JANUARY 18, 2011 — THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Monday, January 18, 2011 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Tripp. Staff members present were: Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
The Board canvassed the Drainage Ditch Elections held on January 15th, 2011.
Motion by Boykin second by Clausen to receive signatures for the canvass of the Garretson Drainage District. Carried 5-0. Copy filed.
The Garretson Drainage District (Sub-District #3) Election was held on 01/15/2011 with the following results:
For the office of Garretson Drainage District Trustee for Sub-District #3 there were two-thousand, three-hundred and forty-four (2,344) ballots cast as follows:
Ron Kerr received Eight-hundred and sixteen (816) votes
Jon Winkel received One-thousand, five-hundred and twenty-eight (1,528) votes
Scattered write-ins received Zero (0) votes
We therefore declare Jon Winkel duly elected to the office of Garretson Drainage District Trustee for Sub-District #3 for a term of Three Years.

The Farmers Drainage District (Sub-District #3) Election was held on 01/15/2011, with the following results:
For the office of Farmers Drainage District Trustee for Sub-District #3 there were five-thousand and sixty-four (5,064) ballots cast as follows:
Fred Johnson received One-thousand, nine-hundred and thirty-nine (1,939) votes
Ron Kerr received Three-thousand, one-hundred and twenty-five (3,125) votes
Scattered write-ins received Zero (0) votes
We therefore declare Ron Kerr duly elected to the office of Farmers Drainage District Trustee for Sub-District #3 for a term of Three Years.
Larry Swanberg, 3301 Jones, Sioux City requested an executive session to discuss his discharge.
Motion by Smith second by Tripp to go into closed session per Iowa Code Section 21.5(1)(a). Carried 5-0 on a roll-call vote.

The Board approved the demotion of Dennis Alioth, Civilian Jailer, County Sheriff Dept., $21.41/hour, -9.5%=-$2.05/hour, effective 01-10-11. Status change, from Jail Sergeant to Master Civilian Jailer. Copy filed.
The Board approved the reclassification of Tammy Casper, Civil Clerk I, County Sheriff Dept., $15.88/hour, 7%=$1.08/hour, effective 01-25-11. Per AFSCME Court House Contract agreement, from Grade 2, Step 4 to Grade 2, Step 5. Copy filed.
The Board approved the Reclassification of Willie Garrett III, Deputy Sheriff, County Sheriff Dept., $23.35/hour, 16%=$3.25/hour, effective 01-28-11. Per CWA Deputy Sheriff Contract agreement, from Class 2 to Class 1. Copy filed.
Motion by Boykin second by Smith to postpone action to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Jail Sergeant , Sheriff Dept. Entry Level: C.W.A. Civilian Officers: $23.46/hour. Carried 4-0; Tripp abstained. Copy filed.

A public hearing was held at 10:15 a.m. for the sale of property parcel #552136 (1530 W. 41st St, Sioux City) to the Larry Roan only for $416.00. The Chairman called on anyone wishing to be heard.
Motion by Smith second by Clausen to close the hearing. Carried 5-0.
Motion by Tripp second by Boykin to approve the sale of this parcel to Larry Roan for the amount of $416.00, plus recording fees, for real estate parcel #552136 (1530 W. 41st St, Sioux City). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

For the following described real estate, To Wit:

Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

RESOLUTION OF THE BOARD OF SUPERVISORS
CONSTRUCTION EVALUATION RESOLUTION
RESOLUTION #10,745
WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2011 and January 31, 2012 and submit an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).
