FEBRUARY 26, 2013 — NINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 26, 2013 at 10:00 a.m.  Board members present were Clausen, Tripp, Monson and Smith; Boykin was absent.  Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

Motion by Smith second by Monson to go into closed session per Iowa Code Section 21.5(1)(c). 
Mr. Tripp excused himself.  Carried 3-0 on a roll-call vote.

Motion by Monson second by Smith to go out of closed session per Iowa Code Section 21.5(1)(c).  Carried 3-0 on a roll-call vote.

Motion by Smith second by Monson to go into closed session per Iowa Code Section 21.5(1)(c).  Carried 3-0 on a roll-call vote.

Motion by Smith second by Monson to go out of closed session per Iowa Code Section 21.5(1)(c).  Carried 3-0 on a roll-call vote.

Motion by Monson second by Smith approve the recommendation of the board’s attorney regarding a settlement agreement pertaining to claims brought against the County contesting jail procedures.  Carried 3-0; Tripp abstained.

The meeting was called to order.

Motion by Monson second by Tripp to approve the minutes of the 2/19/2013 Board meeting.  Carried 3-0; Smith abstained.  Copy filed.

Motion by Tripp second by Monson to approve the reclassification of Jennifer Fuentes, Youth Worker, Juvenile Detention Dept., effective 03/11/2013, $23.37/hour, 6.5%=$1.4/hour.  Per AFSCME Juvenile Detention Contract agreement, from Grade 1/Step 5 to Grade 1/Step 6,  and the reclassification of Ryan Weber, Assistant Director, Juvenile Detention Dept., effective 03/21/2013, $55,423/year, 6.5%=$3,427/year.  Per Wage Plan Matrix, 6 year salary increase.   Carried 4-0.  Copy filed.
      
Motion by Smith second by Monson to approve and authorize the chairperson to sign the CWA Civilian Officers Contract.  Carried 3-0; Tripp abstained.  Copy filed.

Motion by Smith second by Monson to lift the suspension of taxes for Kathy Huber, 417 Prescott St., Sioux City, Parcel #894730152015.  Carried 4-0.

Motion by Monson second by Tripp to lift the suspension of taxes for Arthur Sweisberger, 3102 Leech Ave., Sioux City, Parcel #894735110012.  Carried 4-0.

Motion by Monson second by Tripp to approve and authorize the Chairperson sign a Resolution of Support for Project Submittal to the SRTPA for County Road K25 PCC Pavement, per recommendation of County Engineer Mark Nahra.  Carried 4-0.

COMMITMENT OF FUNDS AND PROJECT MAINTENANCE
RESOLUTION #11,014

WHEREAS: The Board of Supervisors is submitting application to the SRTPA RPA Surface Transportation Program for the following project in FY 2017, and

275th Street PCC Pavement Replacement Project

NOW, THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that County Engineer is directed to submit application for the above captioned project, that the Board of Supervisors will dedicate the local match funding for the project, and that Woodbury County will maintain the completed project for its intended public use for a minimum of 20 years following project completion.

Passed and approved this 26th day of February, 2013.

Motion by Monson second by Tripp to approve a 5% Salary Increase for Veteran Affairs Director, Danielle Dempster.  Failed 2-2; Clausen and Smith opposed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
      
Motion by Monson second by Tripp to go into closed session per Iowa Code Section 21.5(1)(a).  Carried 4-0 on a roll-call vote.

Motion by Monson second by Tripp to go out of closed session per Iowa Code Section 21.5(1)(a).  Carried 4-0 on a roll-call vote.
 
The Board adjourned the regular meeting until March 5, 2013.
