APRIL 7, 2009FIFTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 7, 2009 at 9:00 a.m. Board members present were Boykin, Monson, Smith, Walish, and Clausen. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel and Jean Jessen, Deputy/Clerk to the Board.

Board of Supervisors meeting was called to order.
Motion by Walish second by Monson to approve the Board minutes of the March 31, 2009 meeting as submitted. Carried 5-0. Copy filed.
The Board approved the separation of Marvin E. Flewelling, Temporary Equipment Operator, Secondary Roads Dept., effective 03/27/2009. End of temporary work. Copy filed.
The Board approved the appointment of Diane I. Robinson, Clerk/Secretary II, Social Services Dept., $12.56/hour, effective 04/08/2009. Job vacancy posted 02/17/2009. Entry level salary $12.56/hour. Copy filed.
The Board approved the appointment of Heather K. Satterwhite, Part-time Executive Secretary/Public Bidder, Board Administration, $15.21/hour, effective 04/21/2009. Job vacancy posted 12/17/2008 and reopened 02/18/2009. Entry level salary $15.21/hour. Copy filed.
The Board approved the reclassification of Kari R. Rosburg, Civilian Jailer, County Sheriff Dept., $16.12/hour, effective 04/22/2009. Per DSDOA contract agreement, from Class 3 to Class 2. Copy filed.
The Board approved the reclassification of Diane M. Richardson, Assistant County Attorney, County Attorney Dept., $48,765/year, effective 04/30/2009. Per AFSCME Assistant County Attorney contract agreement, from Step 1 to Step 2. Copy filed.
Motion by Monson second by Boykin to receive as submitted the Auditors Quarterly Report for E-Bonds and Payroll Taxes for the third quarter ending 03/31/2009. Carried 5-0. Copy filed.
Margaret Sanders gave a presentation to the Board on Sexual Assault Awareness.
Motion by Boykin second by Smith to approve and receive for signatures a Resolution proclaiming April, 2009 as Sexual Assault Awareness Month. Carried 5-0.

PROCLAMATION
WHEREAS, sexual violence is a devastating and intolerable crime that continues to escalate in our society and affects every person in the Siouxland area either as a survivor or as a family, member, significant other, neighbor, or co-worker of a survivor, and
WHEREAS, Siouxland sexual assault programs, other professionals and supporters joined together as the Tri-State Sexual Assault Coalition to support each other in their work and to provide the county of Woodbury and its citizens with a central source of information on sexual violence, and
WHEREAS, the Council on Sexual Assault and Domestic Violence acknowledges that awareness and prevention are key to ending this horrendous crime. It is critical to the welfare of our communities that citizens and systems support the work with their time, financial resources, and efforts to end this violence, and
WHEREAS, 'Respect Works' and everyone can help make a difference by modeling respect and equality and work towards a society where all women, children, and men live in a society free from violence and exploitation,
WHEREAS, in recognition of the National Sexual Assault Awareness Month theme 'Prevent Sexual Violence' we too come forward in a unified commitment of the Siouxland communities to prevent all forms of sexual violence.
NOW, THEREFORE, the Woodbury County Board of Supervisors, do hereby proclaim the month of April 2009 as
'SEXUAL ASSAULT AWARENESS MONTH'
in Woodbury County and urge all Siouxland citizens to unite toward the elimination of all forms of sexual violence and encourage them to model respect in their relationships.

Motion by Walish second by Boykin to approve submission of a federal assistance application for the Federal assistance COPS Hiring Recovery Program (CHRP), per recommendation of County Sheriff Glenn Parrett. Carried 5-0. Copy filed.
Motion by Walish second by Boykin to approve funding position(s) gained by grant at the conclusion of grant funds. Carried 5-0.
Motion by Walish second by Boykin to approve Patty Erickson-Puttmann submitting the application electronically, and administering the grant on behalf of Woodbury County. Carried 5-0.
The Board discussed issuance of County Essential Purpose Bonds with County Treasurer Bob Knowler, and Budget/Tax Analyst Dennis Butler.
Motion by Smith second by Monson to approve proceeding with the issuance of County Essential Purpose Bonds in the amount of $500,000. Carried 5-0.
Motion by Boykin second by Walish to approve proceeding with the issuance of County Essential Purpose Bonds in the amount of $900,000, to be paid for through County Park fees. Carried 5-0.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a performance bond for Hallett Materials for projects #G-2009 and #G-2009A, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.
The Board discussed funding for Siouxland Honor Flight with Cathy Mueller.
Motion by Walish second by Boykin to approve funding Siouxland Honor Flight utilizing local option sales tax funds. Motion failed 2-3, Walish and Boykin voting aye.
Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution adopting and levying a special assessment of 42% of the original assessment value in the Little Sioux Inter-County Drainage District of Monona, Woodbury, and Harrison Counties. Carried 5-0.

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE LITTLE SIOUX INTER-COUNTY DRAINAGE DISTRICT
WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 12th day of March, 2009, requested that the Board of Supervisors levy a special assessment of Forty-two (42%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.
NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-two (42%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2009-2010.
PASSED and APPROVED this 7th day of April, 2009.

IN THE MCCANDLESS INTERCOUNTY DRAINAGE DISTRICT
WHEREAS, the Board of Trustees of the McCandless Inter-County Drainage District, in session on the 18th day of February, 2009, requested that the Board of Supervisors levy a special assessment of Eighty Percent (80%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.
NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the McCandless Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of eighty percent (80%) of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2009-2010.

WHEREAS, the Board of Trustees of the Sandhill-Lakeport Inter-County Drainage District, in session on the 9th day of March, 2009, requested that the Board of Supervisors levy a special assessment of Twenty-One (21%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Boykin second by Walish to go into closed session per Iowa Code Section 21.5 (1) (c). Carried 5-0 on a roll-call vote.
Motion by Walish second by Boykin to go out of closed session per Iowa Code Section 21.5 (1) (c). Carried 5-0 on a roll-call vote.
Motion by Walish second by Boykin to accept the recommendation discussed in the closed session. Carried 5-0.
The Board adjourned the regular meeting until April 14, 2009.
