SEPTEMBER 2, 2014 — THIRTY SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 2, 2014 at 10:00 a.m.  Board members present were Clausen, Smith, Boykin and Monson; Tripp was absent.   Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick Gill, Auditor/Clerk to the Board.

The meeting was called to order.   Motion by Clausen second by Smith to approve the minutes of the 08/26/2014 Board meeting.  Carried 4-0.  Copy filed.  

Motion by Monson second by Smith to approve the County’s claims totaling $1,266,713.99.  Carried 4-0.  Copy filed.

Motion by Smith second by Monson to postpone the discussion on an agreement with US Attorney’s Office regarding a Special Assistant US Attorney for Drug Prosecutions.  Carried 4-0.

Motion by Smith second by Clausen to approve the transfer of Bradley Carlson, P/T Courthouse Safety & Security Officer, Courthouse Safety & Security Dept., effective 08/13/14, $16.43/hour. Status Transfer.; the transfer of Michael Vanbeest, P/T Courthouse Safety & Security Officer, Courthouse Safety & Security Dept., effective 08/13/14, $16.43/hour. Status Transfer.; the transfer of Shawn McKenna, P/T Courthouse Safety & Security Officer, Courthouse Safety & Security Dept., effective 08/13/14, $14.96/hour. Status Transfer.; the transfer of Valerie Uken, P/T Courthouse Safety & Security Officer, Courthouse Safety & Security Dept., effective 08/13/14, $14.96/hour. Motion by Clausen second by Smith to approve the request from to William Anderson remain on County Dental Insurance Plan.  Carried 4-0.  Copy filed.

Motion by Smith second by Clausen to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Deputy Sheriff, County Sheriff Dept., CWA Deputy Sheriff:  $21.12/hour.  Carried 4-0.  Copy filed.

Motion by Monson second by Clausen to approve and receive for signatures a Resolution thanking and commending William L. Anderson for his years of services to Woodbury County.  Carried 4-0.

RESOLUTION #12,067

RESOLUTION THANKING AND COMMENDING

WILLIAM L. ANDERSON

FOR HIS SERVICE TO WOODBURY COUNTY

WHEREAS, William L. Anderson has capably served Woodbury County as an employee of the Woodbury County Conservation Department  for 37 years from February  1, 1977 to September 20, 2014; and

WHEREAS, the service given by William L. Anderson as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends William L. Anderson  for his  years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, William L. Anderson.

Motion by Monson second by Clausen to approve and authorize the Chairperson to sign a Quit Claim Deed for Vacated County Right of Way for Blutt.  Carried 4-0.  Copy filed.

Motion by Smith second by Monson to approve and authorize the Chairperson to sign a Quit Claim Deed for Vacated County Right of way for Murray.  Carried 4-0. Copy filed.

Motion by Smith second by Clausen to approve and authorize the Chairperson to sign an Underground Utility Permit in the Right of Way for Lundell Construction.  Carried 4-0.  Copy filed.

Motion by Clausen second by Smith to approve and authorize the Chairperson to sign a contract for Propane Gas Supply for 2014-15.  Carried 4-0.  Copy filed.

Motion by Monson second by Clausen to approve and authorize the Chairperson to sign a Resolution approving petition of suspension of taxes for Kimberli Fritz, 609 Prescott, Sioux City, parcel #894730130004.  Carried 4-0.

RESOLUTION #12,068

RESOLUTION APPROVING PETITION OF SUSPENSION OF TAXES

WHEREAS, Kimberli Fritz, is the titleholder of property located at 609 Prescott, Sioux City, IA,  Woodbury County, Iowa, and legally described as follows:       

Parcel #   8947 30 130 004   

HIGHLAND 3 FAWCETTS SUB DIV LOT  A LOT 1 BLK 20 LOT  

WHEREAS, Kimberli Fritz,  is the titleholder of the aforementioned properties have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension  for this property.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Saint Thomas Episcopal Church is the titleholder of real estate Parcels #894728112012 and 894728112013 located in Woodbury County, Iowa and legally described as follows:

SIOUX CITY EAST PT E/W ALLEY ADJ TO LOTS 3 & 4 BLK 64 

WHEREAS, the abovestated property has taxes owing for the 2013-2014 tax year, and the parcel is owned by Saint Thomas Episcopal Church; and

WHEREAS, the organization, namely Saint Thomas Episcopal Church  is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes and; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the tax year 2013/2014, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Then the Chairperson called on anyone wishing to be heard.

Motion by Clausen second by Smith to close the public hearing.  Carried 4-0.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Matt Mead (601 State St., Oto, IA) for real estate parcel #623925 (108 4th Ave) for $217.00 plus recording fees.  Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By   Matt Mead in the sum of Two Hundred Seventeen Dollars & 00/100 ($217.00)-----------------------------------------------------dollars.

For the following described real estate, To Wit:

Lot 4 in Block 16 Day’s First Addition to the City of Oto, Woodbury County, Iowa

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

WOODBURY COUNTY BOARD OF SUPERVISORS

There was a discussion on the nursing staff in the jail.

Motion by Smith second by Clausen to approve the addition of one and a half positions to the nursing staff in the jail to be funded from the county’s reserves.  Carried 3-1; Monson opposed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Sandra Nation, 4735 Cambridge Ct, Sioux City, addressed the Board with an issue regarding Teen Court and the First Tee program.

Mark Monson addressed the Board with a concern about board procedures.

Jay Kirkpatrick, 1809 Bronson Blk Top, Bronson, addressed the Board with issues about drainage issues on his property.

The agenda item dealing with a general relief hearing was not held as the individual who requested the hearing did not appear.

The Board adjourned the regular meeting until September 9, 2014.
