MARCH 15, 2011 — TENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 15, 2011 at 10:00 a.m.  Board members present were Boykin, Clausen, Monson, Smith, and Tripp. Staff members present were:  Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

Motion by Clausen second by Smith to go into closed session per Iowa Code Section 21.5(1)(C).  Carried 4-0 on a roll-call vote.  Tripp abstained.

Motion by Boykin second by Smith to go out of closed sessions per Iowa Code Section 21.5(1)(C).  Carried 4-0 on a roll-call vote.  Trip abstained.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.
 
Motion by Tripp second by Smith to approve the minutes of the March 8, 2011 Board meeting.  Carried 5-0.  Copy  filed.

The Board approved the appointment of Leila McCoy, Case Manager, Social Services, $36,582/year, effective 03-16-2011.    Job Vacancy Posted: 02-02-11.  Entry Level Salary:  $36,582/year.   Copy

Motion by Clausen second by Boykin to approve abatement for the following taxes that are uncollectable or impractical to pursue collection through tax sale of personal judgment, per recommendation of County Treasurer Michael Clayton:

1) Tonys Professional Service Inc, VIN #AC2476, mobile home has been dismantled and junked by the mobile home park.        Taxes total $520.00 plus interest and costs.

Carried 5-0.

Motion by Smith second by Clausen to approve and Authorize the Chairman to sign a Resolution approving suspension of taxes for St. Thomas Episcopal Church, 406 12th St, Sioux City, Parcel #894728112002 and #894728112003.  Carried 4-0; Boykin abstained.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, St. Thomas Episcopal Church is the titleholder of real estate Parcels #894728112002 and #894728112003 located in Woodbury County, Iowa and legally described as follows:

Except Irregular Tract in SE Corner Lot Four (4) & North 6 Ft West 93 Ft Lot Five (5) Block Sixty-four (64)  Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, the abovestated property has taxes owing for the 2010/2011, tax year, and the parcel is owned by St. Thomas Episcopal Church; and

WHEREAS, the organization, namely St. Thomas Episcopal is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates  the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2010/2011 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.
 
SO RESOLVED this 15th day of  March,  2011.

Motion by Tripp second by Boykin to approve a 12-month, Class C liquor license (LC-commercial), with outdoor service and Sunday sales privileges permit renewal for Anthon Golf Cource (Anthon Golf Club, Incorporated), 2236 Hwy 31 South, Anthon, Iowa, effective 04/01/2011 through 03/31/2011.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to appoint Amy Tooley, 3815 War Eagle Drive, Sioux City, to the Community Action Agency of Siouxland Board of Directors.  Carried 5-0.

Motion by Clausen second by Boykin to approve the participation with City of Sioux City in the Submission of the Edward J Byrne Memorial Justice Grant (JAG) Program Application to the Governor’s Office of Drug Control Policy for FY 2011/2012, per recommendation of Greg Logan, Sheriff Dept. and PJ Jennings, County Attorney.  Carried 5-0.  Copy filed.


Motion by Boykin second by Smith to approve and authorize the Chairman to sign a Resolution accepting Whiskey Creek addition-a Minor Subdivision into Woodbury County.  Carried 5-0.

RESOLUTION ACCEPTING AND APPROVING
WHISKEY CREEK ADDITION, A MINOR SUBDIVISION
TO WOODBURY COUNTY, IOWA
 
WHEREAS, THE OWNER AND PROPRIETOR DID ON THE 15TH DAY OF March, 2011, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS WHISKEY CREEK ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA; AND
 
WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND
 
WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND
 
WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.
 
NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF WHISKEY CREEK ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNER AND PROPRIETOR A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

Motion by Boykin second by Tripp to award the bid for metal pipe culverts for Secondary Roads Dept. to Contech Construction Products in the amount of $53,569.62, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to authorize the Chairman to sign an Interdepartmental Agreement with Woodbury County Conservation for Providing snow Removal within Certain County Parks, per recommendation of Mark Nahra, Secondary Roads Dept.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to approve for letting for Secondary Roads Dept. project #FM-CO97(95)—55-97, HMA Resurfacing on 250th and Mason Ave. in Section 22-87-43, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Public Hearing set for 10:15 a.m. for discussion and adoption of FY 2012 County Budget.

James Van Bruggen, Siouxland Tax Research Council, and Jack Burright commented on the budget.

Motion by Smith second by Boykin to close the public hearing.  Carried 5-0

Motion by Clausen second by Boykin to receive the Woodbury County Compensation Board report.  Carried 4-1 Tripp opposed.

Motion by Tripp second by Boykin to increase the projected revenue from the housing of Federal Prisoners by $109,562.00.  Carried 5-0.

Motion by Boykin second by Smith to reduce the allocation to Siouxland District Health by $100,000.00.  Carried   5-0.

Motion by Boykin second by Tripp to adopt the Fiscal year 2011/2012 budget and certify the property tax levy.  Carried 5-0.

Motion by Boykin second by Smith to approve the LeGrand Real Estate Proposal to sell County Property and set a published reserve at $250,000.00.  Carried. 5-0.

Motion by Smith second by Boykin to award the Proximity Reader Door Bid to Electronic Innovations in the amount of $36,977.30 per recommendation of WCICC IT, John Malloy.  Carried 5-0.  Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

The Board adjourned the regular meeting until March 22, 2011.
