MARCH 3, 2009TENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 3, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Walish second by Monson to approve the Board minutes of the February 24, 2009 meeting as submitted. Carried 5-0. Copy filed.
Motion by Monson second by Smith to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process for:
Recorder Clerk II, County Auditor/Recorder Dept. Entry level: AFSCME Courthouse, Grade 3: $12.56/hour.
Carried 5-0. Copy filed.
Motion by Boykin second by Walish to approve lifting the tax suspension for Willie J. Ford, 1005 W. 6th Street, Sioux City, IA, as he no longer lives there. Carried 5-0.
Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for parcels #427020 and #427035, on March 17, 2009 at 10:15 a.m. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Lot Twenty-eight (28) & Lot Twenty-nine (29) Pleasant View Addition, City of Sioux City, Woodbury County, Iowa
(1673 & 1667 W. Lunah Ave.)
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 17th Day of March, 2009 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 17th Day of March, 2009, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

For the tax balance of $20.00, plus interest. Carried 5-0.
Motion by Boykin second by Walish to receive the appointment of Maurice Wilt, 2843 Dallas Avenue, Salix, IA, for the office of Sloan Township Trustee, to fill a vacancy until the 2010 General Election, filling the office previously held by Randy Hunt. Carried 5-0.
Motion by Walish second by Boykin to receive the appointment of Wallace Sorenson, 100 Cedar Street, Lawton, IA, for the office of Banner Township Trustee, to fill a vacancy until the 2010 General Election. Carried 5-0.
Bid opening was held at 10:05 a.m. for Social Services Office remodeling project. The bids were as follows:
Frank Audino Construction: $95,548.00
HW Design Build: $89,935.00
HCI Construction: $122,000.00
Holtze Construction Company: $85,250.00
L & L Builders: $94,180.00
There were no other bids.
Motion by Boykin second by Walish to receive the bids and refer them to Scotney Fenton, RDG Planning and Design, for review and recommendations. Carried 5-0. Copy filed.
Motion by Walish second by Boykin to approve and receive for signatures, a Resolution proclaiming March 2009 Mental Retardation Awareness Month. Carried 5-0.

RESOLUTION NO. 10,534
PROCLAMATION
IN SUPPORT OF MENTAL RETARDATION AWARENESS MONTH
WHEREAS mental retardation is a condition which affects more than 7 million Americans and their families; and
WHEREAS public awareness and education enhance a communitys understanding of the issues affecting people with mental retardation; and
WHEREAS the month of March has been designated National Mental Retardation Awareness Month, with more than 120,000 members and 1,000 chapters of the Arc undertaking public awareness, educational, and fundraising initiatives; and
WHEREAS The Arc of the United States is the nations leading volunteer-based organization advocating for and with people with mental retardation and related developmental disabilities and their families; and
THEREFORE the Woodbury County Board of Supervisors hereby proclaims March 2009
MENTAL RETARDATION AWARENESS MONTH
in Woodbury County, Iowa, and urges the citizens to give full support to efforts toward enabling people with mental retardation to live full and productive lives of inclusion in our communities.

RESOLUTION ACCEPTING AND APPROVING FIXSEL ADDITION,
WOODBURY COUNTY, IOWA.
Whereas, the owners and proprietors did on the 30th day of December, 2008, file with the Woodbury County Zoning Commission a certain plat designated as Fixsel Addition, Woodbury County, Iowa; and
Whereas, it appears that said plat conforms with all of the provisions of the code of the State of Iowa and ordinances of Woodbury County, Iowa, with reference to the filing of same; and
Whereas, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and
Whereas, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.
Now therefore, be, and it is hereby resolved by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the plat of Fixsel Addition, Woodbury County, Iowa, be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the owners and proprietors a certified copy of this resolution as required by law.

The Board reviewed quotations submitted for the repair of a bridge D28 on 120th Street, section 12 of Banner Township, requested under Iowa Code Section 309.40A by County Engineer Mark Nahra. The quotations were as follows:
Kooiker Construction: $22,980
There were no other quotes received.
Motion by Monson second by Boykin to approve the quotation submitted by Kooiker in the amount of $22,980.00, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Walish second by Boykin to approve a contract for Lucas Avenue box culvert project #BROS-CO97(91)8J-97, per recommendation of the County Engineer. Carried 5-0.
The Board discussed Social Services Department office remodeling bids with Patty Erickson-Puttmann, Social Services Coordinator.
Motion by Boykin second by Walish to approve and award the remodeling contract to Holtze Construction in the amount of $85,250.00 per recommendation of Scotney Fenton, RDG Planning and Design, and to allow them to perform the work as a change order to their existing contract. Carried 5-0. Copy filed.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until March 10, 2009.
