JULY 1, 2008TWENTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 1, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator and Patrick F. Gill, Auditor/Clerk to the Board. Loan Hensley, Assistant County Attorney/Board Legal Counsel, participated by phone.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Batcheller second by Monson to approve the Board minutes of the June 24, 2008 meeting as submitted. Carried 5-0. Copy filed.
Motion by Monson second by Boykin to approve the Board minutes of the June 23, 2008 special meeting as submitted. Carried 5-0. Copy filed.
The Board approved the appointment of Caroline E. Tompkins, HR Safety/Risk Coordinator, Human Resources Dept., $36,000/year, effective 07/07/2008. Job vacancy posted 03/25/2008, 04/07/2008, and 05/14/2008. Entry level salary: $36,000/year. Copy filed.
The Board approved the appointment of Sabrina L. Cooley, Part-time Youth Worker, Juvenile Detention Dept., $14.50/hour, effective 07/07/2008. Job vacancy posted 05/01/2008. Entry level salary, fiscal year 2008-2009: $14.50/hour. Copy filed.
The Board approved the reclassification of Katie A. Tucker, Part-time Youth Worker, Juvenile Detention Dept., $18.25/hour, effective 07/13/2008. Per AFSCME J. D. contract agreement from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.
Gallagher Benefit Services addressed the Board with employee benefit services they could provide Woodbury County with.
Motion by Batcheller second by Boykin to direct the Human Resources Department to prepare a contract for signature with Gallagher Benefit Services, Inc. to provide services for Woodbury County. Carried 5-0.
A public hearing was held at 10:15 a.m. for the sale of real estate parcel #349876 (aka 3511 Correctionville Road). The Chairman called on anyone wishing to be heard.
Motion by Boykin second by Batcheller to close the hearing. Carried 5-0.
The Chairman called for bids.
Reinhold Hoffman bid the minimum bid of $150.00
There were no other bids.
Motion by Batcheller second by Boykin to approve the bid received from Reinhold Hoffman in the amount of $150.00, plus recording costs, for the purchase of real estate parcel #349876 (aka 3511 Correctionville Road). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By REINHOLD HOFFMANN in the sum of ONE HUNDRED FIFTY & 00/100 ($150.00)-------------------------------------------- dollars.
For the following described real estate, To Wit:
Parcel #349876
Except S. 35 Ft. of Lots 10 and 11 in Block 4 of the Miller Addition, City of Sioux City,
Woodbury County, IA
(3511 Correctionville Rd.)
Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

A public hearing was held at 10:15 a.m. for the sale of real estate parcel #282870 (aka 1511 Lansdown Avenue). The Chairman called on anyone wishing to be heard.
Mrs. Willard D. Maaske, 1501 Lansdown Ave., Sioux City, spoke in opposition to the proposed sale and asked for a directed sale and Danny Robinson, 1515 Goldie Ave., Sioux City, spoke in favor.
Motion by Clausen second by Boykin to close the hearing. Carried 5-0.
Motion by Boykin second by Clausen to not proceed with the sale. Carried 5-0.
Motion by Monson second by Clausen to approve a 12-month, Class C, commercial liquor license, with Sunday sales privileges, for Theos, Incorporated, 1911 Highway 20 East, Lawton, IA, effective 07/01/2008 through 06/30/2009. Carried 5-0. Copy filed.
Motion by Monson second by Boykin to approve the re-appointment of Wanda Carrier, to the Library Board of Directors. Carried 5-0.
Motion by Monson second by Batcheller to approve the appointment of Doug Lehman to the Commission to Assess Damages, Category D-Persons Having Knowledge of Property Values in the County by Reason of Their Occupation. Carried 5-0.
Fran Sadden, Siouxland District Health, updated the Board with changes/additions to the approved Woodbury County Bio-Emergency Response Plan version 8.2 2008.
Motion by Boykin second by Monson to approve the changes/additions as presented by Fran Sadden, Siouxland District Health Dept. Carried 5-0. Copy filed.
The Board discussed whether to allow smoking in Woodbury County building parking lots, as is permitted in Iowa House File 2212, which goes into effect 07/01/2008, with Loan Hensley, Assistant Woodbury County Attorney.
Motion by Batcheller second by Clausen to designate the parking lots of Woodbury County buildings as no smoking areas.
Mr. Batcheller asked to withdraw his motion and he was allowed to do so without objection.
Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a trademark license agreement with HyVee, pertaining to the use of the Sioux City Sue logo. Carried 5-0. Copy filed.
The Board discussed the costs associated with publication of zoning and subdivision ordinances, scheduled to be adopted on the 07/08/2008 public hearing, with John Pylelo, Zoning and Planning Administrator.
Motion by Boykin second by Monson to approve publication of the entire ordinance in the Sioux City Journal. Carried 5-0.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign contract and approve bonds for project #L-B05(5)73-97, Nelson and Rock Contracting, Onawa, Iowa, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a final payment voucher for project #BRS-CO97(63)60-97, Dixon Construction Company, Correctionville, Iowa, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Batcheller second by Boykin to award the bid for a single-axle flat bed truck to Great Plains, International, Sioux City, IA, in the amount of $75,144.00, per recommendation of the County Engineer. Carried 5-0. Copy filed.
The Board discussed incorporating SUDAS design guidelines and requirements into zoning ordinances, with County Engineer Richard Storm.
County Engineer Richard Storm addressed the Board regarding past fuel purchases by the Secondary Roads Dept.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Terry Petekavich, 810 South Street, Pierson, addressed the Board with concerns about his previous employment with the County.
The Board adjourned the regular meeting until July 8, 2008.
