MAY 20, 2014 — TWENTYFIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 20, 2014 at 10:20 a.m.  Board members present were Clausen, Monson, Smith, Boykin, and Tripp.  Staff members present were Karen James, Board Administrator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.  

Motion by Monson second by Tripp to approve the minutes of the 05/13/2014 Board meeting.  Carried 5-0.  Copy filed.  

Motion by Monson second by Clausen to approve the county’s claims totaling $572,201.86.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve the appointment of Kyle Hardisty, Temporary Summer Laborer, Secondary Roads Dept., effective 05/21/14, $9.00/hour. Not to exceed 120 days.; the appointment of Reed Mitchell, Temporary Summer Laborer, Secondary Roads Dept., effective 05/22/14, $9.00/hour.  Not to exceed 120 days.; the appointment of Gabriel Sweers, Temporary Engineering Aide, Secondary Road Dept., effective 05/21/14, $11.00/hour.  Not to exceed 120 days.; the appointment of James Vaughn, Equipment Operator, Secondary Road Dept., effective 06/04/14, $20.30/hour.  Job Vacancy Posted 3-5-14.  Entry Level Salary $20.30/hour.; the reclassification of Steven Holden, Maintenance Technician, Building Services Dept., effective 06/06/14, $18.38/hour, 5%=$.92/hour.  Per AFSCME Courthouse Contract agreement, from Grade 4/Step 3 to Grade 4/Step 4.; and the reclassification of Sharon Dimmitt, Recorder Clerk II, Auditor/Recorder Dept., effective 06/14/14, $16.11/hour, 5%=$.77/hour.  Per AFSCME Courthouse Contract agreement, from Grade 3/Step 2 to Grade 3/Step 3.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a permit to work in the right of way for Long Lines along Port Neal Road to serve CF  Hiring Center.  Carried 5-0.  Copy filed.

1) Motion by Tripp second by Smith to approve and authorize the Chairperson to sign a Resolution levying special assessment of $1,000.00 for the Bennett-McDonald Drainage District for fiscal year 2014-2014.  Carried 5-0.

BENNETT-MCDONALD DRAINAGE DISTRICT

RESOLUTION LEVYING SPECIAL ASSESSMENT AND CERTIFICATE

TO THE COUNTY AUDTIOR OF WOODBURY COUNTY, IOWA

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Bennett-McDonald Drainage District of Woodbury County, Iowa; and  

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Bennett-McDonald Drainage District, that a special tax and/or assessment in the sum of $  1,000   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes.

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Hackley Lateral Drainage District of Woodbury County, Iowa; and

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Hackley Lateral Drainage District, that a special tax and/or assessment in the sum of $  1,000   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Orton Slough Drainage District of Woodbury County, Iowa; and

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Orton Slough Drainage District, that a special tax and/or assessment in the sum of $  12,000   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Upper Wolf Creek Drainage District, that a special tax and/or assessment in the sum of $   5,000    be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Weber Creek Drainage District, that a special tax and/or assessment in the sum of $  500   be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Pumping District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Bennett-McDonald Smithland Special, that a special tax and/or assessment in the sum of $    30,000.00   be levied against all the tracts of land, lots, railroad companies, and public highways within said Pumping District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

A public hearing was held at 10:30 a.m. for Budget Amendment #2 for FY 2014.

Motion by Clausen second by Monson to close the public hearing Budget Amendment #2 for FY 2014.  Carried 5-0.

Motion by Clausen second by Monson to approve the Budget Amendment #2 for FY 2014.  Carried 4-1; Tripp opposed.  Copy filed.

Motion by Monson second by Smith to approve the Appropriation Transfers in Service Area – Public Safety and Legal Services.  Carried 5-0.

Motion by Tripp second by Smith to approve Amendment #1 of Woodbury County Secondary Roads Budget to Iowa DOT.  Carried 5-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

The County Auditor discussed a collective bargaining agreement with the board.

Irwin Grau, 433 E. Maple, Lawton, addressed the Board with concerns about drainage in Woodbury County. Tim Nelson, Correctionville presented the Board a set of US flags and led the room in reciting the Pledge of Allegiance.   The Board adjourned the regular meeting until May 27, 2014.
