MARCH 23, 2010 — TWELFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 23, 2010 at 9:00 a.m. Board members present were Boykin, Clausen,
Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The closed session scheduled under Code Section 21.5 (1) (c) was canceled.
The Claims were approved as presented. Copy filed.
The meeting was called to order.
Motion by Monson second by Walish to add consideration of a road embargo to the agenda due to an emergency situation that has occurred. Carried 5-0.
Motion by Walish second by Monson to approve the Board minutes of the March 16, 2010 meeting as submitted. Carried 5-0. Copy filed.
The Board approved the separation of Marvin E. Flewelling, Secondary Roads Dept., effective 03/12/2010. End of temporary work. Copy filed.
The Board discussed usage of employee paid breaks and unpaid lunch breaks with J. D. Pellersels, Human Resource Director.
Motion by Monson second by Walish to approve and authorize the Chairman to sign a Resolution approving tax abatement for Siouxland Habitat for Humanity parcel #894729377001. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES
WHEREAS, Siouxland Habitat for Humanity. is leasing real estate Parcel #894729377001 located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the above‑stated property has taxes owing for the 2008/2009, tax year, and the parcel is leased by Siouxland Habitat for Humanity. and
WHEREAS, the organization, namely Siouxland Habitat for Humanity is failing to immediately pay the taxes due; and
WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2008/2009 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

The Board discussed appointments to the Community Action Agency of Siouxland to fill three terms that expire 03/31/2010.
Motion by Walish second by Smith to appoint Anita Bekish, 2713 Ivanhoe Street, Sergeant Bluff, to the Welfare Category, Mark Monson, 300 3rd Street, Sergeant Bluff, to the NE Rural Category, and Catherine Olson, 3134 Glen Oaks Blvd., Sioux City, to the Community Development Category. Carried 5-0.
Motion by Clausen second by Smith to approve for letting for Secondary Roads Dept. project #BRS-CO97(101)---60-97 Farm-to-Market/federal aid funded bridge project, per recommendation of County Engineer Mark Nahra. Carried 5-0.
Motion by Smith second by Monson to approve and authorize the Chairman to sign a "Permit for Use of County Road/Highway Right-of-Way" permit submitted by Cable One, to place utilities within County right-of-way, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Clausen second by Smith to approve and receive for signatures, a Resolution approving an embargo on County Road L-36, per recommendation of the County Engineer. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION #10,646
WHEREAS, the Woodbury County Board of Supervisors believe certain secondary roads in Woodbury County, Iowa which are paved or unpaved, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or permissible weight thereon reduced, and
WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operations of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operations of vehicles weighing in excess of said weight limit are prohibited on said highway.
IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in exhibit "A", attached thereto and by this reference made part hereof. The effective period of this resolution begins March 23, 2010, until in the judgment of the County Engineer road conditions have improved and the embargo can be removed. The embargo may not be in place beyond June 23, 2010.

There was a discussion on the impact of the FEMA flood insurance maps and the impact on the county.
The Board adjourned the regular meeting until March 30, 2010.
