SEPTEMBER 21, 2010—THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 21, 2010 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
The meeting was called to order.
Motion by Monson second by Clausen to approve the minutes of the September 14, 2010 Board meeting. Carried 5-0. Copy filed.
The Board approved the Reclassification of Amy Klocke, Assistant County Attorney, County Attorney Dept., $73,242/year, effective 10-02-10, Per AFSCME Asst. Attorney Contract agreement, from Step 8 to Step 9. Copy filed.
The Board approved the Reclassification of Diane, Robinson, Clerk/Secretary II, Social Services Dept., $13.57/hour, effective 10-08-10, per Wage Plan comparability with AFSCME Court House Contract @ FY 09/10 rate, from Grade 3, Step 1 to Grade 3, Step 2.
Motion by Clausen second by Smith to approve renewal of a 1-year Class C beer permit with Sunday sales privileges for Chet’s Moville Market, 759 Frontage Road, Moville, Iowa. Carried 5-0. Copy filed.
The Board reviewed final platting of Home Port Addition, a minor subdivision, Portion of GIS parcel #874733302009, with John Pylelo.
Motion by Monson second by Walish to approve and authorize the Chairman to sign a Resolution accepting Home Port Addition into Woodbury County. Carried 5-0.

RESOLUTION ACCEPTING AND APPROVING HOME PORT ADDITION - A MINOR
SUBDIVISION TO WOODBURY COUNTY, IOWA.
WHEREAS, THE OWNER AND PROPRIETOR DID ON
THE 29th DAY OF July, 2010, FILE WITH THE WOODBURY
COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS HOME PORT
ADDITION - A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA; AND
WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE
PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF
WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND
WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS
RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND
WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS
RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

Motion by Monson second by Smith to award the bid for Sign Truck Body to Flannegan Western Company, Emmetsburg, Iowa, for the bid amount of $46,215.45, per recommendation of County Engineer Mark Nahra. Carried 5-0
Motion by Walish second by Smith to approve and authorize the Chairman to sign a utility permit for BB Com., Inc., per recommendation of County Engineer, Mark Nahra. Carried 5-0. Copy filed.
A public hearing was held at 10:15 a.m. for the sale of property parcel #004155, (519 W. 2nd St, Sioux City). The Chairman called on anyone wishing to be heard.
Motion by Walish second by Monson to close the hearing. Carried 5-0.
Motion by Walish second by Clausen to approve the bid from Lores Gonzalo in the amount of $1.00, plus recording fees, for real estate parcel #004155 (519 W. 2nd St, Sioux City). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on
the 5th Day of October, 2010 at 10:15 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 5th
Day of October, 2010, immediately following the closing of the public
hearing to Jimmy Reising only per Code of Iowa 331.361
(2).
3. That said Board proposes to sell the said real estate to Jimmy Reising
only for consideration of $102.00 plus recording fees.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Janet B. Nelson, is the titleholder of a property located at 3635 Pierce Street., City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Except East Twenty-two feet (E 22 ft) Lot Twenty-one (21) and Except East Twenty-two feet ( E 22 ft) South Four feet ( S 4 ft) Lot Twenty-two (22) Block One Hundred Twenty-four (124) Peirces Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Janet B. Nelson as titleholder of the aforementioned property have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.
