APRIL 6, 2010 — FOURTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 6, 2010 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, and Walish; Smith was absent. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
The meeting was called to order.
Motion by Clausen second by Monson to approve the Board minutes of the March 29, 2010 special meeting as submitted. Carried 4-0. Copy filed.
Motion by Monson second by Walish to approve the Board minutes of the March 30, 2010 meeting as submitted. Carried 4-0. Copy filed.
The Board approved the reclassification of Diane M. Richardson, Assistant County Attorney, County Attorney Dept., $52,888/year, effective 04/30/2010. Per AFSCME Assistant Attorney contract agreement, from Step 2 to Step 3. Copy filed.
The Board approved the reclassification of Brenda L. Sopoci, Part-time Youth Worker, Juvenile Detention Dept., $16.10/hour, effective 04/30/2010. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.
Ed Gilliland, Gallagher Consultants, presented the Board with a health insurance reform act and Wellness Program update.
The Board discussed designating Gene Nitzschke as an authorized representative for the fiscal year 2009-HSGP grant.
Motion by Walish second by Monson to approve the designation of Gene Nitzschke as an authorized representative for the fiscal year 2009-HSGP grant. Carried 4-0.
Motion by Walish second by Clausen to approve and receive for signatures, a Resolution proclaiming April “Sexual Assault Awareness Month”. Carried 4-0.

RESOLUTION NO. 10,652
PROCLAMATION
WHEREAS, sexual violence is a devastating and intolerable crime that continues to escalate in our society and
affects every person in the Siouxland area, either as a survivor or as a family member, significant
other, neighbor, or co-worker of a survivor, and
WHEREAS, Siouxland sexual assault programs, and other professionals joined together as the Tri-State Sexual
Assault Coalition to support each other in their work and to provide the city of Sioux City and its
citizens with a central source of information on sexual violence and,
WHEREAS, THE Council on Sexual Assault and Domestic Violence acknowledges that awareness and
prevention are key to ending this horrendous crimes. It is critical to the welfare of our community
that citizens and systems support the work with their time, financial resources, and efforts to end
this violence, and
WHEREAS, everyone can get involved by taking action towards creating a society where all women, children,
and men live free from sexual violence and exploitation,
WHEREAS, in recognition of the National Sexual Assault Awareness Month overall theme, “Decide to End
Sexual Assault”, we too come forward in a unified commitment of the Siouxland communities to
prevent all forms of sexual violence.
NOW, THEREFORE, the Woodbury County Board of Supervisors, do hereby proclaim the month of April, 2010
as
“SEXUAL ASSAULT AWARENESS MONTH”
In Woodbury County and urge all Siouxland citizens to unite toward the elimination of all forms of sexual violence and encourage them to get involved in creating a society free from sexual violence.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a 28E agreement between Woodbury County and the city of Sioux City, relating to the annexation of Camp High Hopes property, per recommendation of the County Engineer. Carried 4-0. Copy filed.
The Board discussed vehicle related incidents at a property located at 5960 Stone Avenue in Sioux City, with the County Engineer.
Mary Jensen, 5960 Stone Avenue, addressed the Board regarding multiple vehicles colliding into her house.
Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution establishing the 2010 County weed destruction program, per recommendation of the County Engineer. Carried 4-0.

RESOLUTION NO. 10,653
WEED DESTRUCTION ORDER
WHEREAS, it is the responsibility of each of Iowa County’s Board of Supervisors to enforce the provisions of Chapter 317 of the Code of Iowa as amended with regard to the destruction of weeds, and
WHEREAS, under Chapter 317 of the Code of Iowa as amended each county Board of Supervisors must prescribe and order a program of weed destruction to be followed by landowners, tenants, and other persons in possession or control of land, and
WHEREAS, it has been determined by the Woodbury County Board of Supervisors that a program of weed destruction for the year 2010 is necessary,
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that each landowner, tenant or other person in possession or control of private land shall on or before the dates stated below, destroy the below-listed noxious weeds on their land by spraying them with a suitable herbicide in a strength sufficient to kill such weeds.
1. May 24, 2010 - for musk, thistle, sow thistle, bull thistle, leafy spurge, perennial pepper grass, sour dock
perennial, smooth dock perennial, and sheep sorrel perennial.
2. June 1, 2010 - for Canada thistle, Russian knapweed, buckhorn perennial, wild mustard annual, horse nettle,
and teasel biennial.
3. June 7, 2010 - for field bindweed, wild carrot biennial, and quack grass.
4. June 14, 2010 - for butterprint annual, puncture vine annual, and cocklebur annual.
5. July 12, 2010 - for wild sunflower annual and poison hemlock.
6. October 4, 2010 - all thistles in the rosette stage.
BE IT FURTHER RESOLVED AND ORDERED that all weeds on county trunk and local roads and between the fence lines of such roads, whether they be noxious weeds or other weeds, shall be cut or otherwise destroyed, to prevent seed production, by the owner of the land adjoining the road on or before June 21, 2010.
BE IT FURTHER RESOLVED that weeds that are not destroyed in compliance with the above order may be destroyed by the Weed Commissioner, and the costs of destruction by the Weed Commissioner, including the cost of serving notice, plus a penalty of twenty-five percent of total costs shall be assessed against the property upon which the weeds were destroyed, in the case of private lands, or against the adjoining land, in the case of weeds on county roads. Landowners are to contact Weed Commissioner and notify him if there are areas that should not be sprayed with herbicides.

The Board reviewed the final plat for Kuhlmann’s Second Addition, a minor subdivision, GIS Parcels #894635300014 and #864634400024, with Planning and Zoning Administrator, John Pylelo.
Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution approving the final plat of Kuhlmann’s Second Addition. Carried 4-0.

Resolution accepting and approving the Final Plat of Kuhlmann's Second Addition,
an Addition to Woodbury County, Iowa.
Whereas, the Owner & Proprietor did on the 1st Day of March, 2010, file with the Woodbury County Zoning Commission, a certain plat designated as the Final Plat of Kuhlmann's Second Addition, an Addition to Woodbury County, Iowa; and
Whereas, it appears that said plat conforms with all of the provisions of the Code of the State of Iowa and Ordinance of Woodbury County, Iowa, with reference to the filing of same; and
Whereas, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and
Whereas, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.
Now therefore, be, and it is hereby resolved by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the Final Plat of Kuhlmann's Second Addition, Woodbury County, Iowa, be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the Owner and Proprietor a certified copy of this resolution as required by law.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on
the 20th Day of April, 2010 at 10:15 o’clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 20th Day of April, 2010, immediately
following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $500.00 plus recording fees.
4. That this resolution, preceded by the caption "Notice of Property Sale"
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.
