FEBRUARY 21, 2012 — EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 21, 2012 at 10:00 a.m.  Board members present were Clausen, Monson, Tripp and Smith; Boykin was absent.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Jean Jessen, Deputy Auditor. 

The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Clausen second by Tripp to approve the minutes of the 02/14/2012 Board meeting.  Carried 4-0.  Copy filed.

The Board approved the separation of Janet Johnson, Motor Vehicle Clerk II, County Treasurer Dept., effective 02-15-12.  Other.  Copy filed.

The Board approved the appointment of Aaron Carstens, Equipment Operator, Secondary Roads Dept., effective 02-22-12, $19.27/hour.  Job vacancy posted:  11-30-11.  Entry Salary:  $19.27/hour.  Copy filed.

The Board approved the separation of Crystal Scholten, Civilian Jailer, Sheriff Dept., effective 03-31-12.  Resignation.  Copy filed.

Motion by Tripp second by Monson to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Temporary Summer Laborers (5), Secondary Roads Dept., Wage Plan:  $8.00-$10.00/hour, based on experience; Temporary Engineering Aides (2), Secondary Roads Dept., Wage Plan:  $7.60-$12.50/hour, based on Experience; Civilian Jailer, County Sheriff Dept.,  CWA Civilian Officer:  $16.32/hour; Motor Vehicle Clerk II, County Treasurer Dept., AFSCME Courthouse Grade 3:  $13.86/hour or per Contract language .  Carried 4-0.  Copy filed.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for Parcel #562545& #562530, 1111 14th St & 1412 Court St, Sioux City.  Carried 4-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot 11, Galbraith’s Addition to Sioux City all that part of the West 50ft. of the unplatted part of Lot 11, called Glen Cove in the auditor’s plat of the Southeast Quarter of Section 21, Township 89, Range 47 in Woodbury County, Iowa, lying S of a straight east-west line projected East across said 50ft. strip of a point located on the SW corner of Lot 14 of Galbraith’s Addition to City of Sioux City, Woodbury County, Iowa

NOW THEREFORE,
 
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on
the  6th Day of March, 2012 at 10:15 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
     
2.  That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 6th Day of March,  2012,  immediately        
following the closing of the public hearing.
     
3.   That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $296.00 plus recording fees.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution setting the public hearing date for disposal of Excess Right of Way in Luton.  Carried 4-0.

NOTICE OF PROPERTY SALE
Disposal of Excess Right of Way in Luton

WHEREAS Woodbury County, Iowa may have an interest in a certain parcel of real estate described as:

All of vacated Second Street adjacent to Lot One (1) in Block (8) extended South to the South line of the North One-half (N ½ ) vacated East-West alley extended East, and all of vacated Third Street adjacent to Lot Six (6) in Block Eight (8) extended South to the South line of the North One-half (N ½ ) vacated East-West alley extended West, and all of the North One-half (N ½ ) vacated East-West alley in Block Eight (8), all in the Town of Luton, in the County of Woodbury and State of Iowa.

NOW THEREFORE,
 
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the herein proposal shall be held on
the  28th  Day of February, 2012 at 10:19 o’clock a.m. in the meeting 
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2.  That said Board proposes to sell Woodbury County’s interest, if any, in the said parcel
of real estate on the 28th Day of February, 2012, immediately following the closing of
the public hearing to Sandra Kay Lau only per Code of Iowa 331.361(2).
    
3.  That said Board proposes to quitclaim Woodbury County’s interest, if any, in said real 
estate to Sandra Kay Lau only for consideration of $1.00 plus recording fees.

Motion by Clausen second by Tripp to award the bid to Clark Construction, Whiting, IA for the amount of $44,130.00 for Hackley Lateral Drainage District improvements.  Carried 4-0.

Motion by Monson second by Tripp to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way for overhead or underground utilities for Northwest Iowa Power Cooperative, per Recommendation of County Engineer Mark Nahra.  Carried 4-0.  Copy filed.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way by Kiewit Construction/Port Neal Power Plants, per recommendation of County Engineer Mark Nahra.  Carried 4-0.  Copy filed.

Motion by Clausen second by Monson to approve plans for project number M-12(1)K185, Michigan Avenue Bridge repair, per recommendation of County Engineer, Mark Nahra.  Carried 4-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Budget discussion and action for FY 2013.

Motion by Clausen second by Monson to fund one-half of Planning & Zoning from Local Option Sales Tax funds.  Failed 2-2. 

Motion by Tripp second by Clausen to set public hearing for March 13, 2012 at 10:30 a.m. for Budget FY13.  Carried 4-0.

The Board adjourned the regular meeting until February 28, 2012.
