MARCH 17, 2009TWELFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 17, 2009 at 9:00 a.m. Board members present were Boykin, Monson, Smith, and Walish; Clausen was absent. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Diane Swoboda Peterson, Deputy/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Smith second by Walish to approve the Board minutes of the March 10, 2009 meeting as submitted. Carried 4-0. Copy filed.
Motion by Walish second by Smith to approve the minutes of the Siouxland Mental Health meeting held on 02/17/2009. Carried 4-0. Copy filed.
The Board approved the reclassification of Sheila F. Grasz, Motor Vehicle Clerk II, County Treasurer Dept., $13.79/hour, effective 07/01/2008. Per AFSCME Court House contract agreement, from Grade 3, Step 2 to Grade 3, Step 3. Retro-pay due from 07/01/2008=$801.92. Copy filed.
The Board approved the reclassification of Loan H. Hensley, Assistant County Attorney (Civil), County Attorney Dept., $58,606/year, effective 04/16/2009. Per Wage Plan comparability with AFSCME Assistant Attorney contract agreement. Copy filed.
The Board approved the reclassification of Levi L. Harry, Civilian Jailer, County Sheriff Dept., $16.77/hour, effective 04/18/2009. Per DSDOA contract agreement, from Class 2 to Class 1. Copy filed.
Motion by Boykin second by Walish to approve a Class A liquor license application for White Horse Patrol Club, 1869 Old Highway 141, Sergeant Bluff, IA, to include Sunday Sales, effective 04/05/2009 through 04/04/2010. Carried 4-0. Copy filed.
Motion by Boykin second by Smith to approve and authorize the Chairman to sign a contract between Woodbury County and Thomas J. Carroll, MD, Woodbury County Medical Examiner, specifying Examiner services and fees to be provided for a term of two years, commencing 01/01/2009. Carried 4-0. Copy filed.
Motion by Boykin second by Walish to approve and authorize the Chairman to sign a lease issued to Western Slopes Farm for leasing the County Farm until 12/01/2011. Carried 4-0. Copy filed.
Motion by Boykin second by Walish to receive a petition submitted by Gerald R. Day and Karen H. Day, requesting rezoning of parcel #894617300002, from agricultural preservation to agricultural estates, and forward it to the Zoning Commission for review and recommendations. Carried 4-0. Copy filed.
The Board discussed a draft of security door policies and procedures presented by Court Administrator Leesa McNeil.
Motion by Boykin second by Smith to approve implementing the security door policies and procedures as outlined. Carried 4-0. Copy filed.
A public hearing was held at 10:15 a.m. for parcels #427020 and #427035 (1673 and 1667 W. Lunah Avenue). The Chairman called on anyone wishing to be heard.
Motion by Boykin second by Walish to close the hearing. Carried 4-0.
Motion by Boykin second by Walish to accept the bid from Eric Stolpe in the amount of $1.00, plus recording fees, for property parcels #427020 and #427035. Carried 4-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Lots Four (4) and Five (5) Block Twenty (20) Riverview 2nd Addition, City of Sioux City, Woodbury County, Iowa

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 31st Day of March, 2009 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 31st Day of March, 2009, immediately following the closing of the public hearing to Martin Wesley only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Martin Wesley only for consideration of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By ERIC AND RHEINOLA STOLPE AS JOINT TENANTS WITH RIGHT OF SURVIVORSHIP AND NOT AS TENANTS IN COMMON in the sum of ONE & 00/100)------------------------------------------------------ dollars.
For the following described real estate, To Wit:

Lot Twenty-Eight (28) and Lot Twenty-Nine (29) Pleasant View Addition, City of Sioux City,
Woodbury County, Iowa

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Walish second by Smith to approve and authorize the Chairman to sign a contract with Hallett Materials, for maintenance gravel project #G-2009, per recommendation of the County Engineer. Carried 4-0. Copy filed.
Motion by Boykin second by Smith to approve and authorize the Chairman to sign a contract with Hallett Materials, for maintenance de-icing sand project #G-2009A, per recommendation of the County Engineer. Carried 4-0. Copy filed.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Leesa McNeil, Court Administrator, addressed the Board regarding her concern that there is a lack of flexible conference rooms in the Courthouse. She also discussed the Court system closings, due to budgetary concerns, and staff movement during those times.
Mark Nahra, County Engineer, addressed the Board regarding the possible closure of the I-29 Port Neal exit. He also discussed the Smithland levy and a communication he received from Dennis McCall.
Jennifer Cullenward, 1383 220th Street, Sergeant Bluff, addressed the Board. Secondary Roads had a contractor perform work on 220th Street that left her driveway and mailbox damaged. The Board directed her to speak with County Engineer Mark Nahra regarding those issues.
She also stated the City contracted with a third party to dump sludge across the street from her property. The Board stated they will place this issue on the next Board meeting agenda, and directed the Boards Attorney to visit with Planning and Zoning about the zoning plan for the County.
The Board adjourned the regular meeting until March 24, 2009.
