SEPTEMBER 15, 2009THIRTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 15, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Smith second by Monson to approve the Board minutes of the 09/08/2009 meeting as submitted. Carried 5-0. Copy filed.
Motion by Walish second by Smith to approve the Board minutes of the 09/11/2009 special meeting for the School Board election canvass as submitted. Carried 4-0; Boykin abstained. Copy filed.
The Board approved the appointment of David H. Wantland, Sheriffs Reserve Volunteer, County Sheriff Dept.,$1.00/year, effective 04/01/2008. Per Iowa Code 80D.11. Copy filed.
The Board approved the appointment of April A. Allen, Civilian Jailer, County Sheriff Dept., $16.16/hour, effective 09/18/2009. Job vacancy posted 07/22/2009. Entry level salary: $16.16/hour. Copy filed.
Motion by Boykin second by Walish to approve and authorize the Chairman to sign a Resolution setting the sale date for property parcel #134520 (4117 Adams Street). Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Out Lot A, Except N. 133 Ft., Replat of Days Addition, City of Sioux City, Woodbury County, IA
(4117 Adams St.)
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 29th Day of September, 2009 at 10:15 oclock a.m . in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 29th Day of September, 2009, immediately following the closing of the public hearing to Martin Palomino only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Martin Palomino only for consideration of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

RESOLUTION APPROVING ABATEMENT OF TAXES
WHEREAS, Siouxland Residential Services, Inc. is the titleholder of real estate Parcel #894721313006, located in Woodbury County, Iowa and legally described as follows:
Parcel #246825
West Forty-eight (W 48 ft.) Lot One (1) block Seventeen (17) Higmans 2nd Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, the above stated property has taxes payable for 2009/2010, and the parcel is owned by Siouxland Residential Services, Inc. and
WHEREAS, the value placed on the above-stated property is incorrect; and
WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 427.8 for the taxes owed for the 2009-2010 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Walish second by Smith to approve and authorize the Chairman to sign award documents for receipt of the 2009 Justice Assistance Grant, per recommendation of Patty Erickson-Puttmann, Social Services Coordinator. Carried 5-0.
Motion by Boykin second by Walish to approve and authorize the Chairman to sign a change order for the Siouxland District Health Department roof replacement project, per recommendation of Fran Sadden, Director of Siouxland District Health. Carried 5-0. Copy filed.
Motion by Monson second by Boykin to award the purchase of LP gas for sheds, to Ferrel Gas in the amount of $42,513.00, per recommendation of the County Engineer. Carried 5-0.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign the re-application of the fiscal year 2010 Detention-Reform/Juvenile Detention Alternatives Initiative grant project, per recommendation of David Gleiser, Juvenile Detention. Carried 5-0. Copy filed.
Motion by Smith second by Monson to approve and authorize the Chairman to sign a Permit for Use of County Road/Highway Right-of-Way for Overhead and/or Buried Utilities Accommodation submitted by High Tech Electric LLC for a telephone drop installation, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
Motion by Boykin second by Walish to award the I-Jobs funded asphalt patching project to Western Engineering Company in the amount of $133,645.75, per recommendation of the County Engineer. Carried 5-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Mark Elgert approached the Board about payment for a lift in the old Eagles Building where voting equipment is stored. County Auditor Pat Gill voiced concerns about the safety of the lift for county employees.
The Board adjourned the regular meeting until September 22, 2009.
