MARCH 30, 2010 — THIRTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

 

The Board of Supervisors met on Tuesday, March 30, 2010 at 9:00 a.m.  Board members present were Boykin, Clausen,

Monson, Smith, and Walish.  Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

 

The Claims were approved as presented.  Copy filed.

 

The meeting was called to order.

 

Motion by Walish second by Monson to approve the Board minutes of the March 23, 2010 meeting as submitted.  Carried 5-0.  Copy filed.

 

Motion by Monson second by Clausen, due to emergency, add an item to the agenda for the consideration of requested road embargos.  Carried 5-0.

 

The Board approved the separation of Angela K. Larson, Civilian Jailer, County Sheriff Dept., effective 03/23/2010.  Resignation.  Copy filed.

 

Motion by Clausen second by Smith to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” form for a female Civilian Jailer, County Sheriff Dept.  Entry Level:  DSDOA/CWA: $16.16/hour.  Carried 5-0.  Copy filed.

 

Bid opening was held at 10:05 for the first floor restrooms for Patty Erickson-Puttmann, Social Services Coordinator.  The bids were as follows:

 

H W Design Build, Sioux City, Iowa                             $30,799.00

HCI Construction, South Sioux City, Nebraska          $32,372.00

Holtze Construction Company, Sioux City, Iowa       $40,400.00

 

Motion by Clausen second by Smith to submit the bids to the architect, for review and recommendations.  Carried 5-0.  Copy filed.

 

The Board discussed action on the Tri State Behavioral Health Association contract.

 

Motion by Clausen second by Walish to terminate the contract with Tri State Behavioral Health Association.  Carried 5-0.

 

Motion by Monson second by Walish to receive the appointment of Loyanne Jensen, 501 Erin’s Cove, Lawton Iowa, to the Woodbury County Library Board of Directors, to fill the office previously held by Mary Gerking who has resigned.  Carried

The Board presented retiring County employee John B. Priestley, with a Resolution thanking and commending him for his years of service as a Woodbury County employee.

 

Bid letting was held at 10:20 for Project L-EWP06(1)—73-97 for Secondary Roads Dept.  The bids were as follows:

Motion by Clausen second by Smith to receive the bids and submit to Mark Nahra, County Engineer, for review and recommendation.  Carried 5-0.  Copy filed.

 

Motion by Walish second by Monson to approve plans for Project BRS-CO97(101)—60-97 (bridge and approaches on 220th Street over Wolf Creek), per recommendation of the County Engineer.  Carried 5-0.

 

Motion by Clausen second by Smith to approve and authorize the Chairman to sign an agreement for “Adopt-A-Highway” by River City Anglers, for Highway K-25 from the I-29 Salix exit to the entrance road to Snyder Bend Park, per recommendation of County Engineer.  Carried 5-0.  Copy filed.

 

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Permit and agreement for use of County Road Right-of Way, submitted by Niewohner Construction, Onawa IA, for reconstruction of Buchanan Avenue from 275th Street to Old Highway 75.  Carried 5-0.  Copy filed.

 

Motion by Smith second by Clausen to award the bid for the first floor restrooms to the low bidder, H W Design Build, per recommendation of the architect.  Carried 5-0.  Copy filed.

 

Shirley Frederiksen, Golden Hills RC&D, discussed with the Board the “Low Impact Development and Storm Water Guidance” manual.

 

Motion by Smith second by Clausen to approve participation with the City of Sioux City in the submission of the Edward J. Byrne Memorial Justice Assistance Grant (JAG) Program grant application to the Governor’s Office of Drug Control Policy, per recommendation of Greg Logan, Sheriff’s Department and P.J. Jennings, County Attorney Dept.  Carried 5-0.  Copy filed.

 

Motion by Clausen second by Smith to approve and authorize the Chairman to sign a Resolution approving suspension of taxes for Deborah A. Green, 3700 28th Street, Lot 207A, Sioux City.  Carried 5-0.

 

WOODBURY COUNTY, IOWA

RESOLUTION #10,646

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

 

WHEREAS, Deborah A. Green, is the titleholder of a mobile home located at 3700 – 28th Street, Lot 207A, City of Sioux City,  Woodbury County, Iowa, and legally described as follows:

2006 Scottbuilt 60x14 White

 

WHEREAS, Deborah A. Green  as titleholder of the aforementioned mobile home have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Bob Knowler, County Treasurer, discussed the possibility of a loan for the purchase of a fire truck for Concord and Banner Township.

 

Motion by Clausen second by Smith to set a public hearing for April 14th, 2010 at 10:10 AM to consider a loan process for a fire truck for Concord and Banner Township.  Carried 5-0.  Copy filed.

 

Linda Drey from the Siouxland District Health Department discussed with the Board the Local Public Health Services Contract.

 

Motion by Walish second by Monson to approve the request to allow Siouxland District Health Department be the contractor for the Local Public Health Services Contract.  Carried 5-0.

 

 

The Board reviewed final platting for Kenney Addition, a minor subdivision, GIS Parcel #8647 14 200 007, with Planning and Zoning Administrator, John Pylelo.

 

Motion by Smith second by Monson to approve and authorize the Chairman to sign a Resolution approving the final platting of Kenney Addition.  Carried 5-0. 

 

WOODBURY COUNTY, IOWA

BOARD OF SUPERVISORS RESOLUTION #10,647

RESOLUTION ACCEPTING AND APPROVING KENNEY SUBDIVISION

TO WOODBURY COUNTY, IOWA

 

WHEREAS, the owner and proprietor did on the 22nd day of January, 2010, file with the Woodbury County Zoning Commission a certain plat designated as Kenney Subdivision to Woodbury County, Iowa; and

 

WHEREAS, it appears that said plat conforms with all of the provisions of the code of the State of Iowa and ordinances of Woodbury County, Iowa, with reference to the filing of same; and

 

WHEREAS, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and

 

WHEREAS, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.

 

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the plat of Kenney Subdivision to Woodbury County, Iowa be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the owner and proprietor a certified copy of this resolution as required by law.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a Resolution adopting and levying a special assessment of 21% of the original assessment value in the Sandhill-Lakeport Inter-County Drainage District of Monona and Woodbury Counties.  Carried 5-0.

RESOLUTION #10,648

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT

IN THE SANDHILL-LAKEPORT DRAINAGE DISTRICT

 

WHEREAS, the Board of Trustees of the Sandhill-Lakeport Inter-County Drainage District, in session on the 8th day of March, 2010, requested that the Board of Supervisors levy a special assessment of Twenty-One (21%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

 

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the Sandhill-Lakeport Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of Twenty-One (21%) Percent of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2010-2011.

IN THE MCCANDLESS INTERCOUNTY DRAINAGE DISTRICT

 

WHEREAS, the Board of Trustees of the McCandless Inter-County Drainage District, in session on the 21st day of January, 2010, requested that the Board of Supervisors levy a special assessment of Eighty Percent (80%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

 

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the McCandless Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of eighty percent (80%) of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2010-2011.

RESOLUTION #10,650

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT

IN THE LITTLE SIOUX INTER-COUNTY DRAINAGE DISTRICT

 

WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 17th day of March, 2010, requested that the Board of Supervisors levy a special assessment of Forty-two (42%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

 

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-two (42%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2010-2011.

Motion by Monson second by Smith to approve, and receive for signatures, a Resolution approving a road embargo, per recommendation of the County Engineer.  Carried 5-0.

 

WOODBURY COUNTY, IOWA

RESOLUTION NO. 10,651

 

WHEREAS, the Woodbury County Board of Supervisors believe certain secondary roads in Woodbury County, Iowa which are paved or unpaved,  will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or permissible weight thereon reduced, and

 

WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operations of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.

 

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operations of vehicles weighing in excess of said weight limit are prohibited on said highway.

 

IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in exhibit “A”, attached thereto and by this reference made part hereof.  The effective period of this resolution begins March 30, 2010, until in the judgment of the County Engineer road conditions have improved and the embargo can be removed.  The embargo may not be in place beyond June 23, 2010.
