OCTOBER 02, 2012 — THIRTYNINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 02, 2012 at 10:00 a.m.  Board members present were Monson, Clausen, Boykin, Tripp, and Smith.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Clausen second by Monson to approve the minutes of the 09/25/2012 Board meeting.  Carried 5-0.  Copy filed.

Motion by Boykin second by Clausen to approve the separation of Mark Moulton, Maintenance Worker, Building Services Dept., effective 09-21-12. Resignation; the appointment of Kayne Weaver, Civilian Jailer, County Sheriff Dept., effective 10-03-12, $16.40/hour.  Job Vacancy posted:  08-01-12 Entry. Level Salary $16.40/hour; the appointment of Abby Riesberg, Motor Vehicle Clerk II, County Treasurer Dept., effective 10-03-12, $14.38/hour. Job Vacancy Posted: 08-22-12. Entry Level Salary $14.38/hour.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairperson to sign an “Authorization to Initiate Hiring Process” for Maintenance Worker, Building Services Dept., AFSCME Courthouse Grade 2/Step 1 to Step 3 Range:  $13.54/hour to $14.89/hour.  Carried 5-0.  Copy filed.

Motion by Boykin second by Tripp to accept the settlement with UBS per P.J. Jennings, County Attorney.  Carried 5-0. 

Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution approving petition for suspension of taxes for Thomas Prince, 1761 West St., Sioux City, parcel #894719437006.  Carried 5-0.

RESOLUTION APPROVING SUSPENSION OF TAXES
 
WHEREAS, Thomas E. Prince  as joint titleholders of  a property  located at 1761 West St.,   Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #894719437006

Lot Two (2) Block Seven (7)   Smiths Villa 2nd Addition, City of Sioux City, Woodbury County, Iowa
                                      
WHEREAS, Thomas E. Prince, as joint titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem this property  Parcel  #894719437006 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

Motion by Boykin second by Tripp to approve Courthouse restoration tower window contract change order #4.  Carried 5-0.

Motion by Boykin second by Clausen to approve and authorize the Chairperson to sign a Resolution approving Letter of intent to form a region for Mental Health Redesign.  Carried 3-2; Monson and Tripp opposed.

RESOLUTION # 10,976
RESOLUTION APPROVING INTENT TO FORM REGION
WHEREAS, The Iowa Legislature has passed and the Iowa Governor has signed SF2315, an Act relating to the Redesign of Publicly Funded Mental Health and Disability Services' and

WHEREAS, SF2315 expresses the intent of the Legislature that Mental Health and Disability Services shall be provided by counties operating together as Regions; and

WHEREAS, the Woodbury County Board of Supervisors finds it is in the public's best interest to make informed decisions regarding entrance into a Region based on sound planning while adhering to the following guiding principles: 1. Assuring the provision of adequate services, 2. Maintaining local control, and 3. Protecting local tax payers; and

WHEREAS, Cherokee, Plymouth, Sioux, and Woodbury Counties (the "Counties") have begun planning for the development and delivery of Mental Health and Disability Services through a Regional Structure;

NOW, THEREFORE, in consideration of the promises and mutual covenants set forth herein, the above Counties agree to use best efforts in jointly developing a Region under the following terms;

BE IT RESOLVED that Woodbury County commits to participate in the planning and development of this Region, which includes Cherokee, Plymouth, Sioux, and Woodbury Counties (the "Region").

BE IT FURTHER RESOLVED that the Counties have determined that the Region complies with the requirements in Iowa code Section 331.438B(3}, as enacted by SF2315.

BE IT FURTHER RESOLVED that Woodbury County hereby authorizes the county CPC and any members of the Board of Supervisors to attend and participate in all planning meetings throughout the planning process.

BE IT FURTHER RESOLVED that Woodbury County agrees to negotiate in good faith with the Counties to enter into a 28E agreement acceptable to the Counties.

BE IT FURTHER RESOLVED that Woodbury County understands that this is an exclusive letter of intent for planning purposes and the County will not at any time during the effectiveness of this letter of intent, solicit, or further discuss or enter into any agreement with any other counties or entities concerning forming a region under SF2315.

BE IT FURTHER RESOLVED that this letter of intent shall be effective upon its execution by the Board of Supervisors for each of the Counties.

BE IT FURTHER RESOLVED that upon effectiveness, this Letter of Intent shall accompany our formal request to form a region, which will be submitted to the Department of Human services as soon as Is practical.

BE IT FURTHER RESOLVED that after effectiveness, this Letter of Intent shall remain in effect until any of the following occur:
* The Department of Human Services rejects this Letter of Intent;
* Anyone of the counties provides a resolution from its Board of Supervisors to all the other counties that are party to this letter of intent, that it has determined it is no longer in its best interest to commit to the planning and participation in this Region; or
* The Counties execute and enter into an effective 28E Agreement to finalize the formation of a
Region.

BE IT FURTHER RESOLVED that this letter of intent may be amended by mutual agreement of the Counties, provided that such amendment shall be incorporated in a written Addendum hereto executed by the Boards of Supervisors of each County.

Motion by Boykin second by Monson to approve the distribution of $25,000.00 Grocery Grant for Correctionville, per recommendation of Rob Marqusee, Rural Economic Development.  Carried 5-0.

Motion by Tripp second by Monson to award the bid for Project No. BROS-CO97(100)—8J-97  to Dixon Construction, Correctionville, IA, for $728,439.30, per recommendation of Mark Nahra, County Engineer.  Carried 5-0.  Copy filed.

A public hearing was held at 10:30 a.m. for Alterations and Security Upgrades Phase I, County Jail.

The Chairman called on anyone wishing to be heard.
 
James Van Bruggen, Taxpayer’s Research Conference asked about the engineer’s estimate.
      
Motion by Boykin second by Clausen to close the hearing.   Carried 5-0.

Opening of bids for Alterations and Security Upgrades Phase I, County Jail.
 
The bids are as follows:

HCI Construction, South Sioux City, NE                $676,494.00
L & L Builders, Sioux City, IA                               $672,000.00

Motion by Clausen second by Boykin to refer the bids to the architecht for review and recommendation.  Carried 5-0. 

Motion by Boykin second by Clausen to approve increase of Contract Amount for Architectural Services.  Carried 4-0; Tripp abstained. Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
