SEPTEMBER 23, 2008THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 23, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen and Monson; Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Batcheller second by Monson to approve the Board minutes of the September 16, 2008 meeting as submitted. Carried 4-0. Copy filed.
The Board approved the separation of Nicholas J. Kellen, Part-time Youth Worker, Juvenile Detention Dept., effective 09/14/2008. Resignation. Copy filed.
The Board approved the reclassification of Amy L. Ellis, Assistant County Attorney, County Attorney Dept., $63,287year, effective 10/02/2008. Per AFSCME Assistant County Attorney contract agreement, from Step 6 to Step 7. Copy filed.
The Board approved the reclassification of Francisco J. Gonzalez, Civilian Jailer, County Sheriff Dept., $20.54/hour, effective 10/04/2008. Per DSDOA contract agreement, from Senior to Master Class. Copy filed.
The Board approved the reclassification of Jason C. Kurtz, Full-time Youth Worker, Juvenile Detention Dept., $18.25/hour, effective 10/12/2008. Per AFSCME J.D. contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Part-time Male Youth Worker, Juvenile Detention Dept. Entry level AFSCME J. D. $14.50/hour. Carried 4-0. Copy filed.
Motion by Monson second by Batcheller to approve lifting the tax suspension for Katherine Kopsas, 1213 Iowa Street, as the property has been foreclosed. Carried 4-0.
Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #299880 (2012 Jennings Street). Carried 4-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 7th Day of October, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 7th Day of October, 2008, immediately following the closing of the public hearing to Clarence C. Erichsen and Candus Marie Erichsen only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Clarence C. Erichsen and Candus Marie Erichsen only for consideration of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 7th Day of October, 2008, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $1.00 plus recording fees.

Motion by Batcheller second by Boykin to approve and authorize DeWild, Grant, Reckert, and Associates Company to develop specifications and a cost estimate to run a water supply line to the Prairie Hills Facility. Carried 4-0.
Motion by Batcheller second by Boykin to receive and approve plans for project #L-G06(2)73-97 per recommendation of County Engineer Richard Storm. Carried 4-0.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a proposal for engineering services with HGM Associates, Incorporated, Omaha, NE, for bridge replacement on County Route D-38. Carried 4-0. Copy filed.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a proposal for architectural/engineering services with Cannon, Moss, Brygger Associates, Spencer, IA, per recommendation of the County Engineer. Failed 2-2, Boykin and Clausen opposed.
Motion by Monson second by Batcheller to postpone action to approve and authorize the Chairman to sign a proposal for Geotechnical Exploration Services with Certified Testing Services, Inc., Sioux City, IA, to do soil borings at the site of the proposed Moville facility, per recommendation of the County Engineer. Carried 4-0. Copy filed.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a supplemental contract for services with Riley Simpson (Flat Earth Planning), to provide up to 200 hours of additional services over the next 10 month period, per recommendation of Planning and Zoning Administrator, John Pylelo. Carried 3-1, Boykin opposed. Copy filed.
The Board discussed the ICN Room lease with James Thompson, Department of Human Services.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a lease agreement with the State of Iowa to lease the ICN Room at the Trosper-Hoyt Services Building, effective 01/01/2009 through 12/31/2009. Carried 4-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Batcheller second by Boykin to go into closed session per Iowa Code 21.5(1)(c). Carried 4-0 on a roll-call vote.
Motion by Batcheller second by Monson to go out of closed session per Iowa Code 21.5(1)(c). Carried 4-0 on a roll-call vote.
Motion by Boykin second by Monson to approve the recommendation of the County Attorney. Carried 4-0.
The Board adjourned the regular meeting until September 30, 2008.
