DECMBER 2, 2008FORTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, December 2, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Clausen to approve the Board minutes of the November 12, 2008 meeting as submitted. Carried 4-0; Batcheller abstained. Copy filed.

Motion by Batcheller second by Monson to approve the Board minutes of the November 24, 2008 meeting as submitted. Carried 4-0; Boykin abstained. Copy filed.

Motion by Clausen second by Monson to approve the Board minutes of the November 25, 2008 meeting as submitted. Carried 4-0; Boykin abstained. Copy filed.

The Board approved the reclassification of Scott N. Muggenberg, Full-time Youth Worker, $18.25/hour, effective 12/21/2008. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

The Board discussed the architects recommendation on the bids for the courthouse skylights project with Patty Erickson-Puttmann, Social Services Director.

Motion by Batcheller second by Boykin to receive the recommendation as submitted and award the bid to Holtze Construction for the bid amount of $312,900.00. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to use Local Option Sales Tax funds to fund the project. Carried 5-0.

The Board discussed a funding request for a Little Sioux Park addition with Rick Schneider, Woodbury County Conservation Director.

A public hearing was held at 10:15 a.m. for the sale of property parcel #369525 (aka 2111 West Street). The Chairman called on anyone wishing to be heard.

Motion by Batcheller second by Clausen to close the hearing. Carried 5-0.

Motion by Batcheller second by Monson to approve a directed sale to Jose Ramon and Rosalba M. Topete in the amount of $1.00, plus recording fees, for the purchase or property parcel #369525 (aka 2111 West Street). Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS

RESOLUTION #10,516

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By JOSE RAMON TOPETE AND ROSALBA M. TOPETE, AS JOINT TENANTS WITH RIGHT OF SURVIVORSHIP AND NOT AS TENANTS IN COMMON in the sum of ONE & 00/100 ($1.00)------------ dollars.

For the following described real estate, To Wit:

Parcel #369525
Lot 1 and S. 1/2 Vacated W. 22nd St. and E. 1/2 Vacated Alley Adjacent to Lot 1,

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Boykin second by Monson to postpone action to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #440385 (aka 1708 Ingleside Avenue) on 12/16/2008 at 10:15 a.m.. Carried 5-0.

The Board discussed the bids for the County Farm lease received at the Board meeting of 11/25/2008.

Motion by Batcheller second by Monson to award the bid to the highest bidder, Western Slopes Farm (Frank Welte II), in the bid amount of $267.00 per acre. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to award the bid for project #L-C07)8)73-97 to LA Carlson Contracting, Merrill, IA for the bid amount of $77,918.55, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the chairman to sign an amendment to the agreement between Woodbury County and NRCS for project #L-C07(8)73-97, to extend the time needed to award a contract from the original 90 days to 180 days. Carried 5-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until December 9, 2008.
