APRIL 5, 2016 — FOURTTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 5, 2016 at 4:00 p.m.  Board members present were Monson, Ung, Smith, Taylor, and Clausen.  Staff members present were Dennis Butler, Budget Tax Analyst, Karen James, Board Administrative Coordinator, Ed Gilliland, Human Resources Director and Patrick Gill, Auditor/Clerk to the Board.

Motion by Ung second by Monson to go into closed session per Iowa Code Section 21.5(1)(a).  Carried 5-0 on roll-call vote.

Motion by Monson second by Ung to go out of closed session per Iowa Code Section 21.5(1)(a).  Carried 5-0 on roll-call vote.

Motion by Monson second by to approve the expenditure of $500 on behalf of the appellant in the previous general relief appeal hearing.  Carried 5-0.

The meeting was called to order with the Pledge of Allegiance to the Flag and a Moment of Silence.

Citizen Concerns.

Motion by Taylor second by Ung to approve the Agenda as submitted for April 5, 2016 with the substitution of the word “vison” for the word “mission” in an item dealing with the approval of a mission statement.  Carried 5-0.  Copy filed.

Motion by Clausen second by Ung to approve the minutes of the March 29, 2016 Board meeting.  Carried 5-0.  Copy filed.  

Motion by Monson second by Ung to approve the claims totaling $395,233.70.   Carried 5-0.  Copy filed.

Motion by Clausen second by Ung to approve the reclassification of Alesha Bieler, Secretary, County Attorney Dept., effective 4-24-16, $20.89/hour, 5%=$1.02/hr.  Per AFSCME Courthouse Contract agreement, from Grade 5/Step 3 to Grade 5/Step 4.; the reclassification of Blake Stahlecker, Civilian Jailer, County Sheriff Dept., effective 4-29-16, $18.19/hour, 4%=$.71/hr.  Per CWA Civilian Officers Contract agreement, from Class 3 to Class 2.; the reclassification of Diane Murphy, Asst. County Attorney, County Sheriff Dept., effective 04-30-16, $79,485/year, 3.7%=$2,867/yr.  Per AFSCME Asst. County Attorney Contract agreement, from Step 8 to Step 9.; and the reclassification of Brenda Sopoci, Youth Worker, Juvenile Detention Dept., effective 4-30-16, $23.29/hour, 5.6%=$1.24/hr.  Per AFSCME Juvenile Detention Contract agreement, from Grade 1/Step 4 to Grade 1/Step 5.  Carried 5-0.  Copy filed.  

Motion by Clausen second by Smith to postpone action to approve the Nepotism Policy.  Carried 5-0.  Copy filed.

A public hearing was held at 4:35 p.m. for the sale of parcel #280651, 3303 Alberta Ave.  The Chairperson called on anyone wishing to be heard.

Motion by Monson second by Smith to close the public hearing.  Carried 5-0.

Motion by Clausen second by Monson to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Michael Joseph Taylor, 3513 Alberta Ave., Sioux City, for real estate parcel #280651, 3303 Alberta Ave. for $250.00 plus recording fees.  Carried 5-0.

RESOLUTION #12,348

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By   Michael Joseph Taylor in the sum of Two Hundred Fifty Dollars & 00/100 ($250.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:  

Parcel #280651

Lot Two Block Eighteen, Kelly Park Addition, City of Sioux City, Woodbury County, Iowa

(3303 Alberta Ave)           

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

The Easterly 55 feet of Lot 6 in Block 8, Sioux City Addition to Sioux City, in the County of Woodbury and State of Iowa (613 W 2nd Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on the 19th Day of April, 2016 at 4:35 o’clock p.m. in the basement of the Woodbury County Courthouse.      

2.  That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 19th Day of April, 2016,  immediately following the closing of the public hearing.      

3.  That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $213.00 plus recording fees.

1.  That a public hearing on the aforesaid proposal shall be held on the 19th Day of April, 2016 at 4:37 o’clock p.m. in the basement of the Woodbury County Courthouse.      

2.  That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 19th Day of April, 2016,  immediately following the closing of the public hearing.      

3.  That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $246.00 plus recording fees.

A public hearing was held at 4:45 p.m. for replacement of the exterior entrance plaza at the Woodbury County Law Enforcement Center.

Motion by Monson second by Clausen to close the public hearing.  Carried 5-0.

Opening of bids for the exterior entrance plaza at the Woodbury County Law Enforcement Center.  The bids are as follows:

W.A. Klinger    $167,700

Motion by Monson second by Smith to receive the bids and to direct the Building Services Director and RML Architects to evaluate the bids and return with a recommendation for award.  Carried 5-0.  Copy filed.

Motion by Monson second by Smith to approve the update Woodbury County Board of Supervisors Agenda Item(s) request form.  Carried 5-0.  Copy filed.

Motion by Monson second by Clausen to receive for signatures a Resolution a Proclamation National County Government Month – April 2016 “Safe and Secure Counties”.  Carried 5-0.

PROCLAMATION

NATIONAL COUNTY GOVERNMENT MONTH – APRIL 2016

“SAFE AND SECURE COUNTIES”

WHEREAS, the nation’s 3069 counties serving more than 300 million Americans provide essential services to create healthy, safe, vibrant and economically resilient communities; and

WHEREAS, Woodbury County and all counties take pride in our responsibility to protect and enhance the health, well-being and safety of our residents in efficient and cost-effective ways; and

WHEREAS, through National Association of Counties (NACO) President Sallie Clark’s “Safe and Secure Counties” initiative, NACO is encouraging counties to focus on strengthening the safety and security of their communities; and

WHEREAS, in order to remain healthy, vibrant, safe and economically competitive, America’s counties provide public health, justice, emergency management and economic services that play a key role in everything from residents’ daily health to disaster response; and

WHEREAS, each year since 1991, the National Association of Counties has encouraged counties across the country to actively promote programs and services to the public we serve; and

NOW, THEREFORE, BE IT RESOLVED THAT the Woodbury County Board of Supervisors do hereby proclaim April 2016 as National County Government Month and encourage all county officials, employees, schools and residents to participate in county government celebration activities.

Dennis Butler provided information on Amendment #2 for Liberty Park and renaming the TIF area.  Copy filed.

Bid opening for project #L-B(X14)—73-97. The bids are as follows:

Graves Construction   $490,806.48

Dixon Construction   $499,745.90

Motion by Clausen second by Ung to receive the bids and direct the County Engineer to evaluate the bids and return with a recommendation for award.  Carried 5-0.  Copy filed.

Motion by Ung second by Monson to award the project HC11-9 and HC11-10 to Niewohner Construction for $59,732.00.  Carried 5-0.  Copy filed.

Motion by Ung second by Monson to approve the contract and bond for project #FEMA 9 & 14—73-97 with Holly Brown Construction for #55,741.64.  Carried 5-0.  Copy filed.

Motion by Monson second by Smith to approve the FY 2017 Secondary Road Budget for the Iowa DOT.  Carried 5-0.  Copy filed.

Motion by Clausen second by Ung to approve the Secondary Roads FY 2017 to FY 2021 Construction Program for Iowa DOT.  Carried 5-0.  Copy filed.

Sheriff Dave Drew presented information on the Sheriff’s overtime budget and jail expenses.  Copy filed.

Motion by Taylor second by Monson to allocate $7,293 of LOST funds to cover the expense of the Joint City/County SIMPCO membership dues project for FY 16-17.  Carried 4-1; Clausen opposed.  Copy filed.

Motion by Monson second by Taylor approve the Rural and Economic director to use outside legal counsel for assistance with helping rural cities form Community Development Corporations (CDCs) subject to preapproval by the chairperson.  Carried 5-0.  Copy filed.

David Gleiser presented information on Comprehensive Planning Project.  Copy filed.

Motion by Monson second by Clausen to approve issues as submitted to be presented by the county delegation during the Washington D.C. lobbying trip.  Carried 5-0.  Copy filed.

David Gleiser presented information on adopting an ordinance for Iowa Code 427B.  Copy filed.

Motion by Taylor second by Monson to approve and authorize the Chairperson to sign the lease agreement with DHS for office space at Trosper Hoyt.  Carried 5-0.  Copy filed.

The Board recessed for a meeting of the Wolf Creek Drainage District.

The Supervisors meeting was called back to order.

The Chairperson reported on day to day activities.

The Board members reported on their committee meetings.

There were no citizen concerns.

The Board adjourned the regular meeting until April 19, 2016.
