklebur annual.

5. July 7, 2014 - for wild sunflower annual and poison hemlock.

6. October 6, 2014 - all thistles in the rosette stage.

BE IT FURTHER RESOLVED AND ORDERED that any person using county road Right-of-Way for haying or grazing are responsible for following the labeled restrictions listed on the following products used by Woodbury County Weed Commissioner: Grazon P&D, Streamline, and Perspective.

BE IT FURTHER RESOLVED AND ORDERED that all weeds on county trunk and local roads and between the fence lines of such roads, whether they be noxious weeds or other weeds, shall be cut or otherwise destroyed, to prevent seed production, by the owner of the land adjoining the road on or before June 19, 2014.

BE IT FURTHER RESOLVED that weeds that are not destroyed in compliance with the above order may be destroyed by the Weed Commissioner, and the costs of destruction by the Weed Commissioner, including the cost of serving notice, plus a penalty of twenty-five percent of total costs shall be assessed against the property upon which the weeds were destroyed, in the case of private lands, or against the adjoining land, in the case of weeds on county roads.  Landowners are to contact Weed Commissioner and notify him if there are areas that should not be sprayed with herbicides.

Motion by Tripp second by Clausen to approve and authorize the Chairperson to sign a permit for use of County Road/Highway Right-of-Way for overhead and/or buried utilities accommodation for CF Nitrogen at 2480 Port Neal Road.  Carried 5-0.  Copy filed.

Motion by Smith second by Clausen to approve and authorize the Chairperson to sign a 28E agreement for Sioux Rivers Regional Mental Health and Disabilities Services.  Carried 5-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Jim Gengler, addressed the Board with concerns about a large number of demolished homes in Sioux City.

The Board adjourned the regular meeting until April 22, 2014.
