MAY 27, 2008TWENTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 27, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, and Jean Jessen, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the May 20, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Jeffrey D. Sailer, Temporary Engineering Aide, Secondary Roads Dept., $10.00//hour, effective 05/28/2008. Job vacancy posted: 03/10/2008. Salary range: $7.50-$12.50/hour based on experience with Woodbury County. Copy filed.

The Board approved the appointment of Reese A. Sudtelgte, Temporary Engineering Aide, Secondary Roads Dept., $9.00//hour, effective 05/28/2008. Job vacancy posted: 03/10/2008. Salary range: $7.50-$12.50/hour based on experience with Woodbury County. Copy filed.

The Board approved the appointment of Luke S. Jenkins, Temporary Summer Laborer, Secondary Roads Dept., $9.00/hour, effective 05/28/2008. Job vacancy posted 03/10/2008. Salary range: $8.00-$10.00, based on experience with Woodbury County. Copy filed.

The Board approved the appointment of Cody F. Forch, Temporary Summer Laborer, Secondary Roads Dept., $9.00/hour, effective 05/28/2008. Job vacancy posted 03/10/2008. Salary range: $8.00-$10.00, based on experience with Woodbury County. Copy filed.

The Board approved the reclassification of Loan H. Hensley, Assistant County Attorney (Civil Division), County Attorney Dept., $56,145/year, effective 07/01/2008. Per Wage Plan comparability with AFSCME Assistant Attorney contract. Copy filed.

Motion by Boykin second by Batcheller to approve a request made by retiring County employee (07/31/2008) Daniel V. Weakley, Siouxland District Health Department, to allow his spouse to remain on the County health insurance plan at her own expense, effective 08/01/2008. Carried 5-0.

Motion by Monson second by Batcheller to approve a request by County Treasurer Bob Knowler to use the Courthouse rotunda the evening of May 12, 2009, for a reception for the Iowa County Treasurers and Deputies. Carried 5-0.

The Board reviewed final platting of Framax Acres Addition subdivision, GIS #874705200001, #874705200002, #874705200006, and #874705200007, with Planning and Zoning Director John Pylelo.

Motion by Boykin second by Monson to approve the final platting of Framax Acres Addition subdivision, GIS #874705200001, #874705200002, #874705200006, and #874705200007, with the condition that the County Engineer must sign-off on the drainage assessment plan, and it must include the agreement for paving 22nd Street, before forwarding it to the Zoning Commission for review and recommendations. Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of property parcel #524310 (aka 2112 Douglas Street). The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Monson to close the hearing. Carried 5-0.

There were no bids.

A public hearing was held at 10:18 a.m. for the sale of property parcel #059055 (aka 1417 Silver Street). The Chairman called on anyone wishing to be heard.

Motion by Batcheller second by Clausen to close the hearing. Carried 5-0.

Douglas Jervik bid $500.00.

Motion by Boykin second by Monson to approve the bid received from Douglas Jervik in the amount of $500.00 plus recording costs, for the purchase of property parcel #059055 (aka 1417 Silver Street). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By DJS STEREO TOWN in the sum of FIVE HUNDRED & 00/100 ($500.00)------------------------- dollars.

For the following described real estate, To Wit:

Parcel #059055
Lot 3, Block 39, North Sioux City Addition, City of Sioux City, Woodbury County, IA
(1417 Silver St.)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 10th Day of June, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 10th Day of June, 2008, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $75.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Boykin second by Clausen to receive the recommendation of the County Engineer and award the bid for two snow plows to Murphy Tractor, in the amount of $15,688.00. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to receive the recommendation of the County Engineer and award the bid for two tail gate sanders to Steffen, Incorporated, in the amount of $10,800.00. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve Amendment #1 to Secondary Roads Dept. budget for fiscal year 2008. Carried 5-0. Copy filed.

A public hearing was held at 10:30 a.m. for Amendment #1 for the fiscal year 2008 County budget. The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Clausen to close the hearing. Carried 5-0.

Motion by Clausen second by Boykin to approve Amendment #1 to the fiscal year 2008 County budget. Carried 5-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until June 3, 2008.
