DECEMBER 10, 2013 — FIFTYTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, December 10, 2013 at 10:00 a.m.  Board members present were Clausen, Smith, Boykin, and Monson; Tripp was absent.  Staff members present were Karen James, Board Administrator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.   Motion by Monson second by Boykin to approve the minutes of the 12/03/2013 Board meeting.  Carried 4-0.  Copy filed.

Motion by Boykin second by Monson to approve the minutes of the 12/03/13 Special Board meeting.  Carried 4-0.  Copy filed.

Motion by Smith second by Monson to approve the minutes of the 12/05/13 Special Board meeting.  Carried 4-0.  Copy filed.

Motion by Smith second by Boykin to approve the county’s claims totaling $754,483.34.  Carried 4-0.  Copy filed.

Motion by Boykin second by Monson to approve amending the CWA Deputies Contract current shift differential from .40 cents and .50 cents per hour to .45 cents per hour effective 11/25/13 per recommendation of Doug Phillips subject to the approval of the bargaining unit.  Carried 4-0.

Motion by Smith second by Monson to approve the appointment of Todd Caster, Custodian, Building Services Dept., effective 12/11/13, $13.18/hour. Job Vacancy Posted 10-23-13.  Entry Level Salary:  $13.18/hour.; the appointment of Raymond Richtermeier, Temporary Equipment Operator, Secondary Roads Dept., effective 12/11/13, $20.30/hour. Not to exceed 120 days.; the reclassification of Terry Svendsen, Maintenance Worker, Building Services Dept., effective 12/20/13, $16.11/hour, 5%=$.77/hour.  Per AFSCME Courthouse Contract agreement, from Grade 3/Step 2 to Grade 3/Step 3.; and the reclassification of Scott Mueggenberg, Youth Worker, Juvenile Detention Dept., effective 12/21/13, $22.38/hour, 5.5%=$1.18/hour. Per AFSCME Juvenile Detention Contract agreement, from Grade 1/Step 4 to Grade /Step 5.  Carried 4-0.  Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Clerk II, Rural Economic Development Dept., AFSCME Courthouse Contract Grade 3:  $14.67/hour or per contract language.  Carried 4-0.  Copy filed.

Motion by Monson second by Smith to approve and receive for signatures, a Resolution thanking and commending Julie Taylor for her years of service to Woodbury County.  Carried 4-0.

RESOLUTION THANKING AND COMMENDING

JULIE TAYLOR

FOR HER YEARS OF SERVICE TO WOODBURY COUNTY  

WHEREAS, Julie Taylor has capably served Woodbury County as an employee of the Siouxland District Health Department  for 15 years from October 26, 1998 to December 3, 2013; and

WHEREAS, the service given by Julie Taylor as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Julie Taylor  for her  years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Julie Taylor.

BE IT SO RESOLVED this 10th day of December,  2013.

RESOLUTION ACCEPTING AND APPROVING

TO WOODBURY COUNTY, IOWA

WHEREAS, THE OWNER AND PROPRIETOR DID ON THE 22nd DAY OF October, 2013, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS HIGH PLACES ADDITION, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

Motion by Monson second by Smith to approve and authorize the Chairperson to sign a Resolution authorizing tax abatement for WM Carl Scanifer, for a mobile home that was deemed valueless home per Sec 555c.3, parcel #884730301980, taxes for 2011-11 through 2013-14, totaling $110.00 plus interest.  Carried 4-0.

RESOLUTION APPORVING ABATEMENT OF TAXES

WHEREAS, WM Carl Scanifer  is the titleholder of a mobile home on leased land Parcel #884730301980 located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the abovestated property has taxes payable Including special assessments and the parcel is owned by WM Carl Scanifer, and

WHEREAS, these taxes are uncollectable or impractical to pursue collection through personal judgment or tax sale

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

RESOLUTION LEVYING SPECIAL ASSESSMENT AND CERTIFICATE

TO THE AUDITOR OF WOODBURY COUNTY

RESOLUTION #11,945_

WHEREAS: The Woodbury County Board of Supervisors is the governing body of the Smithland District of Woodbury County, and

WHEREAS: said Board, as Trustees and in response to a petition from affected landowners, has determined it is necessary to levy a special tax and/or assessment for the purpose of improving the integrity and protection of the levee on the left bank of the Little Sioux River and that said tax is assessed against all tracts of land protected by said levee and only that benefitted part of said District,

NOW, THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Smithland District that a special tax and/or assessment in the sum of $98,000.00 be levied against the benefited tracts of land in the ratio herein established, adopted and confirmed.

BE IT FURTHER RESOLVED that said special tax and/or assessment in the sum of $98,000.00 shall be spread over three years at no interest to the benefited parcels with the project cost to be loaned to the district from the Local Option Sales and Service Tax Fund.

BE IT FURTHER RESOLVED that said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and /or assessment against all of the said benefited lands, etc. in the ratio and percentage and upon the same classification as heretofore adopted, established and confirmed and enter the same upon the tax list of Woodbury County for collection beginning with the first half of the real estate taxes payable September, 2014.

Motion by Smith second by Boykin to approve and authorize the Chairperson to sign a Resolution establishing bridge embargoes at various bridges on the Woodbury County Secondary Road system.  Carried 4-0.

WOOBDURY COUNTY

BRIDGE EMBARGO RESOLUTION

RESOLUTION #11,946

WHEREAS: The Board of Supervisors is empowered under authority of Sections 321.236 Sub. (8), 321.471 to 321.473 to prohibit the operation of vehicles or impose limitations as to the weight thereof on designated highways or highway structures under their jurisdiction, and

WHEREAS: the Woodbury County Engineer has caused to be completed the Structure Inventory and Appraisal of certain bridges according to accepted Bridge Inspection Standards and has determined that the bridges below, require revision to their current load ratings,

NOW, THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that the following vehicle and load limit be established and that signs be placed advising of the permissible maximum weights thereof on the bridge listed herein.

Discussion with Ivan Droessler, I & S Group, on Orton Slough improvement preliminary design work and the next steps in the project development was postponed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

The Board recessed at 10:25 a.m. until 11:00 a.m.

Motion by Boykin second by Monson to go into closed session with Dan Hartnett per Iowa Code Section 21.5(1)(c).  Carried 4-0 on a roll call vote.

Motion by Boykin second by Monson to go out of closed session with Dan Hartnett per Iowa Code Section 21.5(1)(c).  Carried 4-0 on a roll call vote.

The Board adjourned the regular meeting until December 17, 2013.
