MARCH 18, 2008TWELFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 18, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Monson; and Walish; Clausen was absent. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the March 11, 2008 meeting as submitted. Carried 4-0. Copy filed.

The Board approved the reinstatement of Chad L. Heckert, Correctional Officer, County Sheriff Dept., $16.09/hour, effective 03/12/2008. Reinstatement of employment with no break in service: 3-12-08. Copy filed.

The Board approved the appointment of Nicholas J. Kellen, P/T Youth Worker, Juvenile Detention Dept., $13.94/hour, effective 03/24/2008. Job vacancy posted: 1-23-08. Entry level salary: $13.94/hour. Copy filed.

The Board approved the promotion of Gloria A. Mollet, Administrative Assistant, Human Resources Dept., effective 03/24/2008. In-House vacancy posted: 3-05-08. Entry level salary: $40,190/year. Copy filed.

The Board approved the resignation of Jermaine Greenaway, Part-Time Male Youth Worker, Juvenile Detention Dept., effective 03/27/2008. Resignation. Copy filed.

The Board approved the end of medical leave of absence of Elizabeth A. Schermerhorn, Assistant Director, Juvenile Detention Dept., effective 03/28/2008. End of medical leave of absence. Copy filed.

The Board approved the reclassification of Peri J. Nelson, Case Manager, Social Services Dept., $37,663/year, effective 03/28/2008. Per Wage Plan Matrix to 3-year level. Copy filed.

The Board approved the reclassification of Cynthia L. Weber-Blair, Assistant County Attorney, County Attorney Dept., $53,727/year, effective 03/30/2008. Per AFSCME Assistant Attorney contract agreement, from step 4 to step 5. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for:

H.R. Safety/Risk Coordinator, Human Resources Dept. Entry level: Wage Plan: $13.24-$16.68/hour, based on experience.

Part-Time Male Youth Worker, Juvenile Detention Dept. Entry level: AFSCME J.D. $13.94/hour.

Mark Olsen, Director, Woodbury County Juvenile Detention Center, presented to the Board for review and approval, a proposed contract between Woodbury and Union County for the purpose of providing detention services.

Motion by Batcheller second by Monson to approve a contract between Woodbury and Union County for the purpose of providing detention services. Carried 4-0. Copy filed.

Motion by Monson second by Boykin to appoint Frances Sadden to the Board of the Community Action Agency of Siouxland in the category of Health Representative. Carried 4-0. Copy filed.

Motion by Batcheller second by Boykin to approve the NACO prize money of $2,500 be used for the local food project as recommended by Rob Marqusee, Director, Rural Economic Development. Carried 3-0; Monson abstained. Copy filed.

A public hearing was held at 10:15 a.m. for the sale of property parcel #115860 (aka 2813 7th Street). The Chairman called on anyone wishing to be heard.

Jerry Sponder of South Sioux spoke against the sale of the property.

Motion by Batcheller second by Boykin to close the public hearing for the sale of property parcel #115860 (aka 2813 7th Street). Carried 4-0.

Motion by Batcheller second by Monson to accept the bid of Star Safi for property parcel #115860 (aka 2813 7th Street) for $1.00 plus recording fees. Motion failed 0-4.

A public hearing was held at 10:16 a.m. for the sale of property parcel #127035 (aka 101 S. Lemon Street). The Chairman called on anyone wishing to be heard.

Motion by Batcheller second by Boykin to close the public hearing for the sale of property parcel #127035 (aka 101 S. Lemon Street). Carried 4-0.

Motion by Boykin second by Monson to accept the bid of Arnold Richtermeier for property parcel #127035 (aka 101 S. Lemon Street) for $1.00 plus recording fees. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution Approving Petition for Suspension of Taxes for Kathryn Lin White for Parcel #894729228009, 1309 Main Street, Sioux City, Iowa. Carried 4-0.

RESOLUTION APPROVING PETITION FOR
SUSPENSION OF TAXES

WHEREAS, Kathryn L. White, is the titleholder of property located at 1309 Main St., City of Sioux City, Woodbury County, Iowa, and legally described as follows:

North 1/3 LOTS 24-25 Shearers Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Kathryn L. White as titleholder of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Frank Baron, Attorney with the Law Firm of Baron, Sar, Goodwin, Gill and Lohr, asked to postpone a presentation to the Board concerning what the Legal Aid Advisory Council does and requests some funding from the Board of Supervisors.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a contract and bonds for project BROS-CO97(84)5F-97 with Midwest Contracting, LLC of Marshall MN. per recommendation of Richard Storm, County Engineer. Carried 4-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until March 25, 2008.
