OCTOBER 14, 2008FORTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 14, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Jean Jessen, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Clausen to approve the Board minutes of the October 7, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the reclassification of Michael A. Gray, District Foreman, Secondary Roads Dept., $56,224/year, effective 11/03/2008. Per Wage Plan Matrix 6 year level. Copy filed.

The Board approved the reclassification of Jason L. Petersen, Equipment Operator, Secondary Roads Dept., $17.91/hour, effective 11/12/2008. Per CWA contract agreement, end of probation salary increase. Copy filed.

Motion by Clausen second by Monson to receive as submitted the Auditors Quarterly E-Bonds and Payroll Taxes Report for the first quarter ending 09/30/2008. Carried 5-0. Copy filed.

The Board was addressed by Liz Shermerhorn, Juvenile Detention, and Kathy Heibel, Building Services, regarding County funding for United Way campaign costs.

Motion by Batcheller second by Monson to approve funding the United Way campaign costs in the amount of $700.00 from Riverboat funds. Carried 5-0.

Motion by Boykin second by Batcheller to receive the Annual Conservation Department Report as submitted by Rick Schneider, Woodbury County Conservation Director. Carried 5-0. Copy filed.

A public hearing was held at 10:15 a.m. for the sale of property parcel #263220 (aka 2003 W. 2nd St.). The Chairman called on anyone wishing to be heard.

Motion by Batcheller second by Clausen to close the hearing. Carried 5-0.

Motion by Batcheller second by Monson to accept the bid from Miguel Hernandez and Ochoa Hernandez, in the amount of $1.00, plus recording fees, for the purchase of property parcel #263220 (aka 2003 W. 2nd St.). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By MIGUEL HERNANDEZ AND OCHOA GRESELDA HERNANDEZ , AS JOINT TENANTS WITH RIGHT OF SURVIVORSHIP AND NOT AS TENANTS IN COMMON in the sum of ONE & 00/100 ($1.00)--------------- dollars.

2. That said Board proposes to sell the said parcel of real estate on the 28th Day of October, 2008, immediately following the closing of the public hearing to Gary Trost only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Gary Trost only for consideration of $1.00 plus recording fees.

Motion by Clausen second by Boykin to approve rescinding the property sale on 10/07/2008 of property parcel #299880, as the bidder did not make the required purchase payment. Carried 5-0.

Motion by Clausen second by Batcheller to postpone for one week for explanation, approving a Resolution approving tax abatement for the City of Sioux City for property parcel #874801400003, Liberty Township, for the balance of taxes due of $7,154.63. Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution authorizing the suspension of taxes for Barbara Springer, 2130 Metropolitan Avenue. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Barbara Springer, is the titleholder of property located at 2130 Metropolitan Ave, City of Sioux City,
Woodbury County, Iowa, and legally described as follows:

Parcel 345990

Lot Thirteen (13) Block Thirteen (13) Metropolitan Park Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Barbara Springer as titleholder of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County R. E. C., to install an underground electrical distribution line along a section of Barker Avenue, per recommendation of County Engineer Richard Storm. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County R. E. C. to install an underground electrical distribution line along a section of 250th Avenue, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve plans as submitted for project #BROS-CO97(91)8J-97, per recommendation of the County Engineer. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Batcheller second by Clausen to go into closed session per Iowa Code 21.5(1)(c). Carried 5-0 on a roll-call vote.

Motion by Clausen second by Monson to go out of closed session per Iowa Code 21.5(1)(c). Carried 5-0 on a roll-call vote.

The Board adjourned the regular meeting until October 21, 2008.
