MAY 24, 2016 —TWENTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 24, 2016 at 4:00 p.m.  Board members present were Monson, Ung, Smith,  Clausen, and Taylor.  Staff members present were Dennis Butler, Budget Tax Analyst, Karen James, Board Administrative Coordinator, Ed Gilliland, Human Resources Director and Patrick Gill, Auditor/Clerk to the Board.

Motion by Smith second by Clausen to go into closed session per Iowa Code Section 21.5(1)(c).  Carried 3-0 on a roll-call vote.

Motion by Smith second by Clausen to go out of closed session per Iowa Code Section 21.5(1)(c).  Carried 3-0 on a roll-call vote.

Motion  by Clausen second by Smith to approve an expenditure of $450.00 for the appellant.  Carried 3-0 

The Chairman recessed the meeting until 4:30 PM.

The meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.  Supervisors Monson and Ung joined the meeting at this time.

There were no citizen concerns.

Motion by Monson second by Clausen to approve the Agenda for May 24, 2016.  Carried 5-0.  Copy filed.

Motion by Clausen second by Monson to approve the minutes of the May 17, 2016 Board meeting.  Carried 5-0.  Copy filed.

Motion by Monson second by Ung to approve the claims totaling $1,620,826.04 that did not include $42,742.41 for commitment hearings.  Carried 5-0.  Copy filed.

Chairman Taylor presented a good news report.  Dr. Michelle Skaff was recognized for her Doctorate achievement and the Chairman announced the largest SEDC loan in Woodbury County was awarded.  Copy filed.

Presentation of Resolutions thanking and commending Frank Morse, Ron McKewon, and Wendy Beavers for their service to Woodbury County as well as brief presentation on Siouxland Center for Active Generations.  Copy filed.

A public hearing was held at 4:45 p.m. for amendment for current County budget.   

Motion by Monson second by Clausen to close the public hearing.  Carried 5-0.

Motion by Monson second by Ung to approve the amendment to the FY 2016 County budget.  Carried 5-0.  Copy filed.

Motion by Monson second by Ung to approve and authorize the Chairperson to sign a Resolution for tax suspension for Cynthia Reed, 1324 La Plante Ave, parcel #894814357001.  Carried 5-0.

RESOLUTION #12,378

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Cynthia R. Reed, is the titleholder of property located at 1324 La Plante Ave., Sioux City,  IA,  Woodbury County, Iowa, and legally described as follows:       

Parcel  8948 14 357 001

EDGEWATER 2ND LOT 15 BLK 5                                      

WHEREAS, Cynthia R. Reed, is the titleholder of the aforementioned properties have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension  for this property.

Motion by Clausen second by Ung to approve the reprioritizing of the “Starcomm Upgrade of Tower Site/RadioIinfrastructure” Capital Improvements project budget of $700,000.00 to the partnership with the Iowa Statewide Interoperable Communications System Board (ISICSB) and Starcomm to which the state will provide the needed upgrades in exchange for space on the Starcomm towers and Starcomm will purchase and increase channel capacity from 5 to 10 channels, for the total cost of $598,000.00.  Carried 5-0.  Copy filed.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Hackley Lateral Drainage District, that a special tax and/or assessment in the sum of $  0.00      be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Orton Slough Drainage District, that a special tax and/or assessment in the sum of $  20,000.00   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

The Supervisors meeting was called back to order.

Information on County Employee Credentialing by Michelle Skaff, Emergency Management.  Copy filed.

Motion by Monson second by Taylor to ask the County Attorney’s Office to negotiate, on the behalf of the county, the purchase of the Little Courthouse in Anthon for $1.00 and to address the liability issues regarding the purchase.  Carried 5-0.  Copy filed.

Motion by Clausen second by Taylor to go into closed session per Iowa Code Section 21.5(1)(c).  Carried 5-0 on a roll-call vote.

Motion by Smith second by Taylor to go out of closed session per Iowa Code Section 21.5(1)(c).  Carried 5-0 on roll-call vote.

The Board adjourned the regular meeting until May 31, 2016.
