October 21, 2014 — FORTYTHIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 21, 2014 at 10:00 a.m. Board members present were Boykin, Monson, Smith, and Clausen; Tripp was absent. Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick Gill, Auditor/Clerk to the Board.
The meeting was called to order.
Motion by Monson second by Smith to approve the minutes from the 10/14/14 Board meeting. Carried 4-0. Copy filed.
Motion by Smith second by Monson to approve the County’s claims totaling $332,654.24. Carried 4-0. Copy filed.
Motion by Smith second by Monson to approve the reclassification of Rachael Edmundson, Asst. County Attorney, County Attorney Dept., effective 11/9/14, $66,957/year. Per AFSCME Asst. County Attorney Contract agreement, from Step 5 to Step 6. Carried 4-0. Copy filed.
Motion by Monson second by Clausen to receive the County Recorder’s Report of Fees Collected for the period of 07/01/14 through 09/30/14. Carried 4-0. Copy filed.
Motion by Clausen second by Smith to approve and authorize the Chairperson to sign a Starcomm Tower Lease Amendment #1 to New Cingular Wireless PCs LLC, 2290 Platte Road, Homer, NE. Carried 4-0. Copy filed.
Motion by Monson second by Clausen to approve and authorize the Chairperson to sign a Starcomm Tower Lease Amendment #2 to New Cingular Wireless PCs LLC, 3430 W 23rd, Sioux City, IA. Carried 4-0. Copy filed.
Action to approve and authorize the Chairperson to sign a Contract and Bond for the Crushing of PCC and HMA materials at the Moville Stockpile site and the D51 Stock Pile site with C.A.P Recycling was deferred.
Motion by Clausen second by Monson to approve and authorize the Chairperson to sign a Contract and Bond for the HMA Routing and Sealing on various roads with Commercial Sweeping. Carried 4-0. Copy filed.
Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Contract and Bond for the 240th Street/Allison Ave. grading project with Lieber Construction. Carried 4-0. Copy filed.
Motion by Smith second by Clausen to approve and authorize the Chairperson to sign a permit to work in the right of way for Mid American Energy Company. Carried 4-0. Copy filed.
Motion by Monson second by Clausen to approve and authorize the Chairperson to sign a Resolution to Revise Woodbury County 2015 Five Year Road Program. Carried 4-0.

Unforeseen circumstances have arisen since adoption of the approved Secondary Road Construction Program, and previous revisions, requiring changes to the sequence, funding and timing of the proposed work plan,
The Board of Supervisors of Woodbury County, Iowa, in accordance with Iowa Code section 309.22, initiates and recommends modification of the following project(s) in the accomplishment year (State Fiscal Year (FY)2014), for approval by the Iowa Department of Transportation (Iowa DOT), per Iowa Code 309.23 and Iowa DOT Instructional Memorandum 2.050.

Then the Chairperson called on anyone wishing to be heard.
Motion by Monson second by Clausen to close the public hearing. Carried 4-0.
Motion by Clausen second by Smith to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Misty Monlux, 3104 Leech Ave., Sioux City, for real estate parcel #210795 (3102 Leech Ave.) for $245.00 plus recording fees. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By Misty Monlux in the sum of Two Hundred Forty-Five Dollars & 00/100 ($245.00)-----------------------------------------------------dollars.
For the following described real estate, To Wit:

Lot Twenty-Four and the East One-half of Lot Twenty-Five, Block Two, Hedges Table Addition to Sioux City, In the County

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.
