MAY 24, 2005 TWENTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 24, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Action on the minutes of 5/17/05 was postponed until next week.

The Board approved the appointment of Timothy M. Byers, Temporary Summer Laborer, Secondary Roads Dept., $8.40/hour, effective 05/25/2005. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Amber D. Wilkinson, Full-time Youth Worker, Juvenile Detention Dept., $12.79/hour, effective 05/25/2005. In-house posting 05/10/2005. From Part-time to Full-time status. Copy filed.

The Board approved the reclassification of Eva L. Lambert, Custodian, Building Services Dept., $11.57/hour, effective 06/05/2005. Per AFSCME Cthouse Contract Agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

The Board approved the reclassification of Kay R. Wagner, Vital Statistics Clerk II, County Auditor/Recorder Dept., $12.61/hour, effective 06/05/2005. Per AFSCME Cthouse Contract Agreement, from Grade 3, Step 3 to Grade 3, Step 4. Copy filed.

The Board approved the transfer of Jackie R. Bates, Economic Development Clerk II, Rural Economic Development Dept., $12.61/hour, effective 06/06/2005. In-house job vacancy posted 04/10/2005. Salary based on AFSCME Cthouse Contract Agreement. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for one (1) Payroll Clerk II, County Auditor/Recorder Dept. Entry level: AFSCME Cthouse Grade 3, Step 1, $10.91/hour. Carried 5-0. Copy filed.

Motion by Walish second by Batcheller to approve and authorize the chairman to sign a resolution approving petition for tax suspension for Dolores Saide. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES


WHEREAS Dolores Saide, are titleholders of a mobile home located at 3700 28th Street Lot #480, Woodbury County, Iowa, and legally described as follows:

1987 66 x 16 Gray Bonn.
WHEREAS, Dolores Saide as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 24th day of May, 2005.

Motion by Clausen second by Monson to approve an application for an Iowa Retail Cigarette Permit for Salix Gas, 1558 275th Street, Salix, IA. Carried 5-0. Copy filed.

Motion by Monson second by Walish to approve an application for an Iowa Retail Cigarette Permit for Shop N Go, 1863 Highway 141, Sloan, IA. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a Memorandum of Understanding with the Iowa Department of Public Health, to provide substance abuse prevention and related services to include only education, prevention, referral, or post-treatment services, effective July 1, 2005 through June 30, 2006. Carried 5-0. Copy filed.

The Board discussed Glen Ellen Project property management with Rick Schneider, Conservation Director, John Pylelo, Zoning Administrator, and Richard Storm, County Engineer.

There was no action taken to approve in-kind help for the Woodbury County Library/Moville Area Community Center, to provide assistance with excavating an area of approximately 27,000 square feet.

Motion by Walish second by Monson to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Long Lines, Sergeant Bluff, IA. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to receive quotes for furnishing bridge stringers, and award the bid to Midwest Sales and Services, Schuyler, NE, to furnish 124 stringers at a total cost of $39,570.88, per recommendation of County Engineer, Richard Storm,. Carried 5-0. Copy filed.

Motion by Clausen second by Walish to receive quotes to surface a section of 220th Street and award the bid to Sta-Bilt Construction Company, Harlan, IA, for $88,448.08, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to receive quotes for providing asphalt leveling sections at various locations, and award the bid to Brower Construction Company, Sioux City, IA, for an approximate cost of $47,970.00, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Dick Storm, County Engineer discussed with the Board establishing an assessment district for the paving of Derocher Path.

A Public Hearing was held at 10:30 a.m. on the proposed drawings, specifications, and form of contract for roof repairs at the Prairie Hills and Climbing Hill facilities. The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Walish to close the public hearing on proposed drawings, specifications, and form of contract for roof repairs at the Prairie Hills and Climbing Hill facilities, as there was no one present wishing to be heard. Carried 5-0.

Bid letting was held for proposed drawings, specifications, and form of contract for roof repairs at the Prairie Hills and Climbing Hill facilities.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Merwyn Kanaly, 4901 Derocher Path discussed the procedure to form an assessment district with the Board.

Pat Gill, Woodbury County Auditor and Recorder discussed the purchase and storage of voting equipment with the Board and asked to be placed on the agenda for next week.

District Court Judge Duane Hoffmeyer discussed a vacancy on the Judicial Magistrate Nominating Committee with the Board.

The Board adjourned the regular meeting until May 31, 2005.
