JULY 29, 2008THIRTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 29, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Monson second by Clausen to approve the Board minutes of the July 22, 2008 meeting as submitted Carried 4-0; Boykin abstained. Copy filed.
The Board approved the separation of Cody F. Forch, Temporary Summer Laborer, Secondary Roads Dept., effective 08/13/2008. End of temporary work. Copy filed.
The Board approved the reclassification of Samson Harris, Custodian, Building Services Dept., $11.83/hour, effective 08/14/2008. Per AFSCME Courthouse contract agreement from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.
The Board approved the separation of Jeffrey D. Sailer, Temporary Summer Laborer, Secondary Roads Dept., effective 08/15/2008. End of temporary work. Copy filed.
The Board approved the separation of Reese A. Sudtelgte, Temporary Engineering Aide, Secondary Roads Dept., effective 08/15/2008. End of temporary work. Copy filed.
The Board approved the reclassification of Michael T. McDonald, Custodian, Building Services Dept., $13.20/hour, effective 08/17/2008. Per AFSCME Courthouse contract agreement from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.
The Board approved the reclassification of David A. Dawson, Assistant County Attorney, County Attorney Dept., $68,208/year, effective 08/19/2008. Per AFSCME Assistant County Attorney contract agreement, from Step 8 to Step 9. Copy filed.
Motion by Monson second by Batcheller to approve and authorize the Chairman to sign the Agreement for Employee Assistance Program Services to Woodbury County, for the period from July 1, 2008 through June 30, 2009. Carried 5-0. Copy filed.
Motion by Monson second by Batcheller to receive the appointment by the Smithland City Council of Kathryn Mack to fill a vacancy on the Council. Carried 5-0.
Motion by Clausen second by Monson to approve and authorize the Chairman to lift tax suspension for Dorothy Schonrock for Parcel #219780, 117 S. Colon Street. Carried 5-0. Copy filed.
Motion by Clausen second by Monson to approve and authorize the Chairman to cancel the direct sale of Parcel #219495, 114 S. Casselman Street. Carried 5-0. Copy filed.
Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a resolution to directly sell Parcel #219495, 114 S. Casselman Street, to Paul S. Skelton for $1.00 plus recording fees. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
N. 1.6 Ft. S. 9.6 Ft., Lot 6, Highland Addition, City of Sioux City, Woodbury County, IA

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 12th Day of August, 2008 at 10:16 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate on the 12th Day of August, 2008, immediately following the closing of the public hearing to Paul S. Skelton only per Code of Iowa 331.361 (2).
3. That said Board proposes to sell the said real estate to Paul S. Skelton only for consideration of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a resolution repealing old zoning ordinances for unincorporated areas of Woodbury County. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION # 10,455
The Woodbury County, Iowa, Board of Supervisors adopted new comprehensive zoning ordinances establishing zoning regulations for the unincorporated area of Woodbury County, Iowa on the 22nd day of July 2008 to be effective upon the date in which the complete text of the ordinances are published.
NOW, THEREFORE, BE IT RESOLVED, all previous zoning ordinances are repealed upon the effective date of the new zoning ordinances adopted by the Woodbury County Board of Supervisors on the 22nd day of July 2008.
SO RESOLVED this 29th day of July, 2008.

RESOLUTION # 10,456
The Woodbury County, Iowa, Board of Supervisors adopted new subdivision ordinances prescribing minimum requirements for the design and development of new subdivisions and the re subdivision of land in the unincorporated area of Woodbury County, Iowa on the 22nd day of July 2008 to be effective upon the date in which the complete text of the ordinances are published.
NOW, THEREFORE, BE IT RESOLVED, all previous subdivision ordinances are repealed upon the effective date of the new zoning ordinances adopted by the Woodbury County Board of Supervisors on the 22nd day of July 2008.

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a utility accommodation permit by Hi-Tech Electric LLC on behalf of Qwest Communications which allows them to place an underground telephone line in the right-of-way of Lucas Avenue between 170th and 180th Streets, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
There was a discussion on a proposed pit bull ordinance.
The Board adjourned the regular meeting until August 5, 2008.
