SEPTEMBER 13, 2005 THIRTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 13, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Suzanne Coburn-Van Veen, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Clausen second by Monson to approve the Board minutes of September 6, 2005 as submitted.
Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve the Board minutes of the September 6, 2005 executive session as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Maggie J. Walsh, Social Services Intern, Social Services Dept., $7.00/hour, effective 09/14/2005. Per Board approval on 08/30/2005. Copy filed.

The Board approved the appointment of Kyle D. Gates, Temporary Engineering Aide, Secondary Roads Dept., $11.50/hour, effective 09/14/2005. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of Jorma J. Schwedler, Correctional Officer, County Sheriff Dept., $14.72/hour, effective 09/22/2005. Per DSA contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Patrick A. Jennings, Assistant County Attorney, County Attorney Dept., $52,863/year, effective 09/25/2005. Per AFSCME Attorney contract agreement, from Step 5 to Step 6. Copy filed.

The Board approved the reclassification of Joseph D. Moravek, Correctional Officer, County Sheriff Dept., $15.31/hour, effective 09/25/2005. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.

The Board approved the reclassification of Jeromy A. Stroman, Correctional Officer, County Sheriff Dept., $14.72/hour, effective 09/27/2005. Per DSA contract agreement, from Class 4 to Class 3. Copy filed.

The Board discussed uncompensated care and medication costs for Siouxland Mental Health, with Patty Erickson-Puttmann, Social Services Coordinator.

Motion by Walish second by Clausen to approve the reimbursement for uncompensated care in the amount of $38,294.64 and reimbursement for medication costs in the amount of $18,286.35. Carried 5-0.

The Board discussed the Mental Health Court/Project Compass budget for fiscal year 2005-2006, with Patty Erickson-Puttmann, Social Services Coordinator.

Motion by Walish second by Monson to approve an expenditure of $13,860.00, and to increase the contractual amount to $235,013, to accommodate Physician Assistant service needs. Carried 5-0.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution approving the abatement of taxes for the County Emergency Management building in Climbing Hill. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Woodbury County, Iowa are the titleholders of real estate Parcel #884429100003 located in Woodbury County, Iowa and legally described as follows:

Wolfcreek Township 1.43 AC TCT in NW SW NW 29-88-44

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcel is owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the Woodbury County, Iowa, is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

WHEREAS, Nancy A. Tyler, is the titleholder of property located at 1012 13th Street, City of Sioux City, Woodbury County, Iowa, and legally described as follows:

WHEREAS, Nancy A. Tyler as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Clausen second by Monson to receive the bids and forward them to County Engineer Richard Storm, for recommendations. Carried 5-0. Copy filed.

A discussion was held concerning the Derocher Path Secondary Road Assessment District.

Motion by Batcheller second by Walish to proceed to establish the assessment district on the per parcel method. Carried 5-0.

The Board discussed the recommendations of the Zoning Commission for Bollmeyer First Addition Subdivision (parcel #883515) preliminary plats, with John Pylelo, County Zoning Administrator.

Motion by Monson second by Walish to approve the recommendations of the Zoning Commission regarding the preliminary plats and to approve the final plats for Bollmeyer First Addition Subdivision (parcel #883515) and refer them to the Zoning Commission for review and recommendations. Carried 5-0.

Emergency Services Director Gary Brown, Rita Donnelly, Sioux City Police, Greg Logan, Woodbury County Sheriffs Department, Chuck Cipperly, Siouxland District Health and gave a presentation to the Board on Community Emergency Planning.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Patty Erickson-Puttmann, Social Services Coordinator and Emergency Services Director Gary Brown asked the Board for permission to move forward with a plan to aid survivors of Hurricane Katrina. The Board gave them informal approval.

The Board adjourned the regular meeting until September 20, 2005.
