JULY 28, 2009THIRTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 28, 2009 at 9:00 a.m. Board members present were Boykin, Monson, Smith, and Walish; Clausen was absent. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Jean Jessen, Deputy/Clerk to the Board.
Mark Monson was appointed Chairman Pro Tem.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Smith second by Walish to approve the Board minutes of the 07/21/2009 meeting as submitted. Carried 4-0. Copy filed.
The Board approved the reclassification of Chad L. Heckert, Senior Civilian Jailer, County Sheriff Dept., $19.38/hour, effective 08/06/2009. Per DSDOA/CWA contract agreement, from Class 1 to Senior Class, 6 years employment and A.A.S. Degree. Copy filed.
The Board approved the reclassification of Jesse J. Lieber, Part-time Youth Worker, Juvenile Detention Dept., $15.56/hour, effective 08/06/2009. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.
The Board approved the reclassification of Donald C. Stevenson, Maintenance Worker, Building Services Dept., $12.84/hour, effective 08/13/2009. Per AFSCME Courthouse contract agreement, from Grade 2, Step 1 to Grade 2, Step 2. Copy filed.
The Board approved the reclassification of Samson Harris, Custodian, Building Services Dept., $12.84/hour, effective 08/14/2009. Per AFSCME Courthouse contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.
The Board approved the reclassification of David A. Dawson, Assistant County Attorney, County Attorney Dept., $72,966/year, effective 08/19/2009. Per AFSCME Assistant County Attorney contract agreement, from Step 9 to Step 10. Copy filed.
Motion by Boykin second by Walish to receive as submitted the County Recorders Report of Fees Collected for the period of 04/01/2009 through 06/03/2009. Carried 4-0. Copy filed.
The Board discussed the 2009 County Assessor homestead and military tax credits with Dennis Butler, County Budget/Tax Analyst.
Motion by Boykin second by Walish to approve as submitted the 2009 County Assessor homestead and military tax credits. Carried 4-0.
Motion by Boykin second by Smith to approve and authorize the Chairman to sign a Resolution setting the public hearing date for the sale of real estate property parcel #534825 (1635 S. Fairmount Street) for 08/10/2009 at 10:15 a.m.., as a direct sale. Carried 4-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Lot Six (6) Block Forty-Two (20) West Morningside Addition, City of Sioux City, Woodbury County, Iowa
(1635 S. Fairmount)
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 11th Day of August, 2009 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 11th Day of August, 2009, immediately following the closing of the public hearing to Jaime and Iran Ortega only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Jaime and Iran Ortega only for consideration of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Walish second by Smith to approve and authorize the Chairman to sign a Memorandum of Understanding between Woodbury County, Siouxland Human Investment Partnership, and Juvenile Court Services, for partial funding for at-risk children, per recommendation of Gary Niles and Doug Noble, Juvenile Court Services. Carried 3-0; Boykin abstained. Copy filed.
Motion by Smith second by Boykin to approve the release of employee payments, as discussed in a previous executive session. Carried 4-0.
The Board discussed a bid received from Prime Coat Coating Systems for shower repair, with County Sheriff Glenn Parrett.
Motion by Boykin second by Smith to approve the shower repair contract with Prime Coat Coating Systems. Carried 4-0. Copy filed.
Motion by Walish second by Boykin to fund the repairs with $40,000.00 from the SCAAP fund, and $19,360.00 from the capital loan note funding. Carried 4-0.
A public hearing was held for the vacation of a portion of 280th Street. The Chairman called on anyone wishing to be heard.
Colleen Savage addressed the Board concerning the street vacation.
Motion by Smith second by Boykin to close the public hearing. Carried 4-0.
Motion by Boykin second by Smith to approve and receive for signatures a Resolution closing and vacating a portion of 280th Street. Carried 4-0.
RESOLUTION NO. 10,590
WOODBURY COUNTY, IOWA
A RESOLUTION CLOSING AND VACATING A ROAD RIGHT OF WAY
WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa) 2007, as amended, on July 7, 2009 held a public hearing on the proposed vacation of Woodbury County Secondary Road Right-Of-Way described as follows:
A portion of 250th Street established as Road No. 898 lying on the south line of section 18, T87N, R44W and north line of section 19, T87N, R44W, Grant Township of the 5th P.M. Woodbury County, Iowa. The area to be vacated is the entire portion of roadway laying either side of the section line of the existing 40 roadway.
WHEREAS, no objections were received in either writing or by persons present.
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that all interest in the subject section of road right-of-way be vacated, subject to utility easements of record for ingress and egress.

Woodbury County, Iowa. The area to be vacated is the entire portion of roadway laying either side of the section line of the existing 66 roadway.
WHEREAS, no objections were received in either writing or by persons present.
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that all interest in the subject section of road right-of-way be vacated, subject to utility Easements of record for ingress and egress.
