MARCH 25, 2008THIRTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 25, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson; and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting was called to order.

Motion by Monson second by Boykin to approve the Board minutes of the March 18, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the reclassification of Brent E. DeVries, Correctional Officer, County Sheriff Dept., $16.09/hour, effective 04/01/2008. Per D.S.A. contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Loan H. Hensley, Assistant County Attorney, County Attorney Dept., $53,727/year, effective 04/16/2008. Per Wage Plan comparability with A.F.S.C.M.E. Assistant Attorney contract, from Step 4 to Step 5. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign an authorization to initiate hiring process for a Certified Engineering Technician II, Secondary Roads Dept. Entry level: C.W.A. $18.54/hour. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign a request to de-authorize a County position for Engineering Technician I, Secondary Roads Dept. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign the Iowa Individual Health Benefit Reinsurance Program 2007 Annual Reporting form. Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Tax Exemption Certificate providing specific details regarding facts, promises, and obligations which must be met and agreed to by the County, in order to maintain the $800,000 General Obligation Capital Loan Notes. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Resolution authorizing a form of loan agreement, and authorizing and providing for the issuance of Capital Loan Notes and levying a tax to pay the notes. Carried 5-0.

The Board discussed renewing the Countys membership to the US 20 Corridor Association.

Motion by Batcheller second by Monson to approve renewing the Countys membership to the US 20 Corridor Association in the amount of $250.00. Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of real estate parcel #133050 (113 West Street). The Chairman called on anyone wishing to be heard.

Motion by Batcheller second by Clausen to close the hearing. The Chairman called for bids.

Motion by Batcheller second by Monson to approve the sale of real estate parcel #133050 (113 West Street) to Rito Losa for the amount of $1.00 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 8th Day of April, 2008 at 10:25 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 8th Day of April, 2008, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 1.00 plus recording fees.

WHEREAS, Linda S. Carlson, is the titleholder of property located at 100 Main St., City of Sioux City, Woodbury County, Iowa, and legally described as follows:

WHEREAS, Linda S. Carlson as titleholder of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Monson to approve and receive for signatures a contract with Calhoun-Burns for 2008-2009 bridge inspection services, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution providing the Secondary Roads Dept. with the authority to establish weight restrictions on certain County roads, as required, per recommendation of the County Engineer. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION NO. # 10,370

WHEREAS, the Woodbury County Board of Supervisors believe certain secondary roads in Woodbury County, Iowa which are paved or unpaved, will be seriously damaged or destroyed unless the us of vehicles thereon is prohibited or permissible weight thereon reduced, and

WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operations of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operations of vehicles weighing in excess of said weight limit are prohibited on said highway.

IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in exhibit A, attached thereto and by this reference made part hereof. The effective of this resolution is March 25, 2008 through and including May 23, 2008.
