MARCH 16, 2010 — ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 16, 2010 at 9:00 a.m. Board members present were Boykin, Clausen,
Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
The meeting was called to order.
Motion by Monson second by Walish to approve the Board minutes of the March 9, 2010 meeting as submitted. Carried 5-0. Copy filed.
The Board approved the separation of Raymond L. Richtermeier, Equipment Operator, Secondary Roads Dept., effective 04/30/2010. Retirement. Copy filed.
The Board approved the reclassification of Tyler J. Lupkes, Operations Officer, Disaster Services Dept., $13.52/hour, effective 04/07/2010. 6 month probationary salary increase. Copy filed.
The Board approved the reclassification of Loan H. Hensley, Assistant Civil Attorney, County Attorney Dept., $65,344/year, effective 04/16/2010. Per Wage Plan comparability with AFSCME Assistant Attorney contract agreement, from Step 6 to Step 7. Copy filed.
Motion by Walish second by Monson to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” form for an Equipment Operator, Secondary Roads Dept. Entry level: CWA $18.07/hour. Carried 5-0. Copy filed.
Motion by Monson second by Walish to postpone action to approve and authorize the Chairman to sign a Resolution approving tax abatement for Siouxland Habitat for Humanity parcel #894729377001. Carried 5-0.
Motion by Monson second by Walish to approve the reappointment of Ronald Kerr and Leon Koster to the Veteran Affairs Commission, retroactive to June, 2009. Carried 5-0.
Motion by Clausen second by Monson to approve a 12-month Class C (commercial) liquor license for Anthon Golf Course, 2236 Highway 31 South, Anthon, Iowa, to include Sunday sales privileges and outdoor service, effective 04/01/2010 through 03/31/2011. Carried 5-0.
Motion by Clausen second by Walish to approve and receive for signatures, a Resolution proclaiming March 2010 mental retardation awareness month. Carried 5-0.

PROCLAMATION IN SUPPORT OF MENTAL RETARDATION AWARENESS MONTH
WHEREAS mental retardation is a condition which affects more than 7 million Americans and their
families; and
WHEREAS public awareness and education enhance a community’s understanding of the issues
affecting people with mental retardation; and
WHEREAS the month of March has been designated National Mental Retardation Awareness Month,
with more than 120,000 members and 1,000 chapters of the Arc undertaking public
awareness, educational, and fundraising initiatives; and
WHEREAS The Arc of the United States is the nation’s leading volunteer-based organization
advocating for and with people with mental retardation and related developmental
disabilities and their families; and
THEREFORE the Woodbury County Board of Supervisors hereby proclaims March 2010
MENTAL RETARDATION AWARENESS MONTH
in Woodbury County, Iowa, and urges the citizens to give full support to efforts toward enabling people with
mental retardation to live full and productive lives of inclusion in our communities.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

The Board reviewed final platting of Kuhlmann’s Second Addition, minor subdivision, GIS parcels #894635300014 and #894634400024, with Planning and Zoning Administrator John Pylelo.
Motion by Smith second by Clausen to approve the final platting for Kuhlmann’s Second Addition and forward it to the Zoning Commission for review and recommendations. Carried 5-0.
Motion by Smith second by Clausen to award the bid for Secondary Roads Dept. project #L-W09(1)—73-97 (stream stabilization structure) to L. A. Carlson, Merrill, Iowa, in the amount of $98,723.00, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
Motion by Monson second by Smith to approve and authorize the Chairman to sign a Resolution for seasonal embargo of designated roads, per recommendation of the County Engineer. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION #10,643
WHEREAS, the Woodbury County Board of Supervisors believe certain secondary roads in Woodbury County, Iowa which are paved or unpaved, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or permissible weight thereon reduced, and
WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operations of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operations of vehicles weighing in excess of said weight limit are prohibited on said highway.
IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in exhibit “A”, attached thereto and by this reference made part hereof. The effective period of this resolution begins March 16, 2010, until in the judgment of the County Engineer road conditions have improved and the embargo can be removed. The embargo may not be in place beyond June 16, 2010.

A RESOLUTION THANKING AND COMMENDING
RAYMOND L. RICHTERMEIER
FOR HIS SERVICE TO WOODBURY COUNTY
WHEREAS, Raymond L. Richtermeier has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 14 years from January 8th, 1996 to April 30th, 2010; and
WHEREAS, the service given by Raymond L. Richtermeier as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Raymond L. Richtermeier for his fourteen years of service to Woodbury County; and
BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Raymond L. Richtermeier; and
BE IT SO RESOLVED this 16th, day of March 2010.

The Board discussed use of the EMS Fund.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board recessed to tour a piece of property the county has been placed in receivership for.
The Board toured the former Morningside Matney nursing home property.
The Board adjourned the regular meeting until March 23, 2010.
