MAY 21, 2013 — TWENTYFIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 21, 2013 at 10:00 a.m. Board members present were Clausen, Monson, Smith, Boykin and Tripp. Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The meeting was called to order.
Motion by Monson second by Tripp to approve the minutes of the 5/14/2013 Board meeting. Carried 5-0. Copy filed.
Motion by Boykin second by Tripp to approve the separation of Charles Clark, Temporary Equipment Operator, Secondary Roads Dept., effective 05/16/13. End of Temporary Work.; the separation of Gary Worrell, Temporary Equipment Operator, Secondary Roads Dept., effective 05/16/2013. Motion by Smith second by Boykin to approve and receive for signatures, a Resolution to Accept Bollymeyer Avenue into the Secondary Road System. Carried 5-0.
WOODBURY COUNTY, IOWA

RESOLUTION ACCEPTING BOLLYMEYER AVENUE INTO THE
SECONDARY ROAD SYSTEM
WHEREAS, the Woodbury County Board of Supervisors under Chapter 306.4 has jurisdiction over the Woodbury County secondary road system, and
WHEREAS, Chapter 306.10 gives said Board the power to establish, alter, or vacate roads on the secondary road system, and
WHEREAS, the Woodbury County Subdivision Ordinance, section 6.05 prescribes a procedure for which new subdivision streets can be constructed to comply with county requirements for acceptance into the secondary road system and allows a subdivision developer to petition to have a subdivision or road established as a county secondary road upon the completion of construction, and
WHEREAS, the County Engineer has inspected the construction of a new road, acknowledges that the construction of the road is complete and in compliance with the county subdivision ordinance and applicable state and county standards,
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that a subdivision street that is platted as a part of the Bollmeyer First Addition, replat of Lot 5 subdivision and designated as Bollmeyer Avenue has been accepted into the Woodbury County Secondary Road system as a county road and that the road is open to the public.

Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Permit to Work in the County Right of Way for Ron Heck, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
Motion by Tripp second by Boykin to approve and authorize the Chairperson to sign a Permit for underground Utilities for Long Lines Communications on Buchanan Avenue, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Permit for underground for Long Lines Communications on 230th St., per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
There was discussion of a Road Vacation on Pocahontas Avenue.
Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Federal Aid Project Agreement for Project Number STP-S-CO97(121)—5E-97, County Road D51 Pavement Replacement Project (Part of CF Industries RISE Project), per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed. A public hearing was held at 10:15 a.m. for the sale of property parcel #185640 (3500 W. 7th St.).
Then Chairperson called on anyone wishing to be heard.
Motion by Boykin second by Monson to close the hearing. Carried 5-0.
Motion by Tripp second by Monson to approve and authorize the Chairperson to sign a Resolution for the sale of this parcel to Wild Hill Honey (23 La Salle Ave, Sioux City), for real estate parcel #185640 (3500 W 7th St., Sioux City) for $627.00 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By ___Wild Hill Honey_________in the sum of Six Hundred Twenty-Seven Dollars & 00/100 ($627.00)-----------------------------------------------------dollars.
For the following described real estate, To Wit: Parcel #185640 Lots Nine and Ten Block Five Golf View Addition City of Sioux City Woodbury County, Iowa (3500 W. 7th Street)
Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
