OCTOBER 6, 2009FORTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 6, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Boykin second by Smith to approve the Board minutes of the 09/29/2009 meeting as submitted. Carried 4-0: Walish abstained. Copy filed.
The Board approved the appointment of Tyler J. Lupkes, Part-time Operations Officer, Disaster Services Dept., $13.11/hour, effective 10/07/2009. Job vacancy posted 07/22/2009. Entry level salary: $13.11/hour. Copy filed.
The Board reviewed a lease agreement for the ICN Room at Trosper-Hoyt Services Building, with James Thompson, Department of Human Services.
Motion by Walish second by Monson to approve and authorize the Chairman to sign a lease agreement, effective 01/01/2010 through 12/31/2010, for the ICN Room at the Trosper-Hoyt Building Services Building. Carried 5-0. Copy filed.
Motion by Boykin second by Walish to approve and authorize the Chairman to sign a Resolution specifying the repayment method by the Conservation Department, of $900,000.00 in general obligation capital loan notes.

RESOLUTION #10,612
SNYDER BEND PARK IMPROVEMENTS FINANCING/REPAYMENT
WHEREAS, the Woodbury County Conservation Board will construct camping cabin units and pave the entrance road into Snyder Bend County Park, Woodbury County, Iowa; and
WHEREAS, the Woodbury County Conservation Board will collect sufficient revenues each year from user fees at various county park facilities over the next ten years; and
WHEREAS, the total estimated cost of the improvements is $900,000; and
WHEREAS, the proposed projects are deemed to have a beneficial economic and tourism impact for Woodbury County; and
WHEREAS, the Woodbury County Board of Supervisors fully supports the proposed improvements at Snyder Bend County Park and possesses necessary financing authority to assist with such a project; and
WHEREAS, the Woodbury County Conservation Board does not have sufficient cash on hand to pay the contractors through completion of the project.
NOW THEREFORE, be it resolved that the Woodbury County Board of Supervisors and the Woodbury County Conservation Board hereto mutually agree that:
1. The Woodbury County Board of Supervisors will provide $900,000 in General Obligation Capital Loan Notes to help finance the project.
2. The Woodbury County Conservation Board agrees to a ten-year repayment schedule of bond principal and interest as developed by bond counsel and the Woodbury County Treasurer to be paid from annual park revenues.

WOODBURY COUNTY BOARD OF SUPERVISORS
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Permit for Use of County Road/Highway Right-of-Way for Overhead and/or Buried Utilities Accommodation submitted by Jay Cooley for Qwest, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a supply contract with Ferrellgas, Incorporated for liquid propane for the 2009-2010 season at the bid price of $1.149/gallon, per recommendation of the County Engineer. Carried 5-0. Copy filed.
A public hearing was held at 10:15 a.m. for the sale of property parcel #245775 (aka 415 16th Street). The Chairman called on anyone wishing to be heard.
Motion by Boykin second by Walish to close the hearing. Carried 5-0.
Motion by Boykin second by Monson to approve the bid received from Sissel Properties LLC in the amount of $575.00, plus recording fees, for property parcel #245775 (aka 415 16th Street). Carried .

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

For the following described real estate, To Wit:

City, Woodbury County, IA (415 16th Street)
Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Boykin second by Walish to receive the bids and award the bid to Scotwood Industries, Incorporated, 12980 Metcalf, Suite 240, Overland Park, KS, per the recommendation of the County Engineer. Carried 5-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Boykin second by Monson to go into closed session per Iowa Code Section 21.5 (1) (c). Carried 5-0 on a roll-call vote.
Motion by Boykin second by Walish to go out of closed session per Iowa Code Section 21.5 (1) (c). Carried 5-0 on a roll-call vote.
Motion by Walish second by Boykin to approve the recommendation of the attorney in the previous executive session. Carried 5-0.
The Board adjourned the regular meeting until October 13, 2009.
