MAY 17, 2005 TWENTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 17, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Monson to approve the Board minutes of May 10, 2005 as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Cole J. Dixon, Temporary Summer Laborer, Secondary Roads Dept., $8.40/hour, effective 05/18/2005. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Andrew R. Bremer, Temporary Summer Laborer, Secondary Roads Dept., $8.40/hour, effective 05/18/2005. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Jacob S. Byers, Temporary Summer Laborer, Secondary Roads Dept., $7.50/hour, effective 05/18/2005. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of Debra A. Heath, Records Clerk III, County Sheriff Dept., $15.14/hour, effective 05/26/2005. Per AFSCME Courthouse contract agreement, from Grade 6, Step 3 to Grade 6, Step 4. Copy filed.

The Board approved the reclassification of Mark R. Larkin, Court Security Officer, County Sheriff Dept., $16.80/hour, effective 05/28/2005. Per DSA contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the transfer of Diana L. Christensen, Senior Tax Clerk II, County Treasurer Dept., $14.19/hour, effective 06/01/2005. In-house posting: 04/26/2005. Salary per AFSCME Courthouse contract, from Grade 3, Step 5 to Grade 4, Step 5. Copy filed.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a statement of support for the Guard and Reserve in regards to current and future employees of Woodbury County. Carried 5-0. Copy filed.

Motion by Clausen second by Monson to approve lifting the property tax suspension for Jessie G. Kissinger. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to receive the appointment of Patricia Hopkins, 305 S. Hickory Street, Smithland, IA, as a City Council Member for the City of Smithland, to fill a vacancy previously held by Kathryn Mack, until the next City Election in 2005. Carried 5-0. Copy filed.

Motion by Walish second by Clausen to receive the appointment of Kathryn Mack, 100 Washington Street, Smithland, IA, as a City Council Member for the City of Smithland, to fill a vacancy previously held by Mark Struble, until the next City Election in 2005. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a letter of support and submit a grant request to Iowa Network Services, Inc. for the Woodbury County Fair Board to use towards Phase 2 (storm shelter, restrooms and a first aid room) of their building project. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to receive the motion from Anthon-Oto Community School District, Battle Creek-Ida Grove Community School District, Kingsley-Pierson Community School District, Lawton-Bronson Community School District, Maple Valley Community School District, Sergeant Bluff-Luton Community School District, Sioux City Community School District, Westwood Community School District, Woodbury Central Community School District and River Valley Community School District requesting an election be held to extend the previously imposed local sales and services tax for school infrastructure purposes and submit said question to Woodbury County residents. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a resolution received from the Sioux City Community School District requesting an election be held in Woodbury County on the Question of extending the previously imposed local sales and services tax for school infrastructure purposes. Carried 5-0.

WOOBURY COUNTY, IOWA
RESOLUTION NO. _9926_

M O T I O N OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY TO CALL FOR AN ELECTION ON THE QUESTION OF EXTENDING THE PREVIOUSLY IMPOSED LOCAL SALES AND SERVICES TAX FOR SCHOOL INFRASTRUCTURE PURPOSES.

WHEREAS, on August 11, 1998, the voters of Woodbury County approved the imposition of a local sales and services tax for school infrastructure purposes, to begin October 1, 1998 and to end on September 30, 2008.

WHEREAS, pursuant to Iowa Code Chapter 423E, authority is extended to school districts and counties to hold elections to extend previously imposed local sales and services taxes for school infrastructure projects; and

WHEREAS, an election on the question of extending a previously imposed local sales and services tax for school infrastructure purposes may be initiated and proposed by motion or motions of the boards of directors of a school district or school districts located within a county and containing a total or a combined total of at least one-half of the population of the county; and

WHEREAS, this Board of Supervisors has been notified of the adoption of a Motion or Motions proposing such an election by the Board of Directors of School Districts containing at least one-half of the population of the County.

NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa:

Section 1. The Commissioner of Elections of Woodbury County, Iowa, shall cause to be submitted to the voters of the County the question of extending the local sales and services tax for school infrastructure purposes previously imposed in Woodbury County at an election held on August 11, 1998.

Section 2. It is the intention of this Board of Supervisors that the rate of the local sales and services tax for school infrastructure purposes be proposed as one percent (1%), with the tax to be extended until September 30, 2018.

Section 3. Moneys received from the local sales and services tax, if and when extended and collected, shall be spent for school infrastructure, as set forth in the ballot proposition set forth in Section 4 of this Resolution, and the Commissioner of Elections of Woodbury County is requested to so provide in the ballot measure, in the manner required by law and the regulations of the State Commissioner of Elections.

Section 4. The form of ballot is approved by this Board of Supervisors as follows:

A previously imposed local sales and services tax for school infrastructure projects shall be extended in the County of Woodbury at the rate of one percent. The tax will be extended until September 30, 2018. The money received from the tax shall be spent for school infrastructure, including
purchasing, building, furnishing, reconstructing, repairing, demolishing, improving, expanding, or remodeling of a schoolhouse or schoolhouses
and additions thereto, gymnasium, athletic facilities, field house, or school bus garage, purchasing and improving grounds, opening roads to
schoolhouses or buildings, the purchase, lease or lease-purchase of buildings or equipment (including transportation and recreation equipment)as authorized by law, procuring or acquiring libraries, expenditures for energy conservation measures, the rental of facilities under Chapter 28E, for public educational and recreational activities, the payment or retirement of bonds issued for school infrastructure purposes or the payment or retirement of bonds issued under Iowa Code Section 423E.5, for debt reduction or property tax relief, or for any one or more of such purposes, or for any purpose or purposes now or hereafter authorized by law.

Section 5. This motion and the motion representing the action of the School Districts are directed to be submitted to the County Commissioner of Elections for action as required by law.

Section 6. Subject to the compliance with all necessary requirements of law, it is requested that the special election be held on August 2, 2005.

The Board discussed with Mark Elgert, Building Superintendent, a preventative maintenance agreement with Access Elevator, Inc., for the Courthouse wheelchair lift.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a preventative maintenance agreement with Access Elevator, Inc. for the Courthouse wheelchair lift. Carried 5-0. Copy filed.

Motion by Monson second by Clausen to authorize the Chairman to sign a contract and bonds with Godberson-Smith, Ida Grove, in the amount of $450,669.61 for Project No. BROS-CO97(70)8J-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to authorize the Chairman to sign a lease with Diamond Mowers, Sioux Falls, SD, for a tractor and side-mounted boom mower for 2005, per recommendation of the County Engineer. Carried 5-0. Copy filed.

The Board heard a recommendation from County Engineer Richard Storm to award the bid to Northern Truck Equipment, Sioux Falls, SD for tandem truck dump boxes, hoist, and hydraulics the bid to furnish three (3) Crysteel Select dump boxes, hoists, and hydraulics.

Mike Feathers of Steffen Truck & Equipment, Sioux City discussed the bids with the Board.

Motion by Batcheller second by Clausen to award the bid for tandem truck dump boxes, hoist, and hydraulics to Steffen Truck & Equipment, Sioux City, IA. Carried 5-0. Copy filed.

The Board discussed with Richard Storm, County Engineer, the approval to initiate a Request for Proposal process for study of the Secondary Roads Department, with the cost paid for by Secondary Roads.

Motion by Batcheller second by Monson to approve the request, and authorize the County Engineer to initiate the process. Carried 5-0.

The Board discussed recommendations from Richard Storm, County Engineer for engineering services on future projects and asked for a tour of the proposed projects.

Riley Simpson of Flat Earth Planning, provided an update on the current status of his work on Woodbury Countys 2005 Development Plan.

The Board discussed the Wolf Creek Drainage District with Dick Storm, County Engineer.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

E.B. Baker of 1997 Carroll Avenue discussed the demolition of the water tower at the Prairie Hills Facility with the Board.

Jack Jolin discussed the purchase of County property with the Board.

Walish excused himself to attend a doctors appointment. Batcheller excused himself rather than attend a tour that was not on the agenda with a quorum of the Board.

Monson, Clausen and Boykin toured the Eagles building.

The Board adjourned the regular meeting until May 24, 2005.
