AUGUST 17, 2021, THIRTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, August 17, 2021 at 4:30 p.m. Board members present were Monson, Ung, Wright, De Witt, and Radig. Staff members present were Karen James, Board Administrative Assistant, Melissa Thomas, Human Resources Director, Dennis Butler, Finance Director, Joshua Widman, Assistant County Attorney, and Patrick Gill, Auditor/Clerk to the Board.
The regular meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.
Andrew Valasek, Sioux City addressed the Board with concerns of employees smoking in front of county buildings.
Motion by Radig second by Monson to approve the agenda for August 17, 2021. Carried 5-0. Copy filed.

Motion by Monson second by De Witt to approve and authorize the Chairperson to sign a Resolution for the sale of real estate parcel #884706433016, 2637 S. Nicollet St., to Bill Margello and Krysia Heimstra, 2626 S. Cleveland St., Sioux City, for $325.00 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

The Supervisors meeting was called back to order.
Motion by De Witt second by Monson to approve seeking bids for demolition of the shuttered Prairie Hills Building. Carried 4-1; Radig opposed. Copy filed.
Motion by De Witt second by Monson to approve the Finance/Budget Director to seek bids to survey the county farm and also have Sedgwick, Brennan, Tally & Co. update the abstract for the county farm. Carried 5-0. Copy filed.
Motion by De Witt second by Monson to approve and authorize the Chairperson to sign a Resolution approving and authorizing the usage of a portion of the fiscal recovery funds under the American Rescue Plan Act (“ARPA”). Carried 5-0.
RESOLUTION #13,223
RESOLUTION APPROVING AND AUTHORIZING THE
USAGE OF A PORTION OF THE FISCAL RECOVERY
FUNDS UNDER THE AMERICAN RESCUE PLAN ACT
(“ARPA”)
WHEREAS, Woodbury County (the “County”) and the City of Sioux City (the “City) are the incorporating units of the Woodbury County Law Enforcement Center Authority (the “Authority”); and
WHEREAS, the general purpose of the Authority is to design, construct, equip and furnish a new law enforcement center including the acquisition of land for such purposes for the joint use of the County and the City; and
WHEREAS, pursuant to a special election on March 3, 2020, the Authority is authorized to issue its Law Enforcement Center Facilities Revenue Bonds in an amount not exceeding the amount of $50,300,000 for the purpose of designing, constructing, equipping and furnishing a law enforcement center including the acquisition of land for such purposes for the joint use of the County and the City; and
WHEREAS, the construction budget for the new law enforcement center was estimated at approximately $43,000,000; and
WHEREAS, competitive bids were solicited by the Authority and two bids were received; and
WHEREAS, the Authority approved a construction contract in the approximate amount of $58,390,000 with the lowest responsive, responsible bidder; and
WHEREAS, total project costs including the $58,390,000 construction contract plus additional soft costs (e.g., consulting fees, land acquisition, costs of issuance, etc.) are currently expected to be approximately $65,076,000; and
WHEREAS, based on these current projections there is a funding gap of approximately $15,576,000; and
WHEREAS, the County believes that the increased costs over and above the original construction estimates are at least partially due to COVID-19 pandemic related conditions (e.g., HVAC systems designed to prevent dangerous cross contamination and minimizing the risk of airborne health hazards in a building delivering critical government functions, additional facilities for mental health related needs, use of materials that can be more easily sanitized, etc.); and
WHEREAS, on March 11, 2021, the ARPA was signed into law by the President of the United States; and
WHEREAS, Fiscal Recovery Funds are intended to provide support to local governments in responding to the impact of COVID-19; and
WHEREAS, the Board expects to receive approximately $10,013,663 of Fiscal Recovery Funds under the ARPA in calendar year 2021 and approximately $10,013,663 of Fiscal Recovery Funds under the ARPA in calendar year 2022; and
WHEREAS, Iowa Code Section 346.27(8) provides in part that the County may make donations of property, real or personal, to the Authority as deemed proper and appropriate in aiding the Authority to effectuate its purposes; and
WHEREAS, Iowa Code Section 346.27(9)(j) provides in part that the Authority may accept donations, contributions, capital grants, or gifts from individuals, associations, municipal and private corporations, and the United States, or any agency or instrumentality thereof; and
WHEREAS, it is the intention of the Board to contribute approximately $10,000,000 of the Fiscal Recovery Funds received in calendar year 2021 and approximately $5,576,000 of the Fiscal Recovery Funds received in calendar year 2022 to the Authority to be used in addition to its Law Enforcement Center Facilities Revenue Bonds for the purpose of designing, constructing, equipping and furnishing a law enforcement center including the acquisition of land for such purposes for the joint use of the County and the City.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA:
Section 1. Subject to further guidance from the Department of Treasury, the County hereby approves and authorizes a contribution of approximately $10,000,000 of the Fiscal Recovery Funds received in calendar year 2021 and approximately $5,576,000 of the Fiscal Recovery Funds received in calendar year 2022 to the Authority to be used in addition to its Law Enforcement Center Facilities Revenue Bonds for the purpose of designing, constructing, equipping and furnishing a law enforcement center including the acquisition of land for such purposes for the joint use of the County and the City.
