MARCH 10, 2009ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 10, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Boykin second by Walish to approve the Board minutes of the March 3, 2009 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the reclassification of Sage M. Lewis, Civilian Jailer, County Sheriff Dept., $16.12/hour, effective 03/22/2009. Per DSDOA contract agreement, from Class 3 to Class 2. Copy filed.

The Board approved the reclassification of Jorma J. Schwedler, Civilian Jailer, County Sheriff Dept., $16.77/hour, effective 03/22/2009. Per DSDOA contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Jeromy A. Stroman, Civilian Jailer, County Sheriff Dept., $16.77/hour, effective 03/27/2009. Per DSDOA contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Nathan M. Sands, Civilian Jailer, County Sheriff Dept., $18.59/hour, effective 03/27/2009. Per DSDOA contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the reclassification of Cynthia L. Weber-Blair, Assistant County Attorney, County Attorney Dept., $58,606/year, effective 03/30/2009. Per AFSCME Assistant Attorney contract agreement, from Step 5 to Step 6. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for parcel #416940, 2211 Rebecca Street, Sioux City, Iowa, on March 24, 2009 at 10:15 a.m. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Southerly Fifty-five Feet (Sly 55 ft) Lot Ten (10) Block One (1) Pendleton Hill Addition, City of Sioux City, Woodbury County, Iowa

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 24th Day of March, 2009 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 24th Day of March, 2009, immediately following the closing of the public hearing to Adam Albert only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Adam Albert only for consideration of $1.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

1. That a public hearing on the aforesaid proposal shall be held on the 24th Day of March, 2009 at 10:17 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 24th Day of March, 2009, immediately following the closing of the public hearing to Troy Martinson only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Troy Martinson only for consideration of $1.00 plus recording fees.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 24th Day of March, 2009 at 10:19 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the24th Day of March, 2009, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $500.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

The Board discussed the possibility of Woodbury County participating with the City of Sioux City in the submission of the Byrne/JAG grant application to the Governors Office of Drug Control Policy, with County Sheriff Glenn Parrett and County Attorney PJ Jennings.

Motion by Boykin second by Walish to approve the joint submission of the Byrne/JAG grant application. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign an Iowa Department of Transportation Federal-Aid Highway Stimulus Program agreement for project ESFM-CO97(107)5S-97, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.

Motion by Walish second by Monson to approve and authorize the Chairman to sign an Iowa Department of Transportation Federal-Aid Highway Stimulus Program agreement for project #ESFM-CO97(108)5S-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

The Board discussed the condition of the I-29 Port Neal Road interchange with Zoning and Planning Administrator John Pylelo.

Wayne Johnson, Ag Processing, Incorporated, Linda Hubert Cox, Mayor of Salix, Gerold Smith, Fire Chief of Salix, and Robert Brouilette, 1728 280th Street, Salix, voiced concerns about the possible closure of the Port Neal interchange.

A public hearing was held at 10:30 a.m. for the Fiscal Year 2010 County budget. The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Monson to close the hearing. Carried 5-0.

Motion by Monson second by Walish to approve the Fiscal Year 2010 Woodbury County budget. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until March 17, 2009.
