MAY 26, 2009TWENTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 26, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Smith to approve the Board minutes of the 05/19/2009 meeting as submitted. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign a purchase agreement in the amount of $275,000.00 for acquisition of a building located at 759 Frontage Road East, Moville, from M and S Realty, per recommendation of the County Engineer, Mark Nahra. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a contract and bond for project #BROS-CO97(92), D54 bridge replacement over Wolf Creek, per recommendation of the County Engineer. Carried 5-0. Copy filed.

The Board reviewed quotes received for two new motor graders for fiscal year 2010. The quotes were as follows:

Murphy Tractor and Equipment Company, Sioux City, Iowa:
District #5 Hornick: $166,884.00
District #2 Moville: $174,884.00

Ziegler, Incorporated, Sioux City, Iowa:
District #5 Hornick: $161,900.00
District #2 Moville: $171,900.00

Motion by Walish second by Smith to award the purchase to Ziegler, Incorporated, Sioux City, Iowa in the amount of $161,900.00 for District #5 Hornick and $171,900.00 for District #2 Moville. Carried 5-0.

The Board reviewed proposals received for repairs to the Little Sioux River levee at Smithland. Quotations received were as follows:

LA Carlson Contracting, Incorporated: $325,056.40
Peterson Contractors, Incorporated: $248,293.00

Motion by Monson second by Walish to approve and authorize the chairman to sign an agreement with Peterson Contractors, Incorporated to repair the levee over the Little Sioux River at Smithland, for the quoted amount of $248,293.00, per recommendation of the County Engineer to be funded from general fund reserves. Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of property parcels #149145 and #147555 (aka 972 and 991 Cornelia Street). The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Walish to close the hearing. Carried 5-0.

Motion by Boykin second by Smith to award the sale to Rex Williams in the amount of $400.00, plus recording fees, for property parcels #149145 and #147555 (aka 972 and 991 Cornelia Street). Carried 5-0.

RESOLUTION #10,562

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By REX WILLIAMS_in the sum of FOUR HUNDRED & 00/100 ($400.00)---------------------------------------dollars.
For the following described real estate, To Wit:

Parcel #149145 & 147555
Lots Fifty-two (52) & Fifty-three (53) Block Seven (7) and Lots One (1) and Two (2) Block Six (6)
Eden Park Addition, City of Sioux City, Woodbury County, Iowa
(972 & 991 N. Cornelia)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Walish second by Smith to approve and authorize the Chairman to sign a Resolution authorizing tax suspension for Pamela Susan Crabb-Conway, 2504 W. 14th Street, Sioux City, Iowa. Carried 5-0.

RESOLUTION #10,563
RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Pamela Susan Crabb-Conway, is the titleholder of property located at 2504 W. 14th St., City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 894730181006

Lots Ten & Eleven (10 & 11) Block Seven (7) Highland 3 Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Pamela Susan Crabb-Conway as titleholder of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Smith second by Monson to approve and receive for signatures a one year Class C liquor license renewal for Theos, Incorporated, 1911 Highway 20 East, Lawton, Iowa, effective 07/01/2009 through 06/30/2010. Carried 5-0. Copy filed.

Motion by Monson second by Walish to receive as submitted, the County Recorders Report of Fees Collected report for the period of 10/01/2008 through 12/31/2008 and the County Recorders Report of Fees Collected report for the period of 01/01/2009 through 03/31/2009. Carried 5-0. Copy filed.

The Board discussed financial planning for current and potential projects with Dennis Butler, County Budget/Tax Analyst.

A public hearing was held at 10:30 a.m. for budget amendment #1 for the Countys fiscal year 2009 budget. The Chairman called on anyone wishing to be heard.

Motion by Monson second by Walish to close the hearing. Carried 5-0.

Motion by Walish second by Smith to approve and authorize the chairman to sign budget amendment #1 for the Countys fiscal year 2009 budget. Carried 5-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until June 2, 2009.
