JANUARY 29, 2008FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, January 29, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish . Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Monson second by Clausen to approve the Board minutes of the January 22, 2008 meeting as submitted. Carried 4-0; Batcheller abstained. Copy filed.
The Board approved the appointment of Karla A. Polley, Vital Statistics Clerk II, County Auditor/Recorder Dept., effective 01/30/2008. Job vacancy posted 12/11/2007. Entry level salary: $11.88/hour. Copy filed.
The Board approved the reclassification of David C. Skilling, Assistant County Attorney, County Attorney Dept., $65,271/year, effective 02/17/2008. Per AFSCME Assistant Attorney contract agreement from Step 8 to Step 9. Copy filed.
Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for:
(1) Temporary Equipment Operator, Secondary Roads Dept. Entry level: C.W.A. $16.55/hour.
(2) Temporary Paper Shredder, Social Services Dept. Entry level: Wage plan $7.25/hour.

Motion by Clausen second by Monson to receive and authorize the Chairman to sign the 2007 OSHA 300A reports, by department, as submitted. Carried 5-0.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign contracts and bonds for project #BROS-CO97(82)8J-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a contract with Hallett Materials, Lake View, Iowa, for 2008 maintenance gravel, per recommendation of the County Engineer. Carried

Motion by Monson second by Boykin to approve and receive for signatures, a 12-month, Class C beer permit, with Sunday Sales, for Salix Gas, 1556 275th Street, Salix, Iowa, effective 02/04/2008 through 02/03/2009. Carried 5-0. Copy filed.
Motion by Batcheller second by Boykin to deny the request to approve and authorize the Chairman to sign a Resolution approving abatement of taxes due for the 2006-2007 assessment period, for Siouxland Community Christian School, parcel #561285. Carried 5-0.
Motion by Boykin second by Monson to approve lifting the tax suspension for Arturo F. Topete, 1315 W. 19th Street, Sioux City, Iowa, per his request. Carried 5-0.
Motion by Clausen second by Boykin to approve lifting the tax suspension for Iva F. Wilen, 1916 S. Olive Street, Sioux City, Iowa, as she is deceased. Carried 5-0.
Motion by Boykin second by Clausen to approve lifting the tax suspension for Patricia Edwards, 5309 Hwy 75 N, Lot 455, Sioux City, Iowa, as the property has been sold. Carried 5-0.
A public hearing was held at 10:15 a.m. for the sale of property parcel #081015 (aka 2905 W. 4th Street, Sioux City, Iowa). The Chairman called on anyone wishing to be heard.
Motion by Monson second by Batcheller to close the hearing. Carried 5-0.
Motion by Monson second by Boykin to accept the offer of Kent Meyer in the amount of $1.00 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By KENT J. MEYER in the sum of ONE & 00/100 ($1.00)------------------------------ dollars.
For the following described real estate, To Wit:

The W. 4 Ft. of the N. Half of Lot 2, Block 8, Bradstreet Addition, Sioux City,
Woodbury County, IA
(2905 W. 4th St.)
Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed tax abatement for parcels which are buildings on leased land for mobile homes that have been disposed of.
Motion by Clausen second by Monson to approve a tax abatement for Parcel #8947-23-200-939 Greg A. Slachetka - Taxes due and payable 2006-2007 total $46.00, plus interest and costs. Carried 5-0.
Motion by Clausen second by Boykin to approve a tax abatement for Parcel #8947-23-200-905 - Taxes due and payable 2005-2006 and 2006-2007 total $34.00, plus interest and costs. Carried 5-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Budget discussions were held for the following departments.
County Sheriff General Basic
Motion by Boykin second by Batcheller to receive the Uniform Patrol budget reduced by $1,375.00. Carried 5-0.
A public hearing was held at 10:45 a.m. for recommendations to the Iowa Department of Natural Resources on an animal confinement facility construction permit application for Mr. Lance Mouw, d.b.a. Jersey North, LLP.
The Chairman called on anyone wishing to be heard.
Jersey North, LLP made a formal presentation, those presenting were Dr. Greg Bleeker, DVM, 137 W. Green Oaks Dr., Visalia, CA, Lance Mouw, 20799 Rd. 465, Tulare, CA, Nick Rowe, Jacobson-Westergard & Associates, Doug Yantzi, 846 31st St., Geneva, NE, Kendall Boenenberger, 7750 S. 36th St., Lincoln, NE and Chris Mondak, DVM, ISU Extension.
Jeff Paulson, an attorney representing a group opposed to the permit application, Chuck Hoelker, 2468 110TH St., Kingsley, Jason Schoenrock, 32322 K49, Hinton, Kevin Miller, 1013 Emmet Ave., Lawton and Bret Riebesell, 2186 110th, Lawton stated their opposition to the permit application and presented a petition and photos to the Board.
Motion by Monson second by Batcheller to receive a petition representing signatures opposed to the permit application. Carried 5-0. Copy filed.
Motion by Batcheller second by Monson to receive exhibits marked A and B opposed to the permit application. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to recommend to disapprove an Animal Confinement Facility Construction Permit application for Mr. Lance Mouw doing business as Jersey North, LLP. Carried 4-1; Batcheller opposed.

Motion by Boykin second by Monson to move one budgeted position ($52,028.00) from the Uniform Patrol budget to the Investigations Budget, and various changes of $1,353.00 that caused further reductions. Carried 4-0.
Motion by Boykin second by Monson to receive the Investigations budget increased by $1,728.00. Carried 4-0.
Motion by Monson second by Boykin to receive the LEC-Correctional Facility budget reduced by $25,653.00. Carried 4-0.
Motion by Boykin second by Monson to receive the Prairie Hills-Correctional Facility budget increased by $75.00. Carried 4-0.
Motion by Boykin second by Monson to receive the Administration budget reduced by one budgeted position ($77,986.00). Carried 4-0.
Motion by Boykin second by Monson to receive the Civil Division budget as submitted. Carried 4-0.
Motion by Boykin second by Monson to receive the Highway Safety budget as submitted. Carried 4-0.
Motion by Boykin second by Monson to receive the Crime Prevention budget as submitted. Carried 4-0.
Motion by Boykin second by Monson to receive the DARE Grant budget as submitted. Carried 4-0.
Motion by Boykin second by Clausen to receive the Equipment Replacement Fund budget as submitted.
Carried 4-0.

Motion by Boykin second by Monson to receive the Uniform Patrol (Rural Basic) budget as submitted. Carried 4-0.
Motion by Monson second by Boykin to receive the Court Security (General Supplemental) budget increased by $9,375. Carried 4-0.
Motion by Monson second by Boykin to receive the Sheriffs Forfeiture budget as submitted. Carried 4-0.
Motion by Clausen second by Boykin to receive the DARE Donations budget as submitted. Carried 4-0.
Motion by Monson second by Boykin to receive the Veteran Affairs Administration (General Basic) budget as submitted. Carried 4-0.
Motion by Clausen second by Monson to receive the Veteran Affairs Assistance (General Basic) budget reduced by $6,000.00. Failed 1-3, Boykin, Walish, and Monson opposed.
Motion by Monson second by Boykin to receive the Veteran Affairs Assistance (General Basic) budget as submitted. Carried 3-1; Clausen opposed.
The Board adjourned the regular meeting until February 5, 2008.
