JANUARY 14, 2014 — THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 14, 2014 at 9:30 a.m.  Board members present were Clausen, Boykin, Monson, Smith, and Tripp.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The private session to discuss Bargaining Strategy Pursuant to Iowa Code Section 20.17(3) was postponed.

The meeting was called to order.   Motion by Monson second by Tripp to approve the minutes of the 01/07/2014 Board meeting.  Carried 5-0.  Copy filed.   Motion by Clausen second by Monson to approve the county’s claims totaling $643,332.53.  Carried 5-0.  Copy filed.

Motion by Tripp second by Smith to approve the transfer of Dawn Norton, Clerk II, Rural Economic Development Dept., effective 01/20/14, $18.81/hour. Transfer from Sheriff Clerk II to Economic Development Clerk II.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Clerk II, County Sheriff Dept., AFSCME Courthouse Contract Grade 3:  $14.67/hour or per contract language and for Director, Human Resources Dept., Wage Plan:  $60,000-$80,000/year  Carried 5-0.  Copy filed.

Presentation of County Audit from Jeff Peter with Williams and Company.  Copy filed.

Motion by Monson second by Tripp to receive the Comprehensive Annual Financial Report for the year ending June 30, 2013.  Carried 5-0.  Copy filed.

Motion by Smith second by Tripp to approve and authorize the Chairperson to sign a Service Agreement with PFA Inc.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve the Certificate of Completion for Project No. PCC Patching 2013 with Cedar Falls Construction.   Carried 5-0.  Copy filed.

Motion by Smith second by Monson to approve the Certificate of Completion for Project No. G-2014 Stock Pile-Maintenance Gravel with Hallett Materials.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to approve the Certificate of Completion for Project No. G-2014 Pit-Maintenance Gravel with Hallett Materials.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve the Certificate of Completion for Project No. Washed Sand-Maintenance Icing Sand with Hallett Materials.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Resolution Construction Evaluation under Iowa Code Section 459.301(3) for the period of February 1, 2014 through January 31, 2015.  Carried 5-0.

RESOLUTION #11,961

CONSTRUCTION EVALUATION RESOLUTION

WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and

WHEREAS,  by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2014 and January 31, 2015 and submit an adopted recommendation regarding that application to the DNR; and

WHEREAS,  the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

Motion by Smith second by Clausen to appoint to the Woodbury County Zoning Commission.  Carried 5-0.

Motion by Tripp second by Smith to approve Jean Jessen to sign the MOU for the 2014 EMS System Development Grant.  Carried 5-0.   The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Patty Robinson discussed her concerns with courthouse security with the Board.

Motion by Clausen second by Monson to receive the Medical Examiner (General Basic) budget as submitted.  Carried 5-0.

Motion by Clausen second by Tripp to reduce the travel line item by $500.00 in Board of Supervisors (General Basic)-Board Expense budget.  Carried 3-2; Smith and Boykin opposed.

Motion by Tripp second by Clausen to receive the Board of Supervisors (General Basic)-Board Expense budget as amended.  Carried 5-0.

Motion by Monson second by Smith to receive the Board of Supervisors (General Basic)-Board Administration budget as submitted.  Carried 5-0.

Motion by Smith second by Clausen to receive the Board of Supervisors (General Basic)-Civil Service budget as submitted.  Carried 5-0.

Motion by Clausen second by Smith to receive the Board of Supervisors (General Basic)-Public Bidder budget as submitted.  Carried 4-1; Tripp opposed.

Motion by Tripp second by Monson to receive the Board of Supervisors (General Basic)-Mail Services budget as submitted.  Carried 5-0.

Motion by Monson second by Tripp to receive the Sanitary Landfill (Rural Basic) budget as submitted.  Carried 5-0.

Motion by Smith second by Monson to receive the County Treasurer (General Basic) Motor Vehicle budget as submitted. Carried 5-0.

Motion by Smith second by Monson to receive the County Treasurer (General Basic) Tax Department budget as submitted.  Carried 5-0.

Motion by Clausen second by Smith to receive the Building Services-Courthouse (General Basic) budget reduced by $14,103.  Carried 5-0.   Motion by Clausen second by Smith to receive the Building Services-LEC (General Basic) budget reduced by $3,200.  Carried 5-0.

Motion by Clausen second by Tripp to receive the Building Service-Tropser-Hoyt (General Basic) budget reduced by $3,000.  Carried 5-0.   Motion by Tripp second by Clausen to receive the Building Services-Prairie Hills Facility (General Basic) budget as submitted.  Carried 5-0.

Consideration of the Building Services-County CIP Projects (General Basic) budget was deferred to the general CIP discussion.

Motion by Smith second by Tripp to receive the Building Services-Old Eagles Building (General Basic) budget reduced by $400.  Carried 5-0.

Motion by Clausen second by Tripp to receive the WCICC Information (General Basic) budget as submitted.  Carried 5-0.

Motion by Clausen second by Smith to receive the County Attorney (General Basic) Administration budget reduced by $4,525.  Carried 5-0.

Motion by Smith second by Tripp to receive the County Attorney (General Basic) Edward Bryne Grant budget as submitted.  Carried 5-0.

Motion by Tripp second by Smith to receive the County Attorney (General Basic) Juvenile Division budget reduced by $1,085.  Carried 5-0.

Motion by Clausen second by Tripp to receive the County Attorney Jury and Witness Fees (General Supplemental) budget as submitted.  Carried 5-0.

The Board recessed until 1:00 P.M. Mr. Monson excused himself.

Motion by Smith second by Boykin to receive the County Sheriff Investigations (General Basic) budget reduced by $58,766.  Carried 3-0; Tripp abstained.

Motion by Boykin second by Smith to receive the County Sheriff Correctional Facility-LEC (General Basic) budget reduced by $311,711.  Carried 3-0; Tripp abstained.

Motion by Smith second by Clausen to receive the County Sheriff Correctional Facility-Prairie Hills (General Basic) budget as submitted.  Carried 3-0; Tripp abstained.

Motion by Clausen second by Smith to receive the County Sheriff Administration (General Basic) budget reduced by $220,000.  Carried 3-0; Tripp abstained.
