JUNE 10, 2008TWENTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 10, 2008 at 9:00 a.m. Board members present were Batcheller, Clausen, Monson, and Walish; Boykin was absent. Staff members present were Denise Fletcher, Public Bidder and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Board of Supervisors meeting was called to order.
Motion by Monson second by Batcheller to approve the Board minutes of the June 3, 2008 meeting as submitted. Carried 4-0. Copy filed.
The Board of Supervisors canvassed the General Primary Election held on the 3rd day of June, 2008 with the following official results:
Victoria L. Ritz, Deputy Commissioner of Elections, announced there were no provisional ballots and one (1) after-election absentee ballot that was rejected.

A public hearing was held at 10:15 a.m. for property parcel #461175 (710 S. Lewis Blvd.). The Chairman called on anyone wishing to be heard.
Motion by Clausen second by Monson to close the hearing. Carried 4-0.
The Chairman called for bids.
There were no bids.
Bid letting was held at 10:20 a.m. for project #L-B05(3)73-97, for 84 reinforced concrete pipe. The bids were as follows:

Motion by Batcheller second by Monson to receive the bids and award the project to L.A. Carlson Contractors for the bid price of $154,973.85 subject to the review of the county engineer. Carried 4-0. Copy filed.
Bid letting was held at 10:25 a.m. for project #L-B05(5)73-97, for 10x8 RCB culvert with drop inlet. The bids were as follows:

Motion by Clausen second by Batcheller to receive the bids and award the project to Nelson Rock Contractors for the bid price of subject to the review of the County Engineer for review. Carried 4-0. Copy filed.
The Board reviewed final platting for Framax Acres Addition Subdivision, GIS parcels #874705200001, #874705200002, #874705200006, and #874705200007, with John Pylelo, Planning and Zoning Administrator.
Motion by Batcheller second by Monson to refer the final platting agreement for Framax Acres Addition Subdivision to the County Attorney for review and recommendation. Carried 4-0.
The Board reviewed final platting for Marx Development Addition Subdivision, GIS parcel #874801200008, with John Pylelo, Planning and Zoning Administrator.
Motion by Monson second by Clausen to approve the final platting for Marx Development Addition Subdivision and forward it to the Zoning Commission for review and recommendations. Carried 4-0.
Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for real estate parcel #564315 (100 Lemon St.). Carried 4-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 24th Day of June, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 24th Day of June, 2008, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $500.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Clausen second by Monson to approve and receive for signatures, a Resolution authorizing establishing a 2008 crop year contract between the Woodbury County Board of Supervisors, as Trustees of Wolf Creek Pumping Station District, and Douglas Washburn, to operate pumps, per recommendation of the County Engineer. Carried 4-0.
RESOLUTION NO. 10,424
WOLF CREEK DRAINAGE DISTRICT/PUMPING STATION
RESOLUTION REQUIRING CONTRACT
TO OPERATE PUMPS
WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Drainage District and as the governing body has approved and established certain pumping stations in connection therewith; and
WHEREAS, the Board of Supervisors as the governing body of the Wolf Creek Drainage District and its pumping station(s) has previously contracted for the pumping of excess surface waters in the Wolf Creek Pumping Station District; and
WHEREAS, it appears that authority for pumping of excess surface waters including the use of the district owned pumping equipment should be renewed in the event of rainfall which might require pumping in the affected area.
NOW THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that this Board as Trustees of Wolf Creek Pumping Station District should enter into a contract for the crop year of 2008, for the operation and maintenance of the pumping stations in the Wolf Creek Drainage District heretofore established by this Board.
BE IT FURTHER RESOLVED, that the Chairman of this Board be and he is hereby authorized and directed to enter into that Employment Contract with Douglas Washburn, as per the attached form of Employment Contract, subject to the Guidelines for the operation of the Wolf Creek Pumping Station District.
IT IS FURTHER RESOLVED that in connection herewith, the Contractor, Douglas Washburn, will furnish evidence of insurance as required by Paragraph 4 of said Contract.
