FEBRUARY 14, 2012 — SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 14, 2012 at 10:00 a.m. Board members present were Clausen, Monson, Tripp and Smith; Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
The Board of Supervisors canvassed the River Valley School District Special Election held on the 7th day of February, 2012, as shown by the tally lists returned from the several election precincts.
For the special proposition, upon the public measure Question A:
“Summary: To adopt the revenue purpose statement to replace the current Revenue Purpose Statement and authorize the expenditure of revenues from the State of Iowa secure an advanced vision for education fund received by the River Valley Community School District.”
There were Ninety-seven (97) ballots cast as follows:
For the question there were Ninety (90) votes cast.
Against the question there were Seven (7) votes cast.
We therefore declare the public measure to be adopted.
Motion by Tripp second by Clausen to receive for signatures the canvass of the River Valley School District Special Election. Carried 4-0. Copy filed.
The meeting was called to order.
Motion by Monson second by Tripp to approve the minutes of the 02/07/2012 Board meeting. Carried 4-0. Copy filed.
Motion by Clausen second by Monson to approve Patrick Weaver to remain on County Insurance Plan. Carried 4-0.
Motion by Clausen second by Tripp to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Weed Commissioner/P/T Equipment Operator, Secondary Roads Dept., CWA Secondary Roads, Wage Plan: $19.27/hour. Carried 4-0. Copy filed.
Motion by Tripp second by Monson to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Foreman, Secondary Roads Dept., Amended Wage Plan: $51,502-$53,048/year. Carried 4-0. Copy filed.
Motion by Clausen second by Monson to approve and authorize the Chairman to sign County Farm lease between Woodbury County, Iowa, Board of Supervisors (“Landlord”), and Tony and Kim Kohn, doing business as Kohn Farms (“Tenant”). Carried 4-0. Copy filed.
Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for Parcel #058455, 1409 Myrtle St., Sioux City. Carried 3-1; Clausen opposed.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Lot Four, Block Thirty-Seven, North Sioux City Addition to Sioux City, in the County of Woodbury and State of Iowa

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on
the 28th Day of February, 2012 at 10:15 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 28th
Day of February, 2012, immediately following the closing of the public
hearing to Lea Knowles only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Lea Knowles only
for consideration of $200.00 plus recording fees.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on
the 28th Day of February, 2012 at 10:17 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 28th
Day of February, 2012, immediately following the closing of the public
hearing to Silverio Lomeli only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Silverio Lomeli only
for consideration of $78.00 plus recording fees.

Motion by Monson second by Tripp to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way by Donnie McDermott, per recommendation of County Engineer Mark Nahra. Carried 4-0. Copy filed.
Motion by Monson second by Tripp to approve plans for Project Number FM-CO97(116)—55-97, RCB Culvert Project on K-64 in Section 33-88-45, per recommendation of County Engineer Mark Nahra. Carried 4-0.
Bid opening was held for the improvement of the Hackley Lateral District. The bids were as follows:
Holly A Brown Construction, Anthon, IA $53,596.00
Nelson & Rock, Onawa, IA $47,655.00
Clark Construction, Whiting, IA $44,130.00
Lieber Construction, Lawton, IA $53,600.00
LA Carlson Contracting, Merrill, IA $47,037.50
Motion by Clausen second by Monson to receive the bids for the improvement of the Hackley Lateral District and submit them to the County Engineer for review and recommendation. Carried 4-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
Budget discussion and action for FY 2013.
Motion by Clausen second by Monson to fund the planning and zoning department from local option sales tax proceeds. Motion fails 2-2.
The Board adjourned the regular meeting until February 21, 2012.
