SEPTEMBER 16, 2008THIRTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 16, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the September 9, 2008 meeting as submitted.

Motion by Clausen second by Boykin to amend the minutes of the September 9, 2008 meeting by inserting Supervisor Clausen briefly referred to sections of the Countys 2005 Development Plan as reasons for denial. These sections were 1.2 and 1.6 of Land Use Goals; Section 2.1 of Agricultural Goals and Section 3.2 of Conservation and Environmental Goals. before the motion Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution approving the final platting for Framax Acres Addition Subdivision, GIS #874705200001, #874705200002, #874705200006, and #874705200007, per recommendation of John Pylelo. Failed 0-5. Motion carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve tax abatement on the following parcels owned by Union Pacific Railroad: #894709300011 for $50.00 taxes due 2008-2009, #874716100009 for $18.00 taxes due 2008-2009, #874716400008 for $54.00 taxes due for 2008-2009, and #874721200008 for $22.00 taxes due for 2008-2009.
Carried 5-0.

Motion by Batcheller second by Clausen to approve tax abatement for the following parcels:

#884730301950, Penny Straw, building on leased land for mobile home, no longer assessed. Taxes due payable 2006-2007, 2007-2008, and 2008-2009 totaling $314.00 plus interest.

#884730301970, Marian Bettin, building on leased land for a mobile home that has been removed. Taxes due payable 2008-2009 total $32.00.

Carried 5-0.

Motion by Batcheller second by Monson to receive the appointment of Greg Crook, 312 4th Avenue, Hornick, Iowa for the office of City of Hornick Council Member position previously held by Robert Dietrich, until the 2009 City Election. Carried
5-0.

The Board discussed holding a public auction on the County Farm lease.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to set a public hearing date for the County Farm lease. Carried 5-0.

Motion by Clausen second by Batcheller to postpone action to approve and authorize the Chairman to sign a farm bin lease with Mr. Frank Welte, Western Slopes Farm. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by MidAmerican Energy to install two signs in the right-of-way of Port Neal Road, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Certificate of Completion for project
#L-B05(5)73-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve lifting the tax suspension for Beverly Ann Monk, 105 Leonard Street, Sioux City, Iowa, as the property has been sold. Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #261270 (1806 W. 2nd Street). Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot 3, Block 27 of Hornicks Addition,
City of Sioux City, Woodbury County, IA

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 30th Day of September, 2008 at 10:15 oclock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 30th
Day of September, 2008, immediately following the closing of the public
hearing to Sharon K. Culbertson only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Sharon K.
Culbertson only for consideration of $1.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 30th Day of September, 2008 at 10:16 oclock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 30th Day of September, 2008, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $200.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

There were no further bids.

Motion by Batcheller second by Boykin to accept the bid of Greg Deman in the amount of $20,000.00 plus recording fees, for property parcel #029085 (113 13th Street). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By UPTOWN HOLDINGS LLC in the sum of TWENTY THOUSAND & 00/100 ($20,000.00)--------------- dollars.

For the following described real estate, To Wit:

Parcel #029085
The W. 50 Ft. of Lots 7, 8, and 9 in Block 78, Sioux City East Addition,
City of Sioux City, Woodbury County, IA
(113 13th St.)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.
