FEBRUARY 12, 2013 — SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 12, 2013 at 10:00 a.m.  Board members present were Clausen, Tripp, Monson and Smith; Boykin was absent.  Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

The Board of Supervisors canvassed the Western Iowa Tech/Sioux City Schools/Westwood Schools Special Election held on the 5th day of February, 2013.

Motion by Smith second by Tripp to receive for signatures the canvass of the Western Iowa Tech/Sioux City Schools/Westwood Schools Special Election held on the 5th day of February, 2013.  Carried 4-0.

Sioux City Community Schools - Board Member – 1 Vacancy
 
P. Paul Gorski Received three hundred forty-eight (348) votes
John Meyers Received one thousand two hundred eighty-seven (1287) votes
Jacqueline Ritter Received four hundred fifty-five (455) votes
Paul Speidel Received two hundred eighty-two (282) votes
Scattered Write-ins Twenty-four (24) votes
TOTAL Two thousand three hundred ninety-six (2396) votes
We therefore declare:
John Meyers duly elected for the office of Sioux City School Board Member for the term of .58 years.
 
Westwood Community Schools - Board Member – 1 Vacancy

Diana Nordstrom Received one hundred thirty-two (132) votes
Scattered Write-ins Eight (8) votes
TOTAL One hundred forty (140) votes
We therefore declare:
Diana Nordstrom duly elected for the office of Westwood School Board Member for the term of .58 years.
      
Western Iowa Tech Community College - Public measure

“Shall the Board of Directors of Western Iowa Tech Community College in the Counties of Buena Vista,
Carroll, Cherokee, Crawford, Harrison, Ida, Monona, Plymouth, Sac, Shelby, Sioux and Woodbury,
State of Iowa, cause to be levied a tax not to exceed six (6) cents per thousand dollars of assessed value
in any one year for a period of ten consecutive fiscal years beginning with the tax levy to be made for
collection in the fiscal year ending June 30, 2016, for either of the following purposes:  program sharing
between community colleges or for the purchase of instructional equipment; or for such other purposes
as authorized by law, as provided in Chapter 260C, Section 28 of the Code of Iowa?”

For the question, there were: Two thousand one hundred fifty-one (2151) votes
 
Against the question, there were: Eight hundred ninety-five (895) votes
 
TOTAL Three thousand forty-six (3046) votes
 
The meeting was called to order.

Motion by Tripp second by Monson to approve the minutes of the 2/05/2013 Board meeting.  Carried 4-0.  Copy filed.

A public hearing was held at 10:01 a.m. for the Liberty Park Urban Renewal Plan. 

The Chairperson called on anyone wishing to be heard. 
      
Motion by Smith second by Monson to close the hearing.   Carried 4-0.
      
Motion by Smith second by Clausen to approve and authorize the Chairperson to sign a Resolution for the Liberty Park Urban Renewal Plan.  Carried 4-0 on a roll call vote.

WOODBURY COUNTY, IOWA
RESOLUTION # 11,006
LIBERTY PARK URBAN RENEWAL PLAN

WHEREAS, as a preliminary step to exercising the urban renewal authority conferred upon Iowa counties by Chapter 403 of the Code of Iowa, a county must adopt a resolution finding that one or more economic development areas exist in the county and that the development of such area or areas is necessary in the interest of the public health, safety or welfare of the residents of the county; and

WHEREAS, it has been recommended that an urban renewal area be established to include the property described in Exhibit A to this Resolution; and

WHEREAS, a proposal has been made regarding the area identified above for the purpose of establishing the need to designate the area as being appropriate for economic development; and

WHEREAS, the proposal demonstrates that sufficient need exists to warrant finding the area to be an economic development area; and

WHEREAS, notice of a public hearing by the Board of Supervisors on the question of establishing the area identified above as an urban renewal area and on a proposed urban renewal plan and project for the area was heretofore given in strict compliance with the provisions of Chapter 403 of the Code of Iowa, and the Board has conducted the hearing; and

WHEREAS, copies of the urban renewal plan, notice of public hearing and notice of a consultation meeting with respect to the urban renewal plan were mailed to the Sergeant Bluff-Luton Community School District and the consultation meeting was held;

NOW, THEREFORE, It Is Resolved by the Board of Supervisors of Woodbury County, Iowa, as follows:

An economic development area as defined in Chapter 403 of the Code of Iowa is found to exist with respect to the property described in Exhibit A.

The area identified in Section 1 hereof is hereby declared to be an urban renewal area, in conformance with the requirements of Chapter 403 of the Code of Iowa, and is hereby designated the Liberty Park Urban Renewal Area.

The development of this area is necessary in the interest of the public health, safety or welfare of the residents of Woodbury County, Iowa.

It is hereby determined by this Board of Supervisors as follows:
1. The proposed urban renewal plan conforms to the general plan of the County as a whole;
2. Proposed economic development in the urban renewal area is necessary and appropriate to facilitate the proper growth and development of the County in accordance with sound planning standards and local community objectives.
3. The urban renewal plan for the Liberty Park Urban Renewal Area is made a part hereof and is hereby in all respects approved in the form presented to this Board, and the proposed project for the area based upon such plan, using tax increment revenues to finance a portion of the construction of a county road to serve the expansion of facilities operated by CF Industries, is hereby in all respects approved.

Section 6.  All resolutions or parts thereof in conflict herewith are hereby repealed, to the extent of such conflict.

Motion by Monson second by Smith to receive for signatures the AFSCME Local 3462, Council 61, Woodbury County Juvenile Detention Center Bargaining Unit Contract.  Carried 3-0; Tripp abstained.  Copy filed
 
Motion by Monson second by Smith to receive for signatures the AFSCME Local 3462, Council 61, Woodbury County Assistant County Attorneys and Victim Witness Coordinator Bargaining Unit Contract.  Carried 3-0; Tripp abstained.  Copy filed

Motion by Monson second by Tripp to receive the Sheriff’s Civil Division Second Quarter and Year to date Report.  Carried 4-0.  Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairperson to sign a Resolution accepting Brittany’s First Addition (A Minor Subdivision) into Woodbury County.  Carried 4-0.

RESOLUTION ACCEPTING AND APPROVING
BRITTANY’S ADDITION, A MINOR SUBDIVISION
TO WOODBURY COUNTY, IOWA

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 27th DAY OF DECEMBER, 2012, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS BRITTANY’S ADDITION, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF BRITTANY’S ADDITION, WOODBURY COUNTY, IOWA, BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

A RESOLUTION THANKING AND COMMENDING
LYNNE EATON
FOR HER SERVICE TO WOODBURY COUNTY

WHEREAS, Lynne Eaton has capably served Woodbury County as an employee of the Woodbury County Sheriff’s Office  for 26 years from March 24, 1987 to March 1, 2013; and

WHEREAS, the service given by Lynne Eaton as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Lynne Eaton  for her years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Lynne Eaton.

Motion by Tripp second by Monson to approve contract for Project Number L-B-11(1)—79-97 with Nelson and Rock Contracting, Onawa, IA, per recommendation of County Engineer Mark Nahra.  Carried 4-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
 
Motion by Smith second by Tripp to approve a per meeting rate of $25 for Township Trustees and Clerks and a bookkeeping hourly rate to be paid at Iowa minimum wage in effect at the time a claim is filed commencing July 1, 2012.  Carried 4-0.

Motion by Smith second by Monson to receive the report of the Compensation Board.  Carried 3-1; Tripp opposed.  Copy filed.

Motion by Smith second by Monson to reduce the funding for the First Tee Program by $54,433.  Carried 3-1; Tripp opposed.
