JULY 20, 2010 — TWENTY-NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

 

The Board of Supervisors met on Tuesday, July 20, 2010 at 9:00 a.m.  Board members present were Boykin, Clausen, Monson, Smith, and Walish.  Staff members present were Heather Satterwhite, Executive Secretary/Public Bidder, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/ Clerk to the Board.

 

The Claims were approved as presented.  Copy filed.

 

The meeting was called to order.

 

Motion by Walish second by Smith to approve the minutes of the July 13, 2010 Board meeting.  Carried 5-0.  Copy filed.

 

Motion by Monson second by Clausen to approve the minutes of the July 12, 2010 Special Board meeting.  Carried 5-0.  Copy filed.

 

The Board approved the separation of Benjamin L. Handke, Temporary Engineering Aide, Secondary Roads Dept., effective 07/16/2010.  End of temporary work.  Copy filed.

 

The Board approved the reclassification of Karla A. Polley, Vital Statistics Clerk II, County Auditor/Recorder Dept., $14.74/hour, effective 7/30/2010.  Per AFSCME Courthouse contract agreement, from Grade 3, Step 2 to Grade 3, Step 3.  Copy filed.

 

The Board approved the reclassification of Izzlee F. Hanson, Custodian, Building Services Dept., $14.11/hour, effective 7/30/2010.  Per AFSCME Courthouse contract agreement, from Grade 1, Step 3 to Grade 1, Step 4.  Copy filed.

 

Motion by Clausen second by Smith to approve and receive for signatures a Resolution naming depositories for the County Conservation Dept.  Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

 

WHEREAS, Gerald Myers, is the titleholder of property located at 2709 Myrtle Street, City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Five (5) & Lot Six (6) Block Six (6) Crescent Park Addition, City of Sioux City, Woodbury County, Iowa

 

WHEREAS, Gerald Myers   as titleholder of the aforementioned property have petitioned the Board of Supervisors for a suspension of taxes pursuant to the  2009 Iowa Code section 427.9, and 

 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

RESOLUTION APPROVING PETITION FOR SUSPENSION

OF TAXES THROUGH THE REDEMPTION PROCESS

 

WHEREAS, Susie D. Welch as joint titleholders of property located at 918 Wright Ave., Sioux City, Woodbury County, Iowa, and legally described as follows:

 

Parcel #894823132003

 

East Forty-one Feet (41 ft) Lots Eleven – Thirteen (11-13) Inclusive Block Seven (7)     Metropolitan Park Addition, City of Sioux City, Woodbury County, Iowa     

 

WHEREAS, Susie D. Welch, as joint titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem this property Parcel #894823132003 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

Motion by Clausen second by Walish to approve abatement of taxes on the following parcels which are uncollectable or impractical to pursue collection on, per recommendation of County Treasurer Bob Knowler:

 

Parcel #894729234002, Louis E. Limoges, for taxes from 1987-1988 through 2009-2010, including special assessments, totaling $820.00 plus interest.

 

Parcel #894729234010, Louis E. Limoges, for taxes from 1988-1989 through 2009-2010, including special assessments totaling $22,905.00 plus interest.

Motion by Monson second by Smith to approve abatement of taxes on the following parcels which are uncollectable or impractical to pursue collection on, per recommendation of County Treasurer Bob Knowler:

Motion by Smith second by Clausen to receive as submitted the auditor’s quarterly report of e-bonds and payroll taxes for the fourth quarter ending 06/30/2010.  Carried 5-0.  Copy filed.

 

Motion by Clausen second by Monson to receive as submitted the sheriff’s statement of unadjudicated condemnation funds being held by the Woodbury County Sheriff’s Office, for the year ending 06/30/2010 and the sheriff’s statement of unadjudicated condemnation funds being held by the Woodbury County Sheriff’s Office in accordance with Section 331.656 of the Code of Iowa, for the year ending 06/30/2010.  Carried 5-0.  Copy filed.

 

Motion by Monson second by Walish to award a contract for a detailed flood study for portions of rural Woodbury County, to Snyder and Associates, Incorporated, with a cost not to exceed $124,800.00, per recommendation of Planning and Zoning Administrator John Pylelo.  Carried 5-0.

 

The Board reviewed a re-zoning application submitted by The Winnebago Tribe of Nebraska, for GIS parcel #894623100001, to be re-zoned from AP (agricultural preservation) to GC (General Commercial), with the Planning and Zoning Administrator.

 

Motion by Walish second by Smith to approve the application and forward it to the Zoning Commission for public hearing and recommendations.  Carried 5-0.

 

The Board reviewed final platting for Cody’s Addition subdivision, GIS parcel #894623300003, with the Planning and Zoning Administrator.

 

Motion by Walish second by Smith to approve the final platting and forward it to the Zoning Commission for public hearing and recommendations.  Carried 5-0.

 

Motion by Monson second by Smith to approve and receive for signatures a Resolution approving the “Investing in Woodbury County” loan program, per recommendation of Rural Economic Development Director Rob Marqusee.  Carried 5-0.

RESOLUTION #10,691

A RESOLUTION APPROVING THE

“INVESTING IN WOODBURY COUNTY” LOAN PROGRAM

 

WHEREAS, in order to facilitate economic development in rural Woodbury County, and in order to offer local solutions to the national economic recession, it is determined that citizens of Woodbury County should have access to low-cost capital in order to either start or expand a business;

 

WHEREAS, there is a need to establish a program to make low-cost loans available to citizens of Woodbury County for the purpose of either starting, or expanding, a business in rural Woodbury County; and

 

WHEREAS, Woodbury County is a duly recognized political subdivision of the State of Iowa acting under the laws of the State of Iowa; and

 

WHEREAS, the Board of Supervisors is the duly elected governing body of Woodbury County, Iowa; and

 

WHEREAS, the Board of Supervisors desires to establish the “Investing in Woodbury County Loan Program” as specified below.

 

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa, as follows:

 

1.   Woodbury County hereby establishes the “Investing in Woodbury      County Loan Program” with the following general provisions.

 

2.   Woodbury County will provide up to $1M in low-interest loans to   citizens of the county to either start, or expand, a business in   rural Woodbury County (within all areas of Woodbury County, except     Sioux City).  The target interest rate of said loans will be two     percent (2%).

 

3.   There will be three different classes of loans made under the program:

 

     a.   A pool of $500,000 is established for the following classification of loans:

 

           i.   “General Secured Business Loans” for up to $50,000 each;

 

           ii.  “Unsecured Micro-Loans” up to $10,000 each;

 

     b.   A pool of $500,000 is established for the following classification of loans:

 

           i.   Secured “Expo-Service Loans”

               These loans are for businesses that service the up-coming Woodbury County Expo Center.  The business must be located within a 10-mile radius of the Woodbury County Fairgrounds.  Expo-Service Loans will not be available until construction begins on the Expo Center.

 

4.   The Siouxland Economic Development Corporation (SEDC), or approved   successor, will provide the administrative services of this loan program.

 

5.   SEDC will make the initial judgment as to whether a specific application for loan is viable or not – SEDC will recommend to      county only loans that SEDC believe to be viable.

 

6.   The Woodbury County Board of Supervisors must approve each loan before the loan can be made to the citizen borrower.

 

7.   The term of the loan to the citizen will be determined on a case- by-case basis.

 

8.   The costs associated with administering the “Investing in Woodbury County Loan Program” will be from the General Fund, or from a Loan Account Fund, to be established by the Board of Supervisors prior to September 1, 2010.

 

9.   The loan program will go into effect as of September 1, 2010.  The specific application process, as well as objective criteria for making loans, will be posted on the www.woodburyiowa.com website on September 1, 2010.

At the request of the candidate, there was a motion by Walish second by Monson to go into Closed Session per Iowa Code 21.5 (i), for a Homeland Security position interview.  Carried 5-0 on a roll-call vote.
