DECMBER 9, 2008FORTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, December 9, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Batcheller second by Clausen to approve the Board minutes of the December 2, 2008 meeting as submitted. Carried 5-0. Copy filed.
The Board discussed the purchase of a high speed scanner for the County Election Dept., with Patrick F. Gill, County Auditor/Recorder/Commissioner of Elections.
Motion by Batcheller second by Clausen to approve the purchase of a high speed scanner for the County Election Dept. Carried 5-0.
Motion by Boykin second by Monson to approve using general supplemental reserves for the purchase of a high speed scanner for the County Election Dept. Carried 5-0.
The Board approved the separation of Robert G. Batcheller, effective 12/31/2008. End of Elected Official term. Copy filed.
The Board approved the separation of E. Dean Neal, Deputy Mapping Coordinator, County Auditor/Recorder Dept., effective 12/31/2008. Retirement. Copy filed.
The Board approved the appointment of Mark J. Nahra, County Engineer, effective 01/01/2009, $105,000/year. Hired through H. R. OneSource Consultants. Entry salary: $105,000/year. Copy filed.
The Board reviewed fiscal year 2009-2010 Proposal for Workers Compensation Review and Continuity of Operation reports with J. D. Pellersels, Human Resources Director and Caroline Tompkins, Safety and Risk Coordinator.
Motion by Boykin second by Batcheller to direct the safety committee to issue directives for the accumulation of information to develop and implement a continuity of operations plan. Carried 5-0.
A public hearing was held at 10:15 a.m. for the sale of property parcel #398340 (aka 3252 Court Street). The Chairman called on anyone wishing to be heard.
Motion by Boykin second by Clausen to close the hearing. Carried 5-0.
Motion by Batcheller second by Boykin to approve a directed sale to Lance Webb and Nancy Webb in the amount of $1.00, plus recording fees, for the purchase or property parcel #398340 (aka 3252 Court Street). Carried 5-0.

Motion by Boykin second by Clausen to deny solicitation for insurance services to Woodbury County Employees from any private company as a representative or business partner of Woodbury County without a contractual agreement. Carried 5-0.
Motion by Boykin second by Batcheller to approve making the Wage Plan floating Christmas holiday Friday, 12/26/2008, to coincide with AFSCME employees. Carried 5-0.
Motion by Monson second by Clausen to approve retiring employee Richard J. Storm, remain on the County health and dental insurance plans at his own expense, effective 01/01/2009. Carried 5-0.
Motion by Clausen second by Boykin to approve Board member G. Robert Batcheller, remain on the County dental insurance plan at his own expense, after his term ends 12/31/2008. Carried 4-0; Batcheller abstained.
Motion by Boykin second by Clausen to postpone action to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #389716 (aka 1321 28th Street) on 12/23/2008 at 10:15 a.m.. Carried 5-0.
Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #440385 (aka 1708 Ingleside Avenue) on 12/23/2008 at 10:16 a.m. Carried 5-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 23rd Day of December, 2008 at 10:16 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 23rd Day of December, 2008, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $350.00 plus recording fees.

Motion by Boykin second by Batcheller to approve the appointment of Flora M. Lee, 1608 Casselman Street, Sioux City, IA, to the Civil Service Commission. Carried 5-0.
Motion by Clausen second by Monson to approve rescinding the approved 2008 issuance of bonds for Sunrise Retirement Community. Carried 5-0.
Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign an agreement between Woodbury County and Juvenile Court Services for the 3rd Judicial District, designating Woodbury County Juvenile Court Services as supervisor of Juvenile Court Services GPS electronic monitoring bracelet program. Carried 5-0. Copy filed.
Rob Marqusee, Rural Economic Development Director, announced to the Board that products from Gentle Creek Candy Company will be sold in Hy-Vee Food Markets.
Motion by Clausen second by Boykin to approve and receive for signatures a Resolution thanking and commending County employee Leslie Douglas, Equipment Operator, for his years of service to Woodbury County. Carried 5-0.

WHEREAS, the service given by Leslie R. Douglas as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Leslie R. Douglas for his twelve years of service to Woodbury County; and

The Board discussed the participation of the Secondary Roads Dept. in the Little Sioux Park parcel purchase.
Motion by Boykin second by Batcheller to approve Secondary Roads Dept. participation in the Little Sioux Park parcel purchase, for use in recovering sand, by reimbursing the Conservation Dept. with $15,000 initially, with additional reimbursements not to exceed 50% of the original purchase price, plus 3% interest per year, on sand material produced in the future. Carried 5-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until December 16, 2008.
