APRIL 30, 2013 — EIGHTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 30, 2013 at 10:00 a.m. Board members present were Clausen, Monson, Smith, Boykin and Tripp. Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
The meeting was called to order.
Motion by Monson second by Boykin to approve the minutes of the 4/23/2013 Board meeting. Carried 4-0; Tripp abstained. Copy filed.
Motion by Smith second by Boykin to approve the separation of Raymond Richtermeier, Temporary Equipment Operator, Secondary Roads Dept., effective 04/17/2013. End of Temporary Work.; the promotion of Christine Murphy, Senior Clerk, Auditor/Recorder Dept., effective 5/01/13, $19.91/hour, 7.9%=$1.47/hour. Promotion from Recorder Clerk II to Senior Clerk.; the reclassification of Lisa Anderson, Secretary, Human Resources Dept., effective 05/16/13, $19.69/hour, 5%=$.96/hour. Per Wage Plan Comparability with AFSCME Courthouse Contract, from Grade5/Step 3 to Grade 5/Step 4; and the reclassification of Stephanie Nelson, Asst. Director, Juvenile Detention Dept., effective 5/19/13, $51,966/year, 3.9%=$1,972/year. Per Wage Plan Matrix, 3 year salary increase. Carried 5-0. Copy filed.

1. That a public hearing on the aforesaid proposal shall be held on
the 14th Day of May, 2013 at 10:17 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 14th
Day of May, 2013, immediately following the closing of the public
hearing to Rick Birkhofer only per Code of Iowa 331.361
(2).
3. That said Board proposes to sell the said real estate to Rick Birkhofer
only for consideration of $1.00 plus recording fees.

RESOLUTION NO #11,037
ESTABLISING LIBERTY PARK URBAN RENEWAL AREA TAX
INCREMENT REVENUE FUND AND AUTHORIZING LOAN TO THAT FUND
WHEREAS, the Board of Supervisors of Woodbury County, Iowa, has established an urban renewal area in the County, known as the Liberty Park Urban Renewal Area (the “Urban Renewal Area”); and
WHEREAS, certain street improvements (the “Street Improvements”) need to be undertaken in order to make it possible for the development of the Urban Renewal Area; and
WHEREAS, in order to make the cost of the Street Improvements eligible to be paid from future incremental property tax revenues, it is necessary to create an internal debt;
NOW, THEREFORE, IT IS RESOLVED by the Board of Supervisors of Woodbury County, Iowa, as follows:
Section 1. There is hereby established the Liberty Park Urban Renewal Area Tax Increment Revenue Fund (the “Tax Increment Fund”), into which all incremental property tax revenues received from the Urban Renewal Area shall be deposited.
Section 2. It is hereby directed that $100,000 be advanced to the Tax Increment Fund from the General Fund, in order to pay the costs of the Street Improvements. This advance shall be treated as a loan (the “Loan”) to the Tax Increment Fund and shall be repaid to the General Fund out of incremental tax revenues received with respect to the Urban Renewal Area.
Payments on the Loan are subject to annual appropriation by the Board of Supervisors and to the Board’s determination that there are incremental tax revenues available for such purpose which have been allocated to or accrued in the Tax Increment Fund.
Once appropriated, payments shall be made on the Loan on June 1 of each year to the extent there are incremental tax revenues available for such purpose which have been allocated to or accrued in the Tax Increment Fund. The right is hereby reserved to issue additional obligations, or to enter into additional loans, payable from the Tax Increment Fund, which may either rank on a parity with the Loan or may have a priority over the Loan with respect to the revenues in the Tax Increment Fund.
Section 3. The Tax Increment Fund is hereby pledged to the repayment of the Loan, and a copy of this Resolution shall be filed in the office of the County Auditor to evidence this pledge.
Section 4. All resolutions or parts thereof in conflict herewith, are hereby repealed, to the extent of such conflict.
